TAKE OUR FREE ADVICE AND DON'T BUY FROM THIS DEALER!!!  It seems as though this equipment dealer thinks that he can sell items that are not working properly and get away without consequences!

We purchased an item for $1500 from Dale Kincaid for our small, family owned cafe, drove over 300 miles round trip to get it, got it back to our shop only to be told days later by a licensed professional who needed to certify it, that the item could not be used in it's present condition. One of the systems inside was not working and would need TOTAL REPLACEMENT which would cost the same as what we paid for the item itself, with no guarantee that the other parts of the item would work once this part was replaced.

When we purchased it, we had a bill of sale signed, guaranteeing that the item was in working order. Days later we emailed him detailing the disappointing experience we had along with a copy of the bill of sale & licensed professional's assessment & estimate. In the email we respectfully requested our money back. We got no response. When we called, he wouldn't pick up! When we left messages, he wouldn't call back!

After a second email, several certified letters, many phone calls & one month later, we finally got Dale Kincaid to answer the phone by hiding where we were calling from. He acknowledged that he had received our emails, letters and phone calls, but he had no intention of responding. He in no uncertain terms said he would not be refunding our money. He also said, it would cost more to take him to civil court then to just let it go (he seemed like he had experienced it before).

This business owner does not deal in HONESTY AND FAIR DEALINGS! All we wanted was a refund, all we got was a headache! BUYERS BEWARE!!! We are just a couple with two small children trying to get by and $1500 for a machine that doesn't work is a lot of money! If he ever decides to refund our money, we will let you know and remove this post.


After posting this warning, Dale Kincaid emailed us the following message one evening shortly after 8pm:
"I will be at my warehouse tomorrow. If you choose to return the AutoFRY, you can bring it by then."

Note: after the dealings that we have had with this dealer, there is no way that we would entertain that risky proposition. Not to mention, we had already explained to him how this could be remedied.

In the many letters & emails that we sent to him, it was explained that we could not travel back down to his warehouse in Maryland. We initially gave him the option to remedy the situation by meeting us halfway (75miles) or for him to have it shipped to his warehouse. Even after he ignored several phone calls, emails & letters, we gave him additional opportunities to remedy the situation by coming to our shop to pick up the machine or have it shipped to his warehouse.

After he flagged this post and sent us the email above, we responded with the following email:
------ Hello Dale,
We are glad you contacted us yesterday. Due to your timely email, our attorney suggested that we give you one more chance to remedy the situation with one of the following two options, before we take further action. We will need to know which option you are going to go with by end of the business day, Thursday, 11/14/13.

Per our second letter in the email you received (see below), we detailed how you could remedy this situation.
"To resolve the problem, I would appreciate a full refund, $1500.00 and I will give you back your AutoFryer. As you know, I drove all the way down to Owings, MD ( approximately 300 miles round trip) to get the Auto Fry, it's only fair that you either drive to our shop to pick it up (or you could forward payment to have it shipped back to Owings, MD)."

Option #1, you can come to our shop to pick up the AutoFry and return our $1500.00
Option #2, you would have to send us certified funds of $1500 plus 1/2 of the total cost to have it packed & shipped to your warehouse Note: We will only ship the AutoFry immediately after the certified funds are received.
We have done the legwork on shipping charges to 7650 Binnacle Lane, Owings, MD 20736-3102:
UPS Freight would cost $487.47 (which we felt was an exorbitant amount) + $35 packing*
DHL would only charge $152.64 + $35 packing*
* packing consists of pallet, ratchet & shrinkwrap at a cost of $35.

Hence, if you used DHL, amount in certified funds would total $1500.00 + $93.82 ( 1/2 of $187.64) = $1593.82. We feel that this is a more than fair resolution.

Please advise. ------
We never received any response from Dale Kincaid after this email. Therefore, he chose to ignore us and not resolve this yet again!

So, as you can see, we are still continuing to give this dealer the opportunity to make this right but it seems as though he would rather continue in his DISHONEST DEALINGS!!!
