I just found out Nov 9 2007 the home I been living in for almost a yr is now up for foreclosure. I been evey mo on time so my question is were the money went. Now he keep calling me telling I have ex amount of day to get out what should I do.

I proved IN COURT and won my case..Anthony certainly made his lack of class available when he owed me almost 5,000. in back rent , and didnt pay for furniture he bought from me...before He and his girlfriend in during his separation from his sweet wife. I sued Anthony and WON..of course HE still hasnt paid...showing what kind of CHARACTER HE HAS...so dont let him fool you..HE hAS NO CREDIT and HIS NAME AND CHARACTER Are indicitive of him...
By the way,,, I still own the house and paying it off EARLY...my new album is doing INCREDIBLE...ITS A SHAME that people like that are allowed to vent and lie...Oh well...as I said..I WON THE SUIT..

Yes indeed - check your lease agreement

Does your lease specify how much notice you or the landlord must give the other party to terminate the lease?

Just so you know - what the landlord does with your rent payments really isn't any of your business although I understand your predicament. There is no law that I know of in any jurisdiction that requires that rent be applied to a mortgage payment, although that's what most landlords as I do.

If you have a one year lease, I would suggest taking it with you and going down to the local housing authority office and ask them if you have any legal recourse.

You might also try to contact the mortgage holder and see if they will let you remain if you pay your rent directly to the mortgage holder (the folks who are foreclosing on the property.)

I'm Confused

You didn't indicate whether you have a written lease or not, but you're going to need it right now. I mean this is a bad situation, but the situation with the foreclosure is between the bank and the owner and only involves you to the extent that you have to leave. It sounds like your landlord has been using your rent payments for something other than mortgage payments on the house. It doesn't matter at this point where your money went - your eviction is not your causing nor your fault, but you are the one affected.

I guess you need to review the lease for the following:

1. What is the written term of the lease?
2. What recourse do you have if the lease is broken by the Lessor?
3. Did he give you any warning other than what you got on 11/09/07?
4. Have you found another place since you were notified?

The foreclosure is going to happen and ownership of the property is going to transfer, so you have no choice but to get out. If you haven't found a place to live - find one ASAP because you aren't going to be living in the house. Talk to your homeowner and see if he can pitch in with the moving costs...

What should you do ? Get out. It's not YOUR home, it's his, or rather the mortgage company's. What this man did with the rent money is of no concern of your's. But it's quite apparent that he did not spend it on his mortgage, isn't it ??

The gentleman owns the house. He can do whatever he wishes with the rent monies given by you. You merely fulfilled your obligation for having that place to live.
