I am filing the report on behalf of my Siseter-in-Law, Cub was her first Job, now mind you this is a independently owned Franchise Cub (owner Doug Winsor) not a Corperate Cub. My Sister-In-Law worked at the store for approx. a month, and due to some health issues ended up having to go home a few times, they released her from the job, which is understandable.

However, how this happend is just shirt of bullying.

My Sister-In-Law called that moring of her dismissal and she was told "we don't need you any more" and they terminated her employment. They asked her to come in to sign some papers which I told her to look over before she signed.

Once at the store the head cashier Pat Jones wanted her to sign a paper saying she "quit" when mu sister-in-law disputed it she was told she had to sign it or she would not get her last check she also told her if she didn't sign she'd tell her next job she was fired and badmouth her. Being this is her first job she took Pats word and signed it. Once my wife and I found out we were angy, my wife went up there to request the paper back as it was signed under lies. They refused to give her the paper or my sister-in-laws last paycheck, due to her within 24 hourse due to her being treminated. They alos refused to give the number of the Union rep. or the Owners name.

We are talking with the Dept. of Labor to se if they cna help.

Avoid Cub Foods Minnetonka at all costs.

This is what I found upon termination in the state of Minnesota:

 

MINNESOTA. Fired - on demand or within 24 hours. Voluntary-quit employees - next regularly scheduled payday, not to exceed 20 days from the last day worked.

 

The ex employee would have had to demand that she get her last check in writing.

Sadly, if this happened, let it be a lesson. No company can bad mouth you after you quit, get fired, or any other reason to a potential new employer. They can not threaten you with legal action unless of course you broke the law. They can not harrass you. etc etc. I have sued an ex employer and I won. I am not a legal expert but I do know I have just as many, if not more, rights as my employer. As long as I did not break the law.

 

I will say this though, if they were within 90 days of being hired, I do believe that is within a probationary period. Basically they can let you go for whatever reason as long as it does not discriminate. Sounds like your sister-in-law was not showing up.

I had a very similar experience when I was terminated from Cub Foods Minnetonka, I was forced to sign a paper I was not given time to read and that was not in any way explained to me. I was threatened with "much more trouble than you are in now" and "pressing charges" if I did not sign. It is my belief that your story has crediblilty because I have experienced it myself. If only your sister knew that legally Pat can not say anything to her next job about her performance or how she left. All she can say is confirm that "yes, she did work here from this date to this date". Thats it. The reason that Pat wanted your sister to sign a paper which said she "quit" is because when you are fired for a performance based complaint, the company has to pay umemployment, if you quit- they do not. As said in the previous article, they cannot legally hold your last check, however, as you say they threatened your sister-in-law with it, they did also to me. I must agree. Avoid Cub Foods Minnetonka if you are looking for a job.

If this were true is would be horrible. But there is far too much emotion and holes in the story. First is your sister-in-law was there only a month as you state, she would still be with in a probation period and they can terminate her with out reason.
--Second, yes the store is a franchise but Doug is not the owner, he is a COO.
--Third, my guess is that your sister in law is young (teens to early twenties) and when telling you what happened between her and Mrs. Jones, was how she felt not what occurred. (you ever play the telephone game, whisper something into one persons ear and see what the 10th person says, this is personified by young, scared emotions).
--Forth you state "she would not get her last check she also told her if she didn't sign she'd tell her next job she was fired and badmouth her." both of these can not and would not happen as Cub Minnetonka has a HR (Human Resource) manager whom would handle any referal information not Mrs. Jones, which HR is highly trained on how illegal slander is (hmmmm, maybe a bit more emotional exaggeration?)
--Fifth, you as a third party have no right to demand paper work back on her behalf, and doing so based on one side of the story is poor judgement.
--Sixth, a friend of mine has informed me that there payroll disperses every Friday, and states so in highering documents, I have yet to here of any rule or law that says they must disperse in 24 hours, some places can legally milk this for weeks, 6 days or less is not unreasonable.
--Seventh, the Union number should be in her hiring info, (local 653, Retail Meat cutters), but is if she was only there a month or so she would not have payed to be a member yet and have no right to their intervention.
To clarify I have shopped at this store, met and inter acted with all the employees mentioned which leads me to believe the original post is the ramblings of a short tempered individual that went off based one half a story. I hope the young lady in questions health is doing better so that she may pursue a better career else were.

I worked at Cub Foods in Willmar for over a year. Its really a rough place to work unless your friends with anyone higher up then its a cake walk. It all builds on WHO you know not WHAT you know or how qualified you are for a job. She isnt the first to be fired over stupid things.
