I purchased my car in October of 2008. It was financed through IDA (Independent Dealers Advantage) in Georgia. Everything was fine until July of 2009. This is when IDA sold my account to Crescent Bank and Trust.


In their letter to me, they stated the account had been sold, but to continue making payments to IDA until further notice. That was the last notification I had from them regarding the account. So I made August and September payments to IDA as I was instructed to do. I made these payments through Money Gram.


Then on September 22, 2009, Crescent Bank and Trust began calling my office, my home and my cell phone, each 3-4 times a day wanting September's payment. I told them I made the payment to IDA via Money Gram because no one at Crescent Bank nor IDA ever told me to start making my payments to Crescent. I even faxed them a copy of the letter from IDA which stated to continue making my payments to IDA. I also gave them the Money Gram tracking number for September's payment.


I was told that they would note the account accordingly and they would contact IDA for the payment. Did the calls stop? No, they increased to about 5 times a day. And each time, it's a different person. I explain the situation to each person and they looked at the account and say "yes I see those notes on the account" and that is the end of the conversation. An hour later, I get another call.


I finally contacted IDA and advised them of the situation. They said they transferred September's payment and to have Crescent Bank contact them the next time they call. So I did. Ms Escobar at Crescent Bank told me it was not her responsibility to contact IDA and she wants the payment and that I need to get it resolved asap. I was like "what else can I do to make you get it?"


Then this evening, I get home from work and my mother calls me. She asked if  I was behind on my car payment. I said no, why? She iinformed me that Crescent called her looking for me because I needed to make my car payment. Geeez, I'm 45 years old and they had absolutely no right or reason to contact my mother!


Any Attorney or Government Agency out there want to take this case? I've done everything else I know to do. Thanks!
