This company and I have been in court 3 times over the faulty oil change they gave me. Now in the last hour the man who swore under oath that his name was Rudy Martinez now in sworn statement from his Attorney all of a sudden his name is Ridy Cornejo! I win 4821.86! Rudy Martinez was from the beginning un cooperative and elusive! But after 8 months of fighting with them I won!!!!!!!!!!!!!!! Dont ever go to this place if you have a problem they will not take responsibilty till you take them to court! It is going to court just waiting the 10 days required here in Nevada for them to pay or not. I will post when I win! But to your response to my post the loud noise was the filter flying off and hitting under my car. I pulled over asap as I was going 65mph. And instantly turned the car off! When the tow truck driver lifted my car you could see a long line of oil and then a big oil spot when i came to rest. There is no doubt that loosing the oil filter caused the damage and they will pay! Thanks for the resonse:)

..and I do believe your report overall. If you paid them to replace the oil and filter..and the next day the filter is missing..there is little doubt that they screwed up big time.

But..you have a problem. And that is when you state there was a loud noise and THEN your oil light came on. You see electronics do not lie. If the oil was leaked out of your engine..be it a slow pre-existing leak which if of course true or not..is what they are claiming..or if the filter fell off due to their neglect...either way once the oil level goes below a certain point..you lose pressure and the light will come on. Unless the light itself (or the sensor) is defective..this is essentially fail-safe.

So how they are looking at this..is it is was your responsibility as the operator of said vehicle, to pull over and shut down once the low oil pressure indicator light came on. And as stated, if there is low oil pressure, the light will come on if the light and oil pressure sensor are properly functioning.

So..the order in which the events should have occurred..is oil level is low due to filter coming off..pressure is low..light comes on..operator shuts down engine before it suffers catastrophic damage.

According to this report the chain of events is lop-sided. Oil came out...catastrophic damage occurred (the loud noise)..then the low oil pressure light came on.

Sad to say..this works against you. And this may be way you gave up. Personally I would have took this to small claims court..unless I was aware there was no way I could win based on the obvious to anyone with an ounce of mechanical experience.

Why did you not pursue this in small claims court?

DISPUTE WITH DISCOUNT AUTO SERVICES 10/16/10 ON 10/16/10 AT 12:36 I STOPPED TO GET A STANDARD OIL CHANGE AND NEW OIL FILTER. SERVICE WAS COMEPLETED AT 1:23 I PAID $17.88 AND WENT HOME. I DIDNT DRIVE CAR ON 10/17/10 AND DROVE TO WORK ON MONDAY MORNING 10/18/10 AND STARTED TO DRIVE HOME AFTER WORK, ABOUT 2MILES WERE DRIVEN AND I HEARD   A LOUD NOISE HIT UNDER MY CAR, THEN THE CHECK OIL LIGHT CAME ON AND MY CAR LOST   POWER. I GOT TO THE SIDE OF THE FREEWAY AND INSTANTLY CHECKED THE OIL AND THERE WAS NOT A DROP ON THE DIP STICK!   I CALLED DISCOUNT AUTO SERVICES AND TALKED TO THE SAME LADY TAMMY AND ASKED FOR A TOW TRUCK BECAUSE THERE WAS NO OIL IN MY ENGINE AND MY CAR WAS AT HER SHOP LESS THAN 28 MILES AGO. SEE ODOMETER READING ON DAY OF OIL CHANGE AND THE ESTIMATE FROM THE SUV&TRUCK, SHE SAID IT WOULD BE AWHILE TILL SHE COULD GET ANYONE TO ME. I THEN TOLD HER I WOULD CONTACT MY OWN TOW COMPANY AND FIND A CERTIFIED   DODGE   ENGINE SHOP WHICH IS SUV&TRUCKS SEE ATTACHED ESTIMATE. THEY WERE CLOSED WHEN I GOT THERE AND I LEFT THE CAR AND THE KEY. ON TUESDAY MORNING THEY LIFTED THE CAR AND THE OIL FILTER WAS MISSING AND THAT THE VEHICLE HAD INTERNAL DAMAGE AND WOULD NEED A NEW ENGINE AT A COST OF $4708.86. I WENT TO DISCOUNT WHERE AGAIN I WAS TALKING TO THE LADY NAMED TAMMY WHO SAID SHE WAS THE MANAGER SO I DROPPED OFF THE COPIES OF ALL THE ESTIMATES AND TOWING CHARGE AND RENTAL CAR AGGREEMENT. I ASKED WHO THE OWNER WAS AND I WAS TOLD" I DON'T KNOW" AND I ASKED AGAIN YOU DON'T KNOW WHO YOU WORK FOR AND SHE SAID" I DON'T HAVE TO TELL YOU "!   I THEN ASKED TO SEE THE BUISNESS LICENCE WHICH SHE PUT HER HAND COVERING THE NAME ON THE LICENCE (SEE PHOTO) . I THEN ASKED WHO PERFORMED THE SERVICE ON MY CAR AND SHE SAID AGAIN" I DON'T HAVE TO TELL YOU! I LEFT WITH LITTLE INFO AND TAMMY TOLD ME I WOULD BE CONTACTED BY A RUDY MARTINEZ OR THE INSURANCE COMPANY THE NEXT DAY 10/21/10, THAT CALL NEVER CAME. SO I CALLED TAMMY AGAIN THIS MORNING 10/22/10 9:15AM AND ASK WHY I HAVENT HEARD BACK FROM ANYONE AND SHE TOLD ME I HAD TO GIVE HER MORE TIME. I ASKED WHO THE INSURANCE COMPANY WAS AGAIN AND WHO I WOULD BE HEARING FROM AND SHE HUNG UP ON ME! SHE THEN CALLED ME BACK AND SAID THERE WAS PHONE TROUBLE AND THAT I WOULD HEAR FROM SOMEONE BY THE END OF THE DAY. I RESONDED TO HER BY TELLING HER IF I DIDNT HEAR FROM ANYONE BY THE END OF THE DAY COMPLAINT LETTERS WOULD GO OUT IN THE MAIL TOMORROW, 10/23/10. I TOLD HER THAT HER   SHOP CAUSED THE DAMAGE AND I JUST NEED IT FIXED, WHY DOES THIS HAVE TO BE SUCH A HASSLE AND WHY ARE YOU PUTTING ME OFF? SHE SAID SHE NEEDED MORE TIME. CONVERSATION ENDED WITH PLEASE MAKE SURE THAT I HEAR FROM SOMEONE TODAY ON THIS MATTER OR THE LETTERS WILL GO OUT AND I WAS GOING TO CONTACT CHANEL 13 AND THAT I WOULD PICKET THERE BUSINESS TILL WE GET THIS RESOLVED. THANKS SO VERY MUCH FOR ALL YOUR HELP, MARY 10/27/10 Rudy Martinez told my mechanic at Suv & Trucks that there was an oil leak before and that my car was knocking when I came in which is a totall LIE! There was a small oil leak however I have an estimate that clearly states the cause of the engine damage is from oil filter coming off my car going 65mph on I 215. An oil leak and a missing oil filter is 100% completly different issuses. Please anything you can do or if you need any additional information please call. Update as of 11/09/10 they have declined BBB mediation and also mediation through the justice court mediation. 10 notices have been sent abd its off to small claims court, i'm out more than 5000 but have to eat it cause i cant afford a lawyer. Good luck and never use this place my life has been turned up side down by them!!
