Bergen County Prosecutor John L. Molinelli announced the arrest of David Miller, D.O.B. 10/09/1969, of 200 W. Milton Ave., Rahway, NJ. Miller was arrested on August 28, 2007 at 1:27 p.m., on charges of Attempted Sexual Assault (2C:5-1/2C:14-2c(4)) (2 Counts), Attempted Luring (2C:5-1/2C:13-6), Attempted Endangering the Welfare of a Child (2 Counts) (2C:5-1/2C:24-4a).
The arrest came about as a result of an investigation conducted by members of the Bergen County Prosecutor's Office, Computer Crimes Unit, under the direction of Acting Chief Joseph Macellaro.
The arrest stemmed from an investigation concerning the following: Mr. Miller engaged in conversations via the Internet, specifically chat and instant messaging, with what he believed was a 14-year-old girl. During the course of those conversations, Mr. Miller initiated sexually explicit dialog. Mr. Miller also instructed the presumed 14-year-old girl to m********e. Additionally, Miller requested to meet the presumed 14-year-old-girl for the purpose of engaging in sexual activity. On August 28, 2007, Mr. Miller was arrested without incident after luring the presumed-girl from her home by instructing her to take a train (providing the train schedule and details) to the Rahway Train Station, and then arriving there at the prearranged time to pick her up.
Prosecutor Molinelli urges anyone whose child spoke online with screen name farmer_n to contact the Bergen County NJ Prosecutor's Office Computer Crimes Unit. Mr. Miller is currently in jail in Bergen County on $150,000 bail (no 10%) and to date his family has not posted the bail.
Mr. Miller was arrested while on parole having been released 1.5 months earlier on charges that he pled down to Endangering the Welfare of a child. Mr. Millers attorney got the charges reduced, but Mr. Miller had ben accused of having sexual intercourse with a 13 yr old girl.
