I signed a contract with debt settlement company called Debtco (San Diego, CA) in 2003 to settle 8 outstanding debts "with a goal to be debt free in an estimated 36 months." Only 2 of the 8 outstanding debts I had were settled by this company over 5 years. Debtco closed and Acushield Financial (Las Vegas, NV) took over as the servicing agent for Debtco. In July 2008, I terminated the contract and requested that the remaining set aside balance of $12,169.66 be returned to me. My contract states that Debtco agreed to return any unused set aside funds within 30 days. My money was not returned and I sought out Nicolas de Segonzac, President of AcuShield to settle this claim. I spoke with Nicolas by phone and mail and he agreed to send a "check of $801.66 as a good faith deposit with two monthly remaining payments of $5,684 to be mailed" to me. I received a check for $801.66 but am still awaiting the $11,368 balance of the settlement. Upon further attempts to contact Nicolas or anyone in these companies, I have only found disconnected phone numbers and voicemails stating that the above companies have closed. Upon further research, I've discovered California's Cease & Desist order against Nicolas and ALL of his bogus companies. I have filed complaints with several Attorney General's Offices, BBB, Federal Trade Comission, and have come across many other people that are looking into filing a class action suit against this company. I'm seeking any more information or assistance in pursuing a class action, or simply getting my money back.

looking for help

I signed a contract with debtco in 2004.  I experienced similar problems and have been unsuccessful in having my set aside balance returned after i settled all the accounts myself.  Can you offer a recommendation to help?

Finally getting my refund taken care of! Thank god there are still sincere, dedicated, caring people in the world. Disregard my previous rants, I'm feeling much better about the whole situation and am happy to report that things are working out!

After much research, I finally got in touch with Nicolas de Segonzac. He has another company that he is currently working for NDS Management

I received a response from him today (2/13/09)

"I just got your fax and I believe you left a message on my phone as well. It is evident by your letter that no one has been in touch with you and I apologize for this. I was assured that everyone was talked to.Let me attempt to explain the situation to you.I was hired as a consultant in early 2000 to help Debtco with its business and a few years later when it was apparent to the Board of Directors that a change needed to happen I was asked to become turn around the situation. I always belived in doing the right thing so I agreed inspite of being blamed for everything that had gone wrong.About a year later I started Acushield Financial and we set the standards by which Debt Settlement was being judged winning a certifcation from JD Powers in the process and being recognized by the Industry for our standards. Debtco clients were brought over for servicing once this happenned. After moving the company to Las Vegas because of the cost rising, and a decline in my health, a new CEO for Acushield was hired in August of 2007. (You found me on the web so you know that nothing refelct that fact anywhere and everyone is still under the impression I am the CEO)From that point forward I was no longer involved in the financial decision at Acushield.A year later I made aware that Acushield was again in trouble and I made some recommendations on how things should be handled yet I could not persuade the mangement staff at the time to handle things differently and within a 3 months period Accushield lost all of it business and close down. I had an understanding from all parties and that is when I contacted you with a payment plan. Unfortnatly after being diagnosed with Diabetes on top of High Blood pressure I had to hand this project back to the company. The IRS demanded that Federal Taxes be paid (which I believe is done now). There are monies continuing to trickle down for quite a few months so I recommend that you send a request letter to Acushield throughSTATE AGENT AND TRANSFER SYNDICATE, INC.112 NORTH CURRY STREETCARSON CITY NV 89703-4934 Once again my deepest apologies.
