 I entered a lease agreement with David Pruitt/west USA realty on dec 23rd 2014 we arrived on the 29th was told the place was move in ready, we moved from at Louis, got here to find 70% of the lights burnt out or broken off in the sockets , light fixtures hanging by cords, no hot water, obvious mold damage in the kitchen and bathroom, filthy grimes moldy mildew smell. A refrigerator unplugged in the garage with spoiled food.

We've taken them to small claims court only to have it dismissed because I didn't use the correct language , sued for lawyers fees , and now my whole family is getting sicker and sicker, wife was rushed to er throwing up violently, my daughter and I also have been to the doctors with bacterial infections from mold. Did a mold test we bought from lowes and took videos of it . Absolutely disgusting, I'm a navy vet on a retirement pension have no means to pack up and move please please help

The Tenant had there day in court and the Judge issued an eviction notice and a judgement of $2,500 was awarded to the landlord on this second time in court. Hopefully no other landlord or Property Manager/Realtor has to go thru what this Tenant put everyone thru in hopes of some monetary gain and attempt to damage the reputations of anyone else unfairly.

Time to do the RIGHT thing for once

 It's obvious by the admission within this conversation by David Pruitt and Steve Kersey there where and still are numerous issues with this property before it was rented to us site unseen because we lived 1500 miles away. David Pruitt / west USA realty / Steve Kersey all were negligent first by listing a property that would not have obtained an occupancy permit from any where in the USA. If they didn't know about the condition of this property, they should have known , they listed it on several national websites including zillow , homes.com, and of course their own site. As a trusted realtor with a reputation they so proudly brag about, it is their ethical and professional duty to make sure this doesn't happen, and should it happen as it did in this case, the RIGHT thing to do would have been to relocate us to a comparable place , paying for all moving expenses making sure we were in a safe healthy environment. Instead we were treated like it was our fault the house was in the condition it was in, taking NO responsibility for obvious neglect. I gave them ample opportunities to do the right thing , what a shame they didn't. Let the court decide , I'm done trying to make them take responsibility for their actions or in this case non actions. PS Steve a handyman is not qualified to determine if mold exist or if it's having health effects , as a matter of fact all the last handyman did was cover it up with sealer.

 move in sheet stated following problems , No hot water, mold damage in kitchen master bath, broken lights in sockets , lights burnt out 70%, cracked and missing electrical outlet covers, sprinkler system that was turned off two months prior due to major water leak in front yard , scrubs dying , pool with control knobs broken off, and not working filter and vacuum , mold was covered with sealer and we were told water damage under sink was ok and dry , sound professional, ethical? Sound like they care about an environmental hazard ? Our health? Our safety? Would you feel safe renting from them ? Ask me , wow is all I can say , God forbid any of us has sustained long term health problems over this

It is unfortunate that you feel this way.  We have had thousands of satisfied customers and are known throughout the industry for our responsivenes and great customer service.  As I am no longer in management of this home I cannot help you with your current issues, but wish you the best of luck in finding your perfect home going forward.

 steve Kersey took over the property management of this house on 01/09/15 the day after the owner came in and fired David Pruitt for the condition his property had been maintained we were given apologies for the filth grim and non working refrigerator lived for 18 days with at best Luke warm water till I fixed the problem myself , we were threatened eviction 15 days before our rent was due and had NEVER been late on a rent payment , we lost our small claims against this company only because they got a lawyer and bumped it to civil court and used law language to get it dismissed then sued us for attorney fees , this has been nothing short of a nightmare , I moved here with my wife to have peace in my life after losing my 20 yr old son and I've had to deal with these kinds of issues

Lies deciet fraud misrepresentation

 ample proof was given of the existence of mold , maintenance men covered up with sealer. I have move in records stating the conditions making this house unlivable , and a health risk . Since this rebuttal is a pack of lies I've never seen the likes of in my entire life, I have ample proof in text messages emails and photos and videos . We were expected to be baby sitters as this company repaired a house they presented fraudulently as being move in ready . My suggestion to any one considering renting or buying from this group , change your mind quick. This has been a nightmare, and now my wife has been to the er violently throwing up , both my daughter and I have been to the doctor too . Seems all David Pruitt Steve Kersey west USA realty is worried about is their financial gain not the safety or health conditions of property the lease and sell renters beware

I took over management of this property offically on March 1st.   Since that time there has been constant demands and threats from this tenant for financial compensation along with a refusal for my vendors to enter the property to check out the problem.   This latest demand was received just days ago and again my vendor was denied enterance into the home.  The Landlord of this property has very generously offered several times to cancel this tenants lease and return their Security and cleaning deposits and also reimburse them for unused rent this month, but this tenant has refused that offer.

This tenant had ample time to see the home prior to moving in and made no complaint about the condition.  The lease and the Arizona Landlord Tenant Act are very specific as to all the issues the tenant has brought up.  He has made multiple demands and threats for financial gain.  The courts have ruled in our favor.

Every time the tenant made a claim or complaint he received a response from us.  We only managed the home for the first 10 days the tenant lived in the property. He complained and was so unhappy that the owner elected to swtch managers in hopes the change of companies would help.  It seems like the new manager is having the same exact issues.
