I have been lied to about every aspect of my contract with Payment Systems, including not being told of signing with two seperate companies - Lease Finance Group and GETI, the amount of early contract termination fees, undisclosed monthly fees, and the cancellation of my former credit processor contract. As well as being told that my current credit card machine was not PCI complaint and was illegal-I believe this was a lie, because we were therefore told we needed to lease a machine through Payment Systems.

I'm already being over charged by Lease Finance Group(credit card machine lease) and my statement from Payment Systems has multiple undisclosed fees. I purposely asked questions to our sales rep., due to my wife's business being slow, and received answers that ultimately were complete lies about cancellation terms and fees. 

We've also discovered forged documents signing us up for for a gift card service we never agreed to. When we cancelled the service we were immediately charged (directly debited) $221 for cancelling (again undisclosed-and forged)

In light of what I feel is deception, fraud, forgery, entrapment and unethical business practices, as well as the discovery of thousands of similar business owner complaints,we're currently asking Payment Systems to cancel all contracts without recourse. We've informed Payment Systems that we have formal complaints written for the AG, BBB, FTC and Well's Fargo Bank. We've spoken to our local AG rep. and they've advised us to cancel our bank account. We're waiting to see if Payment Systems handles this on their own before we cancel accounts and file the complaints.

Any advice or help would be appreciated. I'll post again if I have any updates.

Hi all! 

I've been doing a lot of reading about this company and the complaints that have been filed against them. 

I have a few simple solutions to any business owner that is looking to avoid a similar dilemma:

1) Read your contract

        At the end of the day the contract is the actual agreement you are making with the company. None of the things you talk to your salesman about matter if they aren't in the contract. 

        Someone can walk into your store and tell you they'll sell you a pink giraffe for $5 but if that isn't what the contract says, you're not gonna get a pink giraffe. 

        So, If you don't read your contracts carefully before you sign them you are welcoming this problem into your business and your life. 

 

2) Get a feel for the salesman

        If you sign anything given to you by an agent that seems "confused" or appears to have had "thoroughly inadequate training", you only have yourself to blame for any problems you may run into.

 

        You can always ask a company to send you a more competent salesman, or you can tell them not to send anyone. 

        More often than not, people in sales are following a script and may not have a strong understanding of what they are selling. Again, it is your responsibility as a business owner to KNOW WHAT YOU ARE BUYING and who from!!

Big Scammers

It is very Sad that the BBB doing NOTHING about it. The Payment Systems, Lease Finance Group and Global Leasing Group, they all go together scammers.

Sorry for the late reply.
It in California and the leasing company is in Illinois. The company name is global leasing
He told my dad he can cancel it for 199. But he did not tell my dad about the real amount of $995 to cancel it.
And he also told my dad he can cancel the leasing contract for the machine but in the contract it said we can't.
The sales man mislead my dad who can't speak English very well.
And also the fee keep adding up, fee after fee after fee.

Where are you located?

You can start by sending complaints to the Attorney General's of CA, Illinois, New York and your home state.  The AG of NY is currently fighting Lease Finance Group. Are they the holder of your equipment lease?

Write to the BBB.  Most of all contact an attorney immediately.  The AG offices are relucant to help and most states consider the business-to-business transaction a civil matter.  In other words you are on your own.  If you can't afford an attorney find one and beg for their help.

My dad also another victim of payment systems corp. one of the salesman came and talk to my dad. since my dad can't really speak English, he did sign the contract.

I am sorry to hear what happened to you. The same thing happened to me from these people at the Lease Finance Group. I am Christian and won't be harsh or nasty or maliciously attack people.
I saw all complaints against them. Friends, what goes around comes around. One day will see if we this company will be in existing. Please be careful and stay away from them.

We have court-ready documentation and evidence of fraud perpetrated by Payment Systems.  We are looking for
numbers of persons who have been told the following:

1.  Payment Systems sales agent promised to drop your processing rate to a flat 1% of your total monthly
processing volume.

2.  Payment Systems sales agent claimed they did not charge/collect "interchange fees".

3.  Payment Systems sales agent claimed it would reduce your total monthly fees depending upon a statement
presented to the sales agent.  Was the claim made that the total fees would equal 1% of total volume or close to it based on the presented statement?

4.  Payment Systems sales agent added a "subtotal" in your statement to the total fees in order to  induce you to think
that your total fees for a month were actually nearly twice as high as they really were.  

5.  Your current terminal used for processing was "not PCI compliant", and therefore needed to be replaced
with a terminal on a lease rate of $100 per month or more.  (Payment Systems is not a "processor", but rather an ISO, or Independent Sales Organization Merchant Service Provider, and uses First Data to handle its processing. Most terminals currently running on any real processor are PCI compliant, and do not need replacing for the claimed reason.  We can tell you how to determine if your old terminal was really PCI compliant or not, as advised by the
Payment Systems agent.}

6.  Payment Systems sales agent seemed confused about how pricing works for credit cards, as evidence of thoroughly inadequate training.  Did the agent use category designations of Qualified, Mid-Qualified and Non-
Qualified that did not appear on your statement to refer to how you were being charged?  Did they claim they did not charge "interchange fees"?  Was there claimed to be a single "interchange rate of 1.54%, or some other number?  Did the agent ever tell you that you would be placed on a pricing system called "ERR", or Enhanced Recover Reduced?  Were you told that a "downgrade" rate of 2.99% or 2.79% did not apply to all or most of the cards you would be presented? Was it mentioned at all?

I am more than sorry to hear about the reviews that Payment Systems has.. The issue is that from the General Manager Mike Ponzi to the Sales Managers Jeanne Tommasi and Marcos Santos that they have no morals and no values. You may wonder why they pressure people into the lease... The Lease is where the company makes the bulk of the profit upfront, and yes they also make monthly profits as well..

When selling the lease, Pament Systems Partners with the leasing Company to have the leasing company pay them in advance for the unit.. Meaning Payments Sytems on average receives 70 to 75 percent if the whole term of the lease in advance. Example is if you are charged $100.00 for lease on a 48 month lease the gross profit is $4800.00 ( for a unit that costs $150.00 or lease for a Veriphone vx 510) and if the company receives 75 percent from the factoring or leasing company in advance then Payment Systems makes $3600.00 at the time that you sign up, however if you cancel in first 90 days then the company has to pay back lease... Canceling means boxing up the equipment and sending it back and having your financial institution not accept any more withdrawals from the company or from leasing agent as well. Send both payment systems and the leasing company a written formal complaint and the BBB and AG or Attourney General both in the state the transaction happened and in California... Payment Systems has no more relationship with BBB because there rating is well below an F, and they have had over 100 complaints since the first of the year and nine got answered.. They have 4 offices and an average office does 120 to 150 deals per month thus the company does on average about 600 deals per month or 2400 from January to April meaning that 1 out of every 24 clients complain... That is ALOT... it takes a lot to complain, how many people are dissatisfied and have not complained, it took effort to look up an area or venue to complain and then it took time to write the complaint, 1 out of 24 people complained!!!!!! Wow..... Please be careful actually RUN like Forest Gump away from this company... Please run..... Do not be lime Lot's wife in the Bible, and look back.... You are dealing with a service industry business and real professionals understand that you are entrusting them with sometimes $10,000 to $100,000 of your business each month, why do you have to make a decision that day without doing the research? Pressure is bad, nd always remember that..

Payment systems is a company that provides NO customer service, they fly the Reps in and they leave and NEVER service you... customer service is a joke, and getting a hold of a sales manager or General Manager is also a joke...They lie, they cheat and they steal, and this is nit a relationship that you would want to have for a month, but you are locked in for 48 months... Please stay away from this company.. Please do your research...

I worked for a while for Payment Systems as an independent contractor.  I received about 3 hours of training and then went out and sold.  Every customer I sold to was dissatisfied.  I sold based on the training I was given and everyone I sold to had a higher fees plus a ridiculous rental agreement.  Contact the Attorney General of California.  If enough businesses do hopefully they will be shut down and fined.  I believe their Dallas office is done.  The BBB has stopped accepting complaints since the company has not responded to the last 82 of them.  This company is a flat out scam.  To any current employees, you would be doing less harm to just steal the 200 to 500 directly from the business owner to match your commission than trying to sell a

contract that will cost them thousands.

While I appreciate your personal effort to reach out to me, your company has done nothing to alleviate my complaints.  I'm not interested in "a better rate".  I was manipulated into signing a non-cancellable contract and was blatantly lied to by a Payment Systems sales representative regarding contract terms..etc.  I have dealt with the Payment Systems customer service and have come to realize that their only interest is to keep drawing from my checking account without trying to meet my request, which is to be relieved of contracts associated with Payment Systems.  My case is currently being reviewed by the Attorney General in my state and is being forward to California and Illinois.  I am in touch with lawyers and my business relationship with Payment Systems will be coming to an end very soon.  In the meantime I will be doing everything in my power to expose how deceitful your company is and I plan on contacting local media to warm other business owners of your companies sales tactic.

If you have been dealing with Payment Systems in Carlsbad, CA I have a similar experience.  They blatantly lied, altered my contract after signing, double charged, etc.  There is an attorney who is looking into a class action law suit, and I am happy to pass on contacts to him for anyone interested in being part of it.  Please email me at isolde1214@yahoo.com if you would like to look into being part of the class action suit. 

You can also file a claim with small claims court in San Diego County for up to $5000 (you will need to justify your amount).  You also need to know their correct legal name if you want to file, I have that information as well (it is not Payment Systems Corp, that is their DBA). Please do not get discouraged and feel you have no recourse!  You absolutely do.  I recommend the class action option first and if that isn't a fit, small claims.  Good luck!
