First, I got signed up to Dishnetwork due to fraudulent advertisement. There was an advertisement at my local news paper offering great deal on Dishnetwork program with the Dishnetwork logo clearly printed on the advertisement. Believing that it is a good deal and never have experience with Dishnetwork before, I called the phone number listed. I was told price and package contents which was fantastic.

I ordered through the phone, and it is installed the next day. Everything seems to be fine. Then a single bill for the first two months came, which is the sum for two months of the price promised. I called Dishnetwork just to confirm on the price, got a shock. They told me a price that is more than double the amount of the promised price. And told me that it is a 18 months contract not a 12 month contract. According to them, the party installed and promised me is their authorized dealer which is a third party.

As far as I know, when the third party agent displayed the principle's logo, I have reasons to believe in their apparent authority. As far as I know, I was given materially mistaken information. I might have some difficulty in proving scienter. I don't think I have any difficulty in proving other elements of fraud, including, material misrep, my intent to rely, damage, reliance on the false info.

In my opinion, as I don't even know the real contract term, I was tricked into the contract so bad, it is a fraud in execution. I naively thought that a contract would be voidable as other court cases and the customer rep would be begging me and let me go free. You know what? Those customer rep don't give a crap even under these situation which is a going to be a easy sweep in court. I realize one thing that I did not put into the picture, the time cost of taking them to court.( When I say court, I mean a civil court) I feel that even if their customer rep is not proficient in law, they are eager to give a lesson. The only thing that they are not going to give me a solution.

After my research, I found their executive resolution team's phone number. I called and speaked with a rep. The rep first tried to convince me that actually it was all my fault for signing up with their company and I am stuck with it. I was furious after being tricked and then treated as a idiot by their rep. The rep finally offered me a discount of $10 for ten months and offered to take away the additional strange penalty for so called not connecting my box to my phone.

I told him that the phone is connected and he concelled the appointment of technitian to check on it. He offered me a promise that there will never be the penalty for the future. You know what I made the worst decision of my life that I believed in Dishnetwork again after they tricked me into the contract in the first place. (After that, i never take any of their word seriously, and I haven't be tricked by anybody from their company since then)

Three month later, when I called in, I was told that the rep whoever spoke with me did not leave a note regarding the promise on no further phone connection penalties. And they throw the penalty back on me. One more lie from this company, is that the Executive resolution rep who gave me his direct number and told me that if in the future i have anything, I can just call him. I called him back on the second day, only voice mail.

Now I identify everybody from their company or associated with their company with the 4 letter word starts with "L". I don't have any hope for their improvment and I am writing my experience out to warn anybody who is honest and thus is vulnerable to tricks/frauds. I hate the way I was treated so much that I am offering free appearance on advertisement of any of dishNetwork's rival. And if you have a class action against dishnetwork, please contact my email. I am willing to testify my experience with Dishnetwork.
