On 03/30/05 I obtained a FREE credit report from MyPerfectCredit.com.

Within hours, I attempted to cancel their 5 (five) day free trial period. When I did not receive an email confirmation from suing their online form, I attempted to fax a writtten notification. Their Fax line consistently busy. The toll free number is usually busy.

Finally was able to get through on the phone to an alleged customer "service" representative. She failed to grasp the concept that the word service is a transitive verb.

She was hostile and not accomodating. Lo and behold, 6 (six) days later I receive emails with one being a cancellation notice.

My credit card was charged $30.00 (thirty dollars) even though I was assured there would be no charges.

07/21/05 I received a phone from a collection agency gency stating I owed money to MYPerfectCredit.com, a service I used to obtain a FREE credit report.

I stated for this collectiona gency to fax me an accounting of how I could owe $186.80. No fax was received.

I immediately sent an email to MyPerfect Credit requesting an explanation. Please see below test for their response:

Thank you for contacting MyPerfectCredit concerning your account.

Your account has been turned over to 1st Credit of America [a collection agency] for the outstanding balance due at the time your account was closed. To pay your balance immediately and protect your credit call 866-505-2632 to arrange for payment.

I began checking out the company ont eh Internet. What a shock.

I hvae filed a claim with the Federal Trade Commision and sent a cease and desist letter to 1st Credit of America, see below:

You are hereby notified under the provisions of Public Laws 95-109 and 99-361, also known as the Fair Debt Collection Practices Act, that your services are not desired.

1. You and our organization must CEASE & DESIST all attempts to collect the above debt. Do not call me at work or at home. Do not call or contact me in any method.

2. The balance you stated to me of $186.60 is not valid much less accurate for I have never had an account with MyPerfectCredit.com.I did utilize their services for their free credit report.

3. Let this letter also serve as your warning that I will utilize telephone-recording devices in order to document any telephone conversations that we may have in the future, should you disregard this notice.

4. Furthermore, if any negative information is placed on my credit bureau reports by your agency after receipt of this notice, this will cause me to file suit against you and your organization, both personally and corporately, to seek any and all legal remedies available to me by law.

Again, since it is my policy neither to recognize nor deal with collection agencies, I intend to settle this egregious as well as erroneous matter with MyPerfectCredit.com. Enclosed is correspondence indicating I had this account pending cancellation from 03/3/05 until 04/05 when I received an email confirming cancellation.

BBB Comments and Analysis
This company offers a 5 day trial membership which provides members with an analysis of their credit report, and a consultation on which negative items might be successfully challenged to result in removal from the clients credit history.
The company advertises they operate on a pay by performance basis, charging a $6.95 fee for each item challenged . If all three of the major reporting agencies are to be challanged, the $6.95 charge would be x 3. All charges are automatically charged to a credit or debit card number which is recorded before the trial begins. It appears that in some cases clients are supplied with a Visa bank debit card with the agreement that the card will automatically be charged a $29 processing fee upon issuance Any charges for services are also deducted from the debit card number.

Complaint Experience
Some complainants allege unauthorized charges to credit or debit cards. Other clients complain of inability to cancel servcies, along with recurring monthly charges for unordered, or unwanted services. Still others allege false advertising, and incomplete or unclear disclosures concerning financial obligations of members. Customers complain based on the company's website ads, they believed they could sign up for services for free with no obligation and no monthly fees.. Even customers who allegedly cancel within the specified time period reportedly also experience unauthorized charges or debits. Some recent complaints allege that this company bought the clients of another credit repair company called Clear Credit. These customers allege, that without receiving notice of service changes, or being given the option to cancel, they began incurring charges on their credit cards and bank accounts which are listed as monthly service fees for My Perfect credit. These customers had not authorized any payment or account debits to My Perfect Credit. The customers contend that the services fees imposed are unauthorized, therefore, they request credits and immediate cancellation. All complainants generally allege they experience technical difficulties on the website, and are unable to cancel. According to the company's website, the only means of cancellation is via the internet site.

We believe this company's advertising is deceptive and misleading. California consumer protection law declares it unlawful for any company to place untrue or misleading ads to induce the public to enter into an obligation to purchase if the intent is not to sell at the advertised or stated price. Whenever a price is mentioned in advertising, any extra charges should be disclosed in immediate conjunction with the price. Some examples might include, delivery, installation, assembly, travel charges, or shipping and handling. An asterisk may be used to impart additional information about a word or term which is not in itself deceptive. The asterisk should not be used as a means to contradict or change the meaning of the ad, and should be clearly and prominently disclosed.

Other Considerations
This company also has a offices located with the service area of the Better Business Bureau' of Reno Nevada. The Reno BBB reports receiving numerous complaints with allegations very similar to that of the Costa Mesa location.'s complaints, and has issued an unsatisfactory rating for this company.

In connection with their trial offer, this company uses a questionable marketing method known as negative option cancellation. With this method, products and services are sent to consumers unsolicited, and unauthorized charges appear on credit cards. Usually, materials sent with the product or service will allow a specified time period for cancellation and return without penalty or obligation. However, many overlook the advisory, and are unaware of the charge until their next monthly credit card statement. In some cases, consumers find they are unable to contact the company to arrange returns or ask for credit. Most credit card issuers will allow the cardholder 60 days to dispute an unauthorized or inaccurate charge. Review your monthly statement carefully. If you discover a charge which is unfamiliar, investigate and dispute the amount with your card issuer as soon as possible to protect yourself from making unwanted purchases.

Don't waste your time with the BBB. That entity really has no enforcement on your behalf and can only record complaints- which as many of you have already discovered- is too little too late.

Instead, do what I did.

Write a complaint letter to the FTC (www.ftc.gov) AND the Attourney General in which state you find the company is working you under (I had to send mine to Illinois and Neveda).

State your complaint clearly and concisely and provide some detail on what you have tried to do to resolve the issue with them (I kept records of phone calls- even the ones I made to them and were continually busy, busy, busy).

The FTC may not be much help, but the Attorney General doesn't mess around. MyPerfectCredit received my complaint from the AG office and immediately backed off saying they will let it pass "this time".

I wish you all good luck!

FYI- my situation was a little different. I never got on their web page and applied for a free credit report. I just simply got a phone call telling me that my WIFE owed them $60 for a free credit report (she didn't apply either). They had her SS# which scared the hell out of us.

I forwarded all my information on this problem (inluding the results I got back from working with the Neveda and Illinois Attorney General) to the FBI. I want them nailed for identity theft.

The more letters you bombard to the AG, FTC and the FBI, the more this becomes a very serious threat to MyPerfectCredit's business (WAAAY more than the powerless BBB).
