On October 2, 2011, my 13 year old boy and I were on our way to the park when a truck ran a light and hit us nearly head on at an intersection. He was a Dish Network contract employee who was in San Antonio on a 3 month contract from California Dish Network office. He was actually in between calls when the accident occurred. I broke my ankle in 2 places and was out of work for over a month. My son is still having issues with soft tissue injuries. Come to find out this contractor had no car insurance and my insurance did not cover me and my sons injuries so now I am stuck with all the bills. How can Dish Network get away with this? How can they not be held liable? They should be ensuring their contractors are insured before allowing them to work. I can't get any lawyer to help me because there is no guaranteed insurance money. It's beyond wrong. I'm a single mom who is the soul provider for my child and not only is this a major amount of money out of my pocket but now I'm left with an ankle that is in constant pain. This needs to change, companies must be held liable for their contractor mistakes!!!!!!!!!

Thank you both so much for the responses! It's been an ordeal for sure. So not right that just because this guy didn't pay his insurance policies, he can just get away with it. And Dish Network doesn't have any responsibility because he's not a direct employee??? Does not make any sense to me. That is such GREAT advice about the universities!! I never thought of that and you are absolutely right about the zest! I am going to look into that tomorrow! I'l keep you posted...

Google "law students pro bono program san antonio" and follow up with area universities.
In your case, they wouldn't even have to do it strictly pro bono, since they have perhaps some chance of earning a contingency if they win.
Law students, unlike burned out veteran lawyers, might make up for their inexperience with zeal and a still fresh leftist, anti-business idealism that so many universities imbue their students with.
That kind of zeal might make things very hot for Dish Network and coax a settlement out of them.
And definitely go after the vehicle owner and driver, whether one in the same or not.
He might have other insurance covering his business that could have liability here, since he was on business in a business vehicle at the time. Y'all were therefore injured and damaged by him in the course of his doing his business. See how much a lawyer will charge to at least dig up that information. Maybe using that angle, one will relent and take the contingency case. Even lawyers don't think of everything.

on your auto insurance? Have you checked?
You might also try to win a judgement against him in small claims court if possible, but any award made to you would depend on his ability/desire to pay. Good luck to you.
My daughter was hit from behind by a Mexican driver illegally in the country and of course NO insurance.
Our uninsured motorist coverage paid her car repairs, medical bills and $25,000 for future surgery. At the time it cost us about $100 a year.
Sorry for your hardship, but your attorney would have gone after Dish Network if there was any hope of winning...lawyers ALWAYS look for deep pockets, even if they have to make something up to go after them.
They wanted to figure a way to sue the fertilizer company and the truck rental company in the Oklahoma bombing a few years ago.....pretty distasteful, eh?
