In the beginning we tried to be reasonable and work with these people. We explained that my husband had been very sick and hospitalized, and that we would only be able to make a small payment at this time. They would not except the payment and said that they would see our dead beat asses in jail.

They called my work place and called my boss a b***h because she wouldn't stop asking what company that they were affiliated with.

We made a first payment of $250.00 towards a settlement. They took the money directly out of my checking account. Two days later they called to say that because we didn't set up a second payment that the first payment went against the entire balance not the settlement. Also they charged our account another $164.00 fee and $48.00 in interest. Only $38.00 went towards our bill.

To begin, the actions of Creditors Interchange are, indeed, illegal. Nonetheless, keep in mind that by law, a creditor does not have to accept anything less than payment in full. Most would rather receive payments to eventually recoup their costs, but some are intent on ruining your life. To begin with, read the Fair Debt Collection Practices Act. You can find this at ftc.gov. This act strictly prohibits harassing or threatening phone calls. The calls to your boss certainly would fall under this category. In addition, it is a violation of the act to threaten legal action the creditor does not intend to take.

In this example, not paying your debt is not a jailable offense. Therefore, you cannot be thrown in jail for refusing to pay. It can be so determined, then, that since the action threatened by Creditors is not a viable action, the creditor did not intend to take this action. Hence, violating the act. I see that this post was some time ago, but if you are still dealing with this issue, I encourage you to contact the Attorneys General for New York and your home state.

Creditors Interchange ripped me off too!!!!

Imagine my surprise one day being called by my mother and told that an attorney had called her and told her that unless I returned her call by the end of the day, I would find my butt in court being sued for over $4500 for a delinquent Chase bill. Finally to get the woman to shut up I agreed to pay 10% of the balance she said I owed. This was supposed to go towards paying off the account, all fees were to be suspended, interest stopped and the account put into a repayment status.

My husband did a little research on the woman and discovered that she wasn't even a lawyer, she was a paralegal. Anyway, I set up payment arrangements to pay off this debt. Yes, it would take me a few years, but I'd get it paid off and the fighting about the original dispute wouldn't be solved in my favour, but would net the company alot of money, but it would be done. Payments went on fine for a few months, then one month I forgot to call and set up my payment. I called as soon as I realized my error, the person I spoke with said no problem, set up the payment and assured me that nothing would be the matter, she apologized for forgetting to call me when she realized that I had not called in. She promised to call me the following month and set up the payment as promised. The following month came and went, I called her, got no response, the payment I'd set up was still sitting in my bank.

Long story short...I left that payment in the bank for 12 months, tried calling for 6 straight months, every week. Got no response. Then in March of this year I get a call from National Asset Management, they say my last payment to this account was in 97 not 2002 and that the balance was almost $5000 owed at this time. So, now where to my almost $2000 go that I paid to Creditors Interchange??

If this company contacts you run the other way!!!
