After finding what we though was the perfect apartment for my Son in Passau, I flew to Germany to sign the contract. Dagmar Mayerhofer was so friendly and rather cool to say the least. Not having much time because she had to go, I quickly signed the rental agreements, which I now know and understand why she had no time.

In Bavaria Germany it's normal to sign a 1 year rental agreement, unless otherwise agreed on. In fact after living in Bavaria for 18 years not once did I ever even see a 3 year rental agreement. Dagmar Mayerhofer had however written a 3 year agreement without my knolwedge and now it makes perfect sense why she literally just had a few moments and needed quickly my signature.

Not thinking anything I signed the contract. My fault right? Well not really, as the contract stated and the Law states that if a new renter is found one can exit the contract. A simple solution, which 1 year later we decided to do. As a lot of landlords, and there are many we did expect a few bad things. But nothing like we've experienced!

When moving in the apartment had mold in the bathroom, black mold. The apartment wasn't painted and even had holes in the wall. Knowing this and mentioning in over and over again, my son was ignored. Upon moving out we knew that this would be an issue as I wasn't there to sign for the apartment takeover and it was my sons first apartment! He only saw the joys of being in his own pad.

So to be kind, we simply treated the black mold fixed the previous holes made in the wall by her son, who agreed it was his fault. We fixed the holes and painted the apartment in a nice fresh white.

Now due to some of Dagmars Mayerhofer Passau's texts I just had a stomach feeling that this lady ripped each and every person off all the time. She just seemed to be a little too professional at looking for issues. Anyway as it was time to exchange the apartment to the new renter, Dagmar Mayerhofer just couldn't make it on that day. Not to worry though she said, she'll transfer the downpayment next week...

That was 3 months ago and now, it's one story after another why she thinks she can keep all the money. In fact the story has changed multiple times and she's come up with costs she claims we should pay from well before we even took the apartment!

It's clear to me, and I'm certain in fact more than certain that this was completely staged. She knew exactly what she was doing from day 1. So I've written this to warn all Students in Passau to be very careful when renting from Dagmar Mayerhofer. I'm going to classify this as fraud and I shall be pressing charges against this lady.

It's not correct to take others money, in fact I am very honest and I even said, I don't trust her. She even sent me 1 text after another about me being rude for not trusting her and promised that she would refund the downpayment. But it seems my suspicions were correct, Dagmar Mayerhofer is a Fraud!

I hope nobody else looses their money with this lady.

Dear Readers,

the report above, is from Marc-Ashley Mulvaneye.

In the following text I want to give people, who read Mr. Mulvaneys report, the opportunity to read the whole story from a different point of view. I have added attachments below to give proof to my statements. The audio files are voicemails from Mr. Mulvaney, explicitly threatening my mother to ruin her reputation. Repeatedly. And you find some text messages from his son to my mother. Even his son doesn’t understand the acts of his father. In opposite to write anonymous messages with insulting content like Mr Mulvaney, I stake my good name on the things I write.

My Name is Tobias Mayerhofer and I am the son of the lady Mr. Mulvaney called a “fraud”. It was a great shock to read the mean and frankly dishonest story, Mr. Mulvaney describes above. Under normal circumstances, I would respect Mr. Muvunayle’s opinion, but since almost every fact he mentions is torn out of context, or simply not true, I feel compelled to clear up those shameful accusations about my mother.

Let me tell you the whole story. When my mom and Mr. Mulvaney met to sign the contract, he knew that my mother was in a hurry, and did not have much time. What Mr. Mulvaney describes to be some sort of strategy to get him to sign the contract, was in fact a doctor’s appointment. Furthermore Mr. Mulvaney was late although he knew my mother was in a hurry. Nevertheless, she took the time to drink some tea with him.

The duration of a rental contract is not restricted by German law. Rental contracts which exceed duration of one year are more than usual – especially in university towns like Passau. To give Mr. Mulvaney a fair choice, my mother gave him two options: two years or three years. Mr. Mulvaney chose the three year contract and signed it. His son was about to finish school and supposed to stay in Passau, and study at Passau University. #withoutmyknowing

A few days later, Mr. Mulvaney’s son came to visit the flat with his grandparents, to sign the transfer protocol. Since I was the current inhabitant, I showed him around personally and made sure he would see every corner. He inspected every room thoroughly and found nothing to complain about. There never was “black mold”, like Mr. Mulvaney mentioned in his report. I think black mold would have been noticeable enough, to get spotted by three people. Mr. M’s son signed the protocol and accepted the flat in the current state.

In October 2016 Mr. Mulvaney’s son told my mother, that he would like to move out. Since the rental contract was still binding, my mother was willing to let him move out, if he would find a new tenant. A common habit concerning student flats. Mr. Mulvaney was not happy with this offer and stated that finding a new tenant is not his “job” and that a landlord in general should give the tenant the opportunity to move out at any time – which would make the whole concept of a rental contract obsolete.

Mr. Mulvaney describes this to be the point, at which he developed his gut feeling that my mother would rip him off. Along with his new developed gut feeling he forgot to mention, that this also was the point, at which he stopped paying the rent. I don’t want my mother to be on stress because of an empty flat, so I looked for a new tenant. I wanted to help my mother and Mr. Mulvaneys son. Mr. Mulvaneys’s son was always very nice and polite, so I helped him.

One and a half month of the rent is still missing. In the beginning Mr. Mulvaneys paid 3 month deposit and my mom kept the half of it, to compensate for the missing rent. Isn’t this more than fair? My mother gave him the half of the caution back – a kind act from her. Usually a tenant stop paying the bills for the flat, the landlord can add interest. My mother didn’t.

As a special “Thank-you” Mr Mulvaney threatened my mother with voicemails, like: “I don’t trust you anymore. Give me my money back. I will ruin your reputation. There will be entries in google ruining you. After all I want to resume, that the accusations of Mr Mulvaney aren’t true. And insults like “she is a fraud” or “ripped each and every person off all the time” are against the German law: §185 or §192 StGB, Downright Statement. And I want to ask you Mr. Mulvaney: Where is your backbone, when you don’t even write your name at the end of your report? You should be ashamed to publish such a disgraceful lampoon.
