Dish Network FAILURE TO REFUND ALL MY MONEY WHEN RIGHTFULLY CANCELLED RIPOFF Englewood Colorado

I received a dishnetwork flyer advertisement and saw that they provide many channels and the equipment are all free with free installation. Also, it had a 30-day money back guarantee.

I said to myself, "hey there is no risk to that". so, I just changed my service from cable to Satellite and ordered the dish.

During my first week, I was not satisfied with Dish. When I received the bill, I saw that I was charged about $249.00!!!

When I called to inquire, they told me that I had to pay for the equipment. Since I refused, I just told them to cancel service.

Few days later, I received a box to put in all the equipment. When the instruction asked me to get a part from the dish itself, I was angry since I did not want to climb up the roof. After fighting with them for a while, they told me to just leave it up the roof (I did not want anything up on my roof!!)

Anyway, within the 30 days, I packaged the equipment and sent them out and I got a call saying that they refunded my money.

However, when I called my credit card company, they had refunded only $49.99 and not the rest of $200.00.

I called to ask why, and they told me that I had the HD equipment which is considered an "upgrade" and thus, the fee was non-refundable. I told them that I was never told about this and the ad clearly states that if I return the goods in 30 days I would get my money back. However, they refused to credit me, pointing to the contract which I never even signed. Moreover, even if it was in the Contract, they should have made it clear to me that the 30 day money back guarantee does not cover upgraded equipment!!!!

Anyway, I am thinking about suing them for "false advertising". Anyone have similar actions to join in on the class action?
