I bought a new dell computer on 6-13-2011.  When I received it there several problems, windows update wouldn't install all the updates, adobe flash player wouldn't stay installed, date and time couldn't be locked in.  Also the cd/dvd drive rom didn't function.

I called tech support and they ran a hardware scan.  It passed and they told me it had to be a software problem.  They said to restore the computer to the factory state and that would fix it.
The restore didn't do anything.

I grew so frustrated that I called a local rep.  He spent 4.5 hrs. on my computer and found it didn't have a genuine Microsoft operating system installed.  He installed a geuine operating system and it cured all the problems except cd/dvd rom problem.

When I called Dell support back the tech said that Dell didn't send computers out without genuine operating systems.  I offered him the local techs. phone number to verify and he didn't want it.  It was if he was calling me a liar.  I had them send out one of their techs to replace the cd/dvd rom.
He replaced it and only tightened the screws on the case thumb tight so I had get a phillips screw driver and tighten it myself.

Tech support called back to have me rate my experience with Dell.  I told them everything.  They told me they'd send me out a free thumb drive which they never have.

I will never buy another computer from Dell!

Dell would not send out a computer with a non-genuine Windows OS on it for one rather big reason. The fine is $10000 per user per license. There is no way Dell would risk their partnership with Microsoft just to possibly save $50 on a single machine. Even less so to send out thousands of machines so that the BSA would come back and hit them with thousands of instances of $10k fines. 

Perhaps you got your machine from a computer recycler that put out a machine with a not-so-legitimate version of Windows on it. I don't know. But Dell would never install unlicensed software on a machine.

Okay first of all if Dell was sending out Computers Non-Genuine Microsoft software that you would be hearing thousands of reports about this?  Or do you really think that you were the "lucky one" that Dell decided to pick on and give you an invalid copy of Windows?

I would actually question your Local Tech a bit more.  First why did it take them 4.5 hours to figure this out?  Keeping in mind that Microsoft has many licensing models.  What did they do to determine it was invalid?  Did the Tech charge you for the "Genuine" software?

Why did you take it to a Local Tech before you had them come out to replace the DVD Drive?  How come you didn't have the Local Tech replace the drive since you did?

As for tightening the screws "thumb tight", that is not really a huge issue.  Of course the tech "could" have done tightened the screw, the point is that it is not really necessary.  In fact I would bet that the screw is actually designed to be allowed to have it "thumb tight" by having a bigger head that makes it easier to grab onto.
