Who ripped off who Jackie??  It's been a year and you still havent paid me a single dime on my Judgment against you!!  I won on all cases, dropped the rest and still you REFUSED to pay me JUST the money YOU admit to owing me!!  Your just scum of the earth and pray that Karma kicks your a*s hard!!

I find all of this so sad, that Jackie just refuses to pay me despite court orders.

She is down in Florida, which is where I am originally from. I headed down that way to complete the registration of a foreign judgment, writ of execution and sheriffs service. All these fees she will be required to pay anyway. I love Florida lien laws anyway and have much more experience with them.

I hate that I even have to go through all this to get paid for working.

I quit fighting with Jackie, I dropped all my cases against her and told the Dept of Labor and the State of NH that Im done fighting with a person who is clearly psychotic.

She only owes me my actual wages $3317.50 plus the attorneys fees she forced me to pay $1500 and a small miscellanious award for fees.

My lawyer says Im entitled to so much more, but at what cost. I have a life to continue living. Jackie's lost her house in NH, she didnt pay the rent (the landlord is suing her for back rent). Her worldly possessions sitting in a storage unit. She cant come back here, because of a warrant out for her arrest.

I attached her bank account which had $49.00 in it and her Social Security check. Which is under a fraud investigation.

This woman is sitting in Florida alone with her husband claiming to caring for dying people. This is a lie, she is sitting in Florida praying for Boyd's mother to die so she can for the first time in her life own a home.

She claims she is a family person who only cares about the love of her family. Ive spoken to many members of her family and was told they have been ripped off by her and Boyd also. Their opinion of her isnt favorable either. Her own father had to cosign for her daughters college loans and they defaulted, leaving an 87 year old man responsible for college expenses.

Her whole life is a made up lie, which has been exposed. She still hasnt paid me any amount of the original wages, she admits to owing me in the above post. All I did was work my a*s off for a common thief, who feels she doesnt owe anybody.

I think it says a lot that Jackie Philbrick has refused to pay me while we are waiting for the warrant for her arrest to be issued.  Even Jail time doesnt concern her enough to pay me and her bail on a felony warrant is more than the total amount she owes me making it even sadder.

Says a lot about the character of Jackie Philbricks.

The Supreme Court has tossed her appeal out of their courts.

If my ALL OF MY money is not in my hand by the end of the week I am filing with the police department under Theft of Services Laws  (NH 637:8 Theft of Services), which is a Class A felony and she can be extradited back to NH from FL. 

She can think about the damage she has done to my family from behind bars, I dont care anymore. Since clearly she doesnt.

 "Low, even for someone who had a right to sue, but she didn't. She could have been paid over two months ago but refused!"

This is what she says in a big bulk of the letters she writes, Yet she filed in the other filing with the Supreme Court recently she owes me nothing. Perjury charges....

"She has systematically ruined day after day of work for me as I have to speak to lawyers, send paperwork, answer questions and submit evidence."

First of all she doesnt have or talk to a lawyer ever, which is evident in her letters. And if she was really concerned about her business she would stop filing frivilous lawsuits and pay me.

"I always gave bonuses to hard working people because I was given them by companies but stopped because it has been told this is treating the like an employee."

Bonuses??  There has never been any bonuses, she refuses to pay flat wages!! That is a joke.

 "I own this business because I like it, I don't have to sit around and collect disability and most of all because after 13 years, I have met some of the best people and companies in this industry. All hard working companies like myself."

13 years of misclassifiying employees is going to cost her huge. She cant collect disability because SS because she makes too much money at her own business.

She also threatened in all of her whining and complaining letters that she intends to file bankruptcy if things dont go her way. So if your working for Philbricks be warned

I really wish I had all the power over the State and Federal Government Jackie Philbricks dba Philbricks Building Inspections (PB FI) give me.

Lets address the facts, which Jackie is lacking in her own story.

I worked for Jackie for 3 months, I quit. Why? 16 hours a day and no paycheck. Yup, thats the real reason I quit.  Im not into working for free. Sorry.

I quit, she refused to give me my final paycheck $3,317.50. I wanted to be paid. Cant blame me there.  Im a single mother, I have no money to file in court.  I went to the NH Dept of Labor.  They asked me questions, I answered them, they asked if I had proof of what I was saying, I gave them Jackies Emails.  They took the case. They heard the case, I won. 

Keep in mind at the time, I didnt know anything about subcontractor/employee crap. All I wanted was my paycheck. Jackie to this day admits in EVERY single filing she owes me money... but what does she pay, NOTHING. 

Jackie didnt like the ruling against her that the NH Dept of Labor made, so she sued me in the Merrimack Supreme Court to get the DOL ruling overturned.  I hired a lawyer. She lost. The judge ordered her to pay the $3,317.50 plus attorney fees, interest and fees.  You know what Jackie paid NOTHING still. Now Im out my final pay $3,317.50 plus $1,500 attorneys fees, interest and cost.

(keeping in mind, she admits she owes me money, the only thing she is fighting is this whole employee/subcontractor crap, That I have NO say in or ability to change and never have.)

Now she thinks she is fighting me in the Supreme Court, but she isnt.  I dont have a dog in the fight of the whole misclassification of employee status at all. That is a fight against all the government agencies that ruled the way they did, (again, I have no say in any of it).

Now, she mentions the contract. All these government agencies have seen and read the contract, signed unsigned, doesnt matter.  She says I won cause it wasnt signed, she says I won because it was.  No matter how many people explain it to her, she cant understand, the contract just doesnt matter to the Government entities charged with making these decisions. AGAIN, not me.

Now, onto unemployment, She wouldnt pay me the $3,317.50 she owes me, she still wont and I spent another $1,500 on an Atty.  I have kids and no job and not even a final paycheck.  Hey kids, Im sorry cant eat this week because Jackie wont pay me doesnt fly.  My father died and I couldnt  see him his last Christmas because of Jackie.  So yes I filed for unemployment and I received it. Thank God I did, Im certainly not getting rich from it, but it does help a little bit. (very little, since they wont take into accout the money Jackie refuses to pay me)

So Jackie is mad at me, because I expect to be paid for work I completed over a year ago, and won in a court of law?  I will agree with Jackie

My husband does not own this business yet is also being attacked by her. He became a certified home inspector after having a double organ transplant in 1996 and until he got congestive heart failure and colon cancer was a popular and terrific inspector. After this, we also got involved in Field Service Inspections working for Vendors across the country and built a good reputation with many of them. We work for the three largest and more still. During the last 13 years we have sub-contracted many wonderful people and only a few that did not work out either because they did not want to or they did not like the work, contracts etc. This was their choice. Ms. Waring worked for three months as a sub contractor. I never met her in person and took her at her word that honoring a contract and performing contracted work was something she was familiar with and she both signed one and submitted a W-9. As allowed, one change she did not like was made to the contract so she opted not to work as well as indicating she may want to move back to Florida where she had come from. It is well within her right to quit, however, rather than submit a final invoice to me for payment as all do. She first filed for unemployment but had no credits prior to working for me in order to collect it. She had not been working. She immediately filed a claim against me with the Dept. of Labor, along with a friend of hers, 3 weeks prior to any date she would have been paid had she submitted her final invoice and log! She did this deliberately knowing I was out of state and I would not be notified. At the same time she was posting damning and damaging information about myself, my business and my family all over the internet which I have copied, pasted and printed. I am not sure why she refused to submit her invoice after attempting to circumvent the proper return of keys used in this business and entrusted to her. She then lied to the DOL, indicating that she was an employee and submitted an unsigned contract along with partial or handpicked emails leaving out the rest in order to gain a favorable outcome. Because I was out of state, managing the lives of two sick people and a husband on many medicines, she knew I had to have this hearing by phone. She also, at the same time, filed an SS-8 against me with the IRS, whom I have never had a problem with as well as other paperwork. She is on a witch hunt. She is part of an online group of people who d**n people in the industry who do what I do and work with who I work with. She has systematically ruined day after day of work for me as I have to speak to lawyers, send paperwork, answer questions and submit evidence. I has become more than the nuisance I thought it was in that this personal attack has affected my family, my health and most of all my trust in sub contractors. I always carried the insurance which I won't do anymore. I always gave bonuses to hard working people because I was given them by companies but stopped because it has been told this is treating the like an employee. For someone I never met in person, someone I gave work to when they wanted it and even more someone I told time and again I would pay immediately if she sent in her paperwork, it was a deliberate and nasty attempt to get money out of me as if I were making millions. I own this business because I like it, I don't have to sit around and collect disability and most of all because after 13 years, I have met some of the best people and companies in this industry. All hard working companies like myself. If you hire her and she does not like you, she will sue you in every possible way and post it all over the place in an attempt to ruin your reputation. Fortunately, those who know me, know better, however, damage is damage. Be careful because if you are a small business, doing inspections in a few states, her and her group of friends are dangerous to you and your business. There was no good reason for any of it. She simply did not want to follow the rules she agreed to and I got sued for it. Unfortunately, if she does not follow them, she blames myself and went so far as to trash other inspectors who had the audacity to say a good word about me. This too is copied, pasted and printed. I hope this gets to the people who are considering working with her because in the end, the attorney fees will add up for no good and true reason. I assumed that telling the truth to the DOL in NH was the right thing to do, not knowing she would stoop so low as to indicate that she was never under contract.
