Can you say SCAM? I was in a car accident a few months ago and my brand new car with less than 400 miles on it had over $8,000 worth of damage. I heard stories of accident victims who were awarded money for diminished value of their vehicle and decided to pursue it. I contacted a representative from Diminished Value of Georgia named Vivian Joyce to get some information. I was told their 100% money back guarantee services cost $150 and once paid I could have a check within the month. I should have paid more attention – COULD have a check… COULD. All I had to do was supply them with some info about the car / accident, and they’d create my claim.
So, what exactly does that mean? I asked the representative to clarify exactly what the fee is paying for exactly. The answer was “our mission here at DVGA is to help you collect the settlement you deserve”. Hmmm.. Being a native New Yorker, I naturally distrust everyone. So I called the company and asked again, what exactly am I paying for? I spoke with a woman named Lindsey Burns who told me I’d be paying for a claim that I could send to the insurance company so they could send me payment for diminished value. My next question – What happens if the insurance company says no? Ms. Burns laughed out loud at my questions and said that never happens. I asked, “Well what if it does?” She said that can’t happen, they cannot legally deny my claim. Well that sounds promising – right? I was convinced this was a good deal. I sent my payment and got ready to make some money.
DVGA sent me a Demand Letter to send to the insurance company. It’s a generic form letter where I have to fill in the blanks. I needed to insert my name and info and the insurance company info, as well as change the grammar of the letter, the whole letter said “we” in places it should have “I”. I fixed the grammatical errors and sent my letter. A few days later, I received a letter from the insurance company that basically said “No”. I contacted DVGA and asked, “Now what?” They gave me a second generic form letter to send, this time demanding less money within 7 days. I again filled in the blanks, fixed the grammar and sent my letter. Only to be sent a second “No” this time citing a Supreme Court Case that denied DV cases in NY. I again asked “What’s next?”.
A man named Tony Rached replied “I am not familiar with this court ruling and I am not sure if it actually applies to your case, especially since your loss happened before this ruling. Additionally, I am not in a position to comment on legal matters as I’m not an attorney. I would suggest you contact the NY dept of insurance and they should be able to assist in verifying the statements made by the carrier, you can also consult with an attorney or take the other driver to small claims.”
What the hell did I pay for? Now I need a lawyer? I need to go to court?! I didn't sign up for this. I demanded my money back. Long story short I was told “we will issue a full refund once the attached form is filled out and signed.”
The “attached form” was one that signs away my first amendment right to free speech. In order to be refunded for a service I am unhappy with, I must “promises not leave any feedback, comments or testimonials about the provider’s services or appraisal practices and remove any content already submitted against the provider, electronic or otherwise.”
Is this coercion or what? Mr. Rached said “When people are angry and ask for their money back, or threaten us, it is our policy to have them sign this contract”. How many people have fallen for this?
How many people needed to give up their 1st amendment right in order to receive a refund for services not provided? Not me, $125 is not worth my CIVIL LIBERTIES.
I told Mr. Rached I would not sign anything that negates my civil liberties, and he threatened to withhold my refund again. He claims he is "offering a full refund", when really all he's done is dangled the promise of a refund in front of me. All i have to do is give up my right to FREE SPEECH?
Mr. Tony Rached, you should be ashamed.
This company is a complete fraud. Don’t be fooled like I was.
