Daniel Volonino is an Independant Representitive for ACN, a national phone service company. I don't know if ACN is actually a legit corporation, and that is not my main concern. My only dealings in this matter have been with Mr. Volonino.
Last July I attended a meeting at Dan Volonino's house with a co-worker and some other random folks. At the meeting we viewed a promotional video on ACN that emphasized the money making opportunities available to ACN Independant Representitives. Basically what these reps do is try and find long distance customers that will switch their long distance service to ACN. Supposedly for each customer that switches, the rep recieves a percentage of their monthly bill. You also get bonuses for signing up new ACN rep's.
To become an ACN rep you need no training or previous experience. The only thing you need is $500. In one of my greatest single acts of stupidity, I signed up to become a rep and gave Mr. Volonino my credit card number. The only reason I signed the contract was becuase there was a clause which allowed me ten business days to cancel the transaction and I was pretty sure this is what I was going to do.
I called Mr. Volonino three days later to cancel and he assured me that while he was dissapointed I did not want to work with ACN, I would indeed recieve a refund check for my $500 sign up fee. I never got it. I have spent the past six months calling Mr. Volonino about the refund check. Each time I called he either told me he was busy, in a meeting, about to board a plane etc, and that he would call me back, or promised he'd have the check mailed soon, he had just been too busy or some other half-assed excuse.
I took Mr. Volonino to small claims court and he never showed so I have been awarded the $500 judgement plus interest. At this point I seriously doubt I will get a check as the courts leave it up to me to collect. There are Marshals who will help me collect, but I have to know where he banks so they can freeze his account.
In any case this is a basic report of my dealings with Mr. Volonino. I would NOT reccomend anyone EVER dealing with this slickster. And as for ACN, like I say, I don't know if they are simply a front for what looks to me to be your typical pyramid scheme or if they are a legit business, but if they have representitives like Dan Volonino, I would say avoid them.

You should have never signed on to the company when you knew from the start that your intentions were to quit. The rep agreement clearly tells how to cancel your agreement. You didn't follow instructions. No where in the agreement does it say to contact your sponsor for a refund. You didn't give the money to him so you shouldn't expect to receive a refund from him.

ACN has been an incredible company. From this posters statement he didn't not follow the appropriate steps in the refund. It clearly states on the agreement form what you need to do. You also have 14 days to do this, not 10.
So if it's been under a year, why don't you "start" working your business instead of sitting around? It sounds like this poster signed on, submitted his start up cost, but didn't start his company.

ACN on a regular basis refunds folks that desire a refund within 10 days.
All you have to do is put the request in writing and fax it to them. You
as a rep may call rep services for addl help.
Not knowing the exact circumstances of the situation, I think if this person
called ACN would be more than helpful.

To whom it may concern:
I was very recently made aware of this report
through a business partner. I am shocked and ap-
palled by the content. The individual's name that
submitted this slanderous and defamatory letter is
Mr.Reid McNamara jr. Mr. McNamara seemed like a
genuine, professional young man when I met him at
my home. I, did, indeed share the ACN oppurtunity
with him. Mr. McNamara was genuinely excited and
signed an independent rep. agreement. I forwarded
the info to ACN's home office. Mr. McNamara, on
several occasions contacted me for a refund. I
told him I would be happy to help him build his
business, but all refunds come from the home
office. This is all clearly explained on the
contract Mr. McNamara signed. Since Mr.McNamara
missed the 10 day window to obtain a full refund
from the company and he was completely unwilling
to show any initiative to build his own business,
he became complaintive. Since I am a sincere and
caring individual, I reached into my own pocket
and paid Mr. McNamara his money back. I have the
check that I sent Mr. McNamara in my posession.
He cashed the check at a Key Bank in Albany, NY,
and his signature is on the back of the check. I
am currently consulting with a high level attorney
on potential slander and defamation issues as a
result of this vicious internet attack by Mr.
McNamara. Note: ACN is one of the most respected
companies of it's industry, with a recent write
up in Fortune magazine. I am a top producing
regional vice president of ACN. I am not remaining
anonymous like Mr. McNamara.

My family has worked with ACN for serveral years. Yes, they are a legitimate company, one of the top in thier industry, however, we understand that not everyone is interested in this type of business model. (In regard to "pyramid", look at a corporate organization chart with the CEO at the top, then compare to a legitimate MLM company, you'll recognize the difference.)
It is the Independent Representative's responsibility to submit a new Rep Agreement to the company. (Representatives of ACN do not process payment from Rep's or customers.) Contact information for the company would be listed on your copy of the Rep Agreement form (which includes method of payment). I recommend going to the company directly to find out if they had ever received your information and inquire about a refund.
