Does anyone here know anyone in the department of labor?
My husband had an injury at work and is being denied payment by US DEPARTMENT OF LABOR. He now needs surgury to screw together a broken bone in his hand but the US DEPT OF LABOR IS REFUSING TO HELP.

We sent an appeal but it may take 6 months. We tried to hire a lawyer but most lawyers won't handle his case because my husband works for the post office and this makes it a federal case.

The one lawyer that we did talk to told us to pay him $1600 just to get initiated and that this would only be paying for his information.

They have not paid him since he has been out (for over 6 wks) he needs to be out even longer due to the surgery that he needs.

Please help: They denied his claim saying that he was put back to work on light duty on 4-29 but he was still out on doctor's orders at this time till 6-2. They wanted to make him work with a broken hand, doing the same job sorting mail but with one hand.

They asked for a more detailed doctor's excuse, which we sent them but they still denied it. Since then his doctor has increased his time out because the injury was not improving and he was in a cast for 6 wks. After the 6 wks the doctor took an MRI to see why it is not healing and found out that he had a broken bone that needs surgury. He has been or heavy pain medication as well.

This is ridiculous and it is not fair that just because you work for the government you have no rights!!!!
They won't allow us to talk to anyone about this and no one answers our calls.

Union stewart is scared of post master

He would not do anything against the post master even if it means doing his job.They are useless in my husband's post office. So his union fees are worthless as well I guess. We believe that the post master is also behind this some how since him and my husband has a huge argument when he got hurt and wanted time off.

is similar to a Union Steward (maybe even the same, with a different name). Have you tried contacting the union at all?

This is another example of how clueless we are about this and how no one ones to help us.
I know that this is workers comp issue but why are the denials being sent by US DEPT OF LABOR?

We did file a claim and it has gotten denied by US Dept of Labor 2x.

Govt workers don't have workman's comp because it's the US Govt - it's a whole different ballgame and one most lawyers don't even want to wage in at.

However, if memory serves me right, you have only 180 days to file an appeal to your application - it's been awhile since I've fooled with this issue and the time frame may have been made shorter. My apologies if I'm incorrect.

However, there are Ombudsmen who are supposed to help you and you can file a complaint with the Inspector General's office - at least they would get you started in the right direction.

Sandra,

An injury at work is a workman's comp issue. How is the US DEPT OF LABOR involved?

Has a workman's comp claim been opened? If not, why? If so, why is he not getting paid?

FYI..The US DEPT of Labor is in Washington DC.
