This company use deceptive statements in their collection letter.After citing Federal Law the following is printed:

"CREDIT REPORTING:You are hereby notified that a negative credit report reflecting on your  credit record may be submitted to a consumer reporting agency if you fail to fulfill the terms of your credit obligations.Adverse credit infotmation is scheduled to be reportedon or after DD/MM/YR"

It does sound very scary and convincing for a lay person. DO NOT fall into this trap. First off, you should vigorously dispute any alleged debt especially when you see friendly notices like this one.

Because this statement uses word "may be" instead of "will be" and " scheduled to be reported on or after", it only shows a true intent to scare and lead you to believe that it is scheduled to be reported and Will Be reported.

Collection agency cannot report anything while the debt being formally disputed Even after you tell them to cease all communications with you they are not at liberty to do anything they want. Collection agency are liable for any infractions and violations of Federal Debt Collection Practices Act. 

Besides filing complaints with authority the best weapon is a Small Claim Court lawsuit. You as individual dont need to be representewd by a lawyer but this company has to send a lawyer for a hearing. Imagine this: Courts budgets are cut drastically so it may take hours for your case to be called on the scheduled hearing date. You show up wait and so does their lawyer getting paid at least $200 per hour If you adjourn 2 hearings with average wait 3 hours each $1200.00 of legal fees is wasted!! This may not sound very ethical but Hello!! how about collection agency ethics. 

The only way to fight them back is waste their time, resources and money Don't get mad-Get even
