My ex owes as of today $28,000 in arrears. He hasn't made a payment since 2013. He missed three hearings for non payment so judge finally issued a writ of bodily attachment on him for contempt/non payment of court order. It took till Nov of 2017 to locate and arrest him. The writ states that he is to pay a $550 purge amount or if he cannot or will not pay it he is ordered to remain in custody for 30 days. He was arrested at 2:15 am on a Sunday, was taken before a judge Monday morning at 9am and stated he was homeless, jobless and had health problems.

The judge ordered that he be released immediately without having to pay the purge amount or any amount even though he had $164 on his person when he was arrested. He was told by a Dept. Of Revenue representative that once released he was to contact the original judge that issued writ to schedule a hearing to explain why he hasn't paid child support all this time, provide proof of health problems that prevent him from working and or proof he has applied for ssi.

If he does not contact judge's office for hearing then the process will start all over again. He has worked legitimate jobs over the last few years, filed out tax forms for employers but because DOR closed my case and no longer enforced it his employment info wouldn't show up so the income deduction order would go into affect. Because of them closing my case my child missed out on at least 8 months of child support. I guess since they really dont ask for proof or require unemployed non custodial parents to report to our local career source building anyone can say they're homeless and jobless to get out of paying support.

My county has a program specifically for non custodial parents who cannot pay support helping them find employment, free city bus passes and vouchers for free clothing so they can have the wardrobe for interviews and or company dress code. Now I was just informed by the judges assistant that I have to hire a lawyer or represent myself to file a motion of contempt just because I know he will not do as told because he knows it will take years all over again to find him. I'm fed up.
