Credit One Bank Credit One Bank identity theft fraud Las Vegas, Nevada

I was called by Capital One to find out if I was applying for a credit card,I said no, it was then I decided to check with my credit monitor service and was informed that a credit card was opened in my name by Credit One Bank, I immediately called Credit One Bank and told them I was a victim of ID theft and they needed to close that account and send me the relevant information to make a police report, they said I will receive the Affidavit in 15 days, I called, only to find out they sent the affidavit to the address of the thieves, they also reopened the account and sent out a second card to the thieves because when the first card was closed the thief called in and said they never called in and to disregard the initial request to sent out the fraud info. The hardest thing to get is an English speaking rep, and a supervisor, I asked them to fax the Affidavit  to me and I am still waiting, I have the address of the thief because it is now on my credit report(that's how you find them,I put an alert on my credit through the three credit reporting agencies)My thief has since applied for credit cards through all major credit card agencies and I was called every time. Capital One called that was my initial alert, Why didn't Credit One Bank? Is it because they don't do due diligence or is it because they are just plain thieves. I will file a complaint with the States Attorney General as well.
