4th Update: 11-13-12 We had been hopeful for the last 2 weeks that DealerOne was going to do the right thing and settle our case before it reached court.  Their Attorney had reached out to us and told us that they were agreeable to settle, with only a few minor sticking points to be worked out. 

The offer/counteroffer was agreeable for but the smallest of details on all points, and we thought we were within days/hours of working out the settlement.  But then, late yesterday afternoon, we heard from Chris Kalis, the Attorney representing DealerOne, that he had filed an answer to our suit (meaning, we're going to court), and in our opinion had collapsed the negotiations for settlement.

We must now wait for them to contact us again requesting the settlement negotiations resume, or wait till sometime this spring to meet them in court when a date is eventually set by the court.From the blog of my 3rd Update, we have had yet another victim contact us.  Their information was turned over to our Attorney, and was also turned over to the Attorney for the state of Texas.  

His case is continuing to enlarge each time I post a blog or an update.It is obvious now with this many victims that surely dozens, perhaps 100's of customers have been scammed by DealerOne of Dallas.  Just from my blog alone, we'll probably soon hit double digits from other victims that will be joining the state of Texas for a suit against DealerOne.

It is in this spirit that I ask you again to post, share, copy; and continue to spread the word of my blog to as many of your friends as possible on FaceBook, MySpace, and LinkedIn.  A small bit of positive news for us, but negative news for DealerOne.  If you go to the Google search engine, and type in the words 'DealerOne Dallas Scam', our blog is at #3 on the search and view list!  That is great, as this gets the word out too to help other victims. 

Today marks the official launch of Phase 2; which is going to be huge.  It is going to take me a lot of time, energy, resources, money, and planning, but we hope to make Phase 2 so successful that DealerOne begins to feel it in their wallets; like they made me feel it in mine.If you are willing to help me as a resource for sharing, voluntarily; please send me a personal note. 

For ease of dissemination, a separate email account, another blog, and a new website are in the works by me for launching as part of Phase 2.  That plus, it is amazing how many sites are available for reviews posting, Auto Forum postings, Dealer postings; and others sites that (for a fee), help launch your campaign for even greater regional and national exposure. 

At last count, I have 45 additional known and reputable websites for reviews/blogging, and sharing.

So, onward we march.  I claim a promise of God.  I say that no weapon formed against me shall prosper, and any tongue that rises against me in judgment I shall show to be in the wrong!  This peace, security, and triumph over wrongful opposition is my inheritance as a child of Christ.  This is the righteousness which I obtain from my heavenly Father, which He has imparted to me as my justification!  I shall not fear, I shall remain steadfast, I shall have strength, as I have the guarantee of His vindication.

My friends; are you with me in this?  I sure hope so.  Many of you have remained silent; I hope now that I will hear your voice to join with me as a mighty force.

Phase 2 of the battle is on.

3rd Update:  Please take the time to read the whole blog post.  You'll know in about 3-4 minutes about all the great news that our case has shaped up to be, BUT, I need your help.  Yes, I need 100's more, or 1,000's more preferably to read this blog, to post, to share, and to work with me in gathering names of other victims. 

We have an Attorney and a member of the Texas Department of Motor Vehicles working directly with us to gather names and numbers of other victims.So much has happened since the last update that I will try to keep it as brief as possible, but the events that are shaping up for us are really exciting:We hired Sharon Campbell as our Attorney.  Her phone number is 214.351.3260, and I will tell you in a minute why I have posted her phone number.  

We have officially filed a lawsuit against Will Monroe and Dealer One in District Court, and all parties have been served.We have been working with Justin White of the Texas Department of Motor Vehicles, and his phone number is 817.284.6524.  Justin has been trying to get to Will Monroe for some time now, and stated that Will has a history of fraud with other companies.  (Wow! That was the first bomb shell).

They are working closely with us and trying to get enough of a case for a full indictment with the District Attorney to try and shut down Dealer One, access fines, and pull the dealer license.Justin White found out that the car we purchased had indeed been wrecked in Miami, FL, and that the dealer in Florida had disclosed this fact to Will Monroe to remove them from any liability. 

But, Will Monroe and Dealer One chose to cover up the details of the wreck from us, and sold the car to us as a non-wrecked vehicle; which is against the law.We have made repairs to the car, and are driving it, while awaiting our day in court.  It still has problems, as we only made enough repairs to make it safe to drive. 

We have an expert witness lined up to testify about the damaged parts, complete with pictures and written evidence. We have found out that the extended warranty we thought we were purchasing, was going to be directly from Infiniti, as that is what we were told.  But, the extended warranty was not an extended warranty at all, it was a duplicate warranty, issued by CARS, a 3rd party warranty company.  AND, it was only issued because Will Monroe forged my signature to the application.  It wasn't even a good forgery either ~ not even close. 

We paid $1,890 for this part of the fraud.  Guess what Will paid?  $995.  That's right, a 100% mark up!  What a total rip off artist he is, and digging his own grave with a forged document ~ just plain stupid too.

Because of the first blog post, another Plaintiff has come forward, contacted me directly about his problem with Will Monroe and Dealer One.  And, he has since hired Sharon Campbell as well, and he has filed a lawsuit against them as well!  He will be one of our witnesses.  This is really great news.  Sharon Campbell has requested that because of my blog; that if any other victims have been effected, to immediately call her at the number listed above. 

She wants to talk to them about filing a lawsuit on their behalf.  She has me, plus one more in separate lawsuits against Dealer One, and believes there are potentially many other victims based on information received from Justin White.For this reason, I ask that you post and share this blog multiple times with your FaceBook and LinkedIn friends.  You never know how many other victims might be able to be made whole as we try to spread the word of Dealer One's egregious fraud.  Please post.  Please share.  Thank you.

Additionally, because of the blog, and because of our efforts of working with Justin White, Justin has added two other victims to his list that have specific issues with Will Monroe and Dealer One on specific complaints that he has added.  And he too has requested that if anyone else can come forward, to please call him immediately at the number listed above, as he intends to pursue action against Will Monroe and Dealer One as far as the law allows.Thank you for your help.  Thank you for your support.

POST 2:Thanks so much to each of you that have read, shared, and reposted this blog.  The more we can get this out, the less likely others will fall prey.  Thank you for your comments and for your prayers.  The fight appears to be a long one.  This is my first update.  Please post and share with others on your FaceBook. 

The Police Detective recommended pursuing our case in civil court.  Even though it was found that on top of everything else, that Will Monroe stole another $1,890 from us via a fraudulent extended warranty that was never actually purchased; the Detective said this would have to be added to the civil claim.We had no idea that auto-scamming was such big business, but it is, especially in Dallas. 

The largest law firm in Dallas that specializes in this category is so over-burdened with cases that they were not able to take ours; though they wanted to.  They referred us to another firm that specializes in Dallas auto fraud, and we hired one of their Attorney's last Friday.  She believes that our case is winnable, and believes in it so much that she agreed to accept our case on a contingency fee basis.  

She has already begun working on it for us, but has prepared us for a long 6-12 month journey before it actually makes it to court.The Texas Attorney General has sent us correspondence saying they have begun an investigation.  The Dallas BBB has processed the complaint, and will work with us through their legal mediation department.We were advised to repair the car, so after sitting in the garage for one month, we have a mechanic making repairs that will be used as our 'expert' witness with his certifications.Thanks again for your support. 

The fight has just begun

POST 1:Here is my original blog in case you have not yet read about it:Please copy this blog to your Facebook, and forward to as many others as possible. We're just trying to keep this business from scamming other innocent victims, as they just did to us.

During the week of 7/16, we exchanged a multitude of texts and e-mails with Will Monroe related to a 2012 Infiniti G37 that he had advertised on AutoTrader. During the week of 7/23, we made arrangements to purchase the vehicle, submitted a deposit, and made arrangements for travel to pick up the car.  All of our communications with Will were answered as "this car is virtually new, it's got a clean CarFax, it is incredible, and we have had good experiences with Geico owned cars in the past."

Nothing was disclosed at any time that the car had been wrecked, or had hidden damage. Will assured us from the start that there was nothing wrong with the car. After we submitted the deposit, Will received the car, inspected the car, prepared it for delivery, and said there was nothing wrong with the car.

We traveled from Tulsa to Dallas to purchase the car. Upon arrival, Will said there was nothing wrong with the car. We took it for a test drive, and I made the comment about how creakity it was, and why it made so many sounds. Will said that was normal for Infiniti, and since I've never owned one, I took it as truthful. The creaks continued, and became so annoying that we took the car in for service at the local Infiniti dealer. 

On 8/2, less than one week from owning the car, our service advisor and ASE certified technician, disclosed that the car had been wrecked.  He said someone had taken the carDukes of Hazzard, that it had become airborne, and that it had sustained substantial damage underneath. The right inner tie rod is bent, the sway bar is bent, the motor mounts are broken. The right front rim is damaged, and the inner part of the right tire is shredding. 

Cost to repair is $4,120 with additional repairs possible. It could need struts and strut plates after initial repair for another $1,200. Will Monroe of DealerOne said again the car did not have damage, and was unwilling to cancel our transaction and purchase the car back from us that he sold to us using fraudulent pretense. 

Dealer One is operating a scam, and is selling wrecked cars to unsuspected customers, claiming they have no damage, when in fact, this very car is not able to be driven on the road until the damages are repaired. Someone needs to stop DealerOne before more customers are scammed into buying wrecked cars. 

DealerOne is not willing to accept any responsibility for what they have done.
