Please take notice that Dr. David Eggleston (Dr. Eggleston) has issued subpoenas in the Superior Court of the State of Arizona, in the County of Maricopa, Case No. OCSC 30-2012-00592583 (the “Arizona Action”).  In the Arizona Action, Dr. Eggleston seeks to subpoena Xcentric Ventures, LLC (“Xcentric”), the company that owns and operates ripoffreport.com, for your contact and identifying information. Dr. Eggleston is a party in an action in the Superior Court of the State of California, in the County of Orange, Case No. 30-2012-00592583 (the “ California Action”), and seeks this information in connection therewith.

Arizona law requires that you be provided notice of the discovery request (i.e., the subpoena) via the same medium that the false and defamatory statements were originally published. By this post, notice is hereby given to you of Dr. Eggleston’s pending discovery request.

You have a right to timely and anonymously file and serve a response to the subpoena.  Such a response can include an objection to the subpoena.  Any response to the subpoena should be mailed by February 10, 2014, to Katherine M. If a response is not received, Xcentric may respond to the subpoena and produce the records as outlined above. 

This notification is being provided to you pursuant to the Court of Appeals, State of Arizona, Division One holding in the matter entitled Mobilisa, Inc. v. John Doe 1, et al., 217 Ariz. 103, 170 P.3d 712 (Ariz. App. 2007).

On May 23, 2012, someone posted a complaint against me stating he/she received lots of bad crowns, lost a tooth, and ended up with 10 root canals.

I suspect this fictitious patient posting was prompted because I testified for a patient as an expert witness in a lawsuit that ended with a $641,442 judgment against the dentist, and I was the subsequent treating dentist in a peer review case that ended in a $27,635 decision against the same dentist.

On June 24, 2012, I offered a full refund if the patient would simply have the current dentist send me x-rays showing the treated tooth decay and the 10 root canals.  The refund would be about $30,000.

As of this date, August 14, 2012, no patient has surfaced for the refund and I have not received any x-rays.

I am a periodontist in Newport Beach and a long time dental patient of Dr. Eggleston.  This complaint is bogus.  I checked with the Dental Board and there have never been any marks, citations, or actions against Dr. Egglestons license.  Also checked for lawsuits - Dr. Eggleston does not have any lawsuits for anything for the last 25 years. 

I go to Dr. Eggleston as a patient because he is an excellent dentist.  He graduated from USC Dental School with the Alpha Tau Epsilon and Omicron Kappa Upsilon honorary awards.  He was the only student in the history of the dental school to receive the top two awards in prosthodontics The Daniel Cave Memorial Award and the Lewis E. Ford Memorial Award. 

Dr. Eggleston is a Board Certified Prosthodontist and past president of the American Board of Prosthodontics, the American College of Prosthodontists, the Academy of Prosthodontics, and the Pacific Coast Society for Prosthodontics.  Currently, he is on the faculty and the Board of Councilors at the Ostrow School of Dentistry of USC.

Dr. Eggleston has a wonderful, caring, professional staff who are extremely accommodating.  Many have been with him for more than 30 years.

Because of Dr. Egglestons qualifications and outstanding reputation in the dental community, he is called upon to testify as an expert witness in dental malpractice lawsuits.  He testifies for the defense when he feels the lawsuit is frivolous, and for the plaintiff when he feels the lawsuit is justified.  In my opinion, this patient complaint is not really a patient, just pay-back from dentist who lost a big lawsuit.

I have informed Dr. Eggleston of this patient complaint on Rippoff Report.com.  Dr. Eggleston is also of the opinion the complaint is bogus.  To demonstrate it, Dr. Eggleston stated, The patient can have the current dentist send me copies of x-rays showing the tooth decay and the 10 root canals.  I will immediately send the patient a full refund for the crowns placed in my office and a full refund for the 10 root canals.
