3/14 Had my car towed to D&M transmission

 3/15 Mark at D&M said it needs a new transmission. Had a new transmission with a 3-year warranty.

3/23 Picked up car and paid with a check

4/17-4/20 Car would not shift into all the gears. RPM were at 5000 on the highway as Judi was driving it to work.

 4/20  Had the car towed by AAA back to D&M transmission.

Mark told me the car was 2 qts of oil low and the car was misfiring. Mark said he put in 2 qts of oil and reset the misfiring codes and the car was OK. I asked if he checked the transmission. Mark said NO the transmission was OK. No need to check the transmission.

I stopped by the Lexus dealer and told them about the oil and the misfiring codes.  I was told if the car was misfiring the check engine light would be flashing on and off.  They also said if the car was misfiring just resetting codes wouldnt help. If its misfiring you have to change something.

Called Martin from Martin Motors and Martin said the oil was low because the car was driven for a few days at 5000 RPMs. He also said the car wasnt misfiring and nothing was done to fix the misfiring. If the car is misfiring you have to do something like changing the plugs. 

4/21 Picked up the car. Paid $8.46 for oil 

4/26 The car again was not shifting into gear again.

Called Mark and he said check the oil. Had Jiffy Lube and the oil was ok.

4/27 The car drove prefect under 45 miles an hour. Had Martin check the code and everything was normal with the misfiring codes. Plus the check engine light was not flashing and the car was riding smooth. Just wanted go in gear over 40-45 mph.

Had car towed by AAA back to D&M again.

5/1 Mark told me I needed new spark plugs, that was the problem with the car. I paid $290.22 for spark plugs.  I said did you the check the transmission. Mark said NO the transmission is OK.

Martin Motors changed the spark plugs 52,000 miles ago. The plugs were for 100,000 miles

5/2 Picked up the car. I asked Mark what happens if it happens again.

Mark said, I will not look at the car again unless you get the O2 sensor replaces. Because the O2 sensor was causing the misfiring and that was causing the transmission not to work. He also said maybe your coils are bad. Good thing I bought a 3 year warranty

As soon as I left the transmission still wasnt  working right. I called Mark right away and told him.

Mark said, I unhooked the battery and that the transmission is electrical and tried to the battery. The car needs to go though a few cycles before it will run correctly.

I drove right to the Lexus dealer I told them everything Mark said. Lexus said the battery has nothing to do with the transmission. They also said the O2 sensor has nothing to do with the transmission. Also the O2 sensor will not make the car misfire.  

I called Mark and told him what the Lexus dealer said. Mark said, They dont know what they are talking about

The dealer took the car in and was going to put in on the computer.

5/3 Stopped by the dealer and was told, There are no misfire codes, the coils are good and everything is ok with the car. But the transmission has a problem.  I told them D&M would not look at the transmission unless I change the O2 sensor. They said it has nothing to do with the transmission. I had the dealer change the O2 sensor and paid $523.09.

5/4 The dealer called and said the new O2 sensor was in the car. The problem was the transmission wasnt really working and the car is un drivable. I need to have it towed.

I called Mark at D&M transmission. I told him what the dealer said. Mark said You sure they changed the right O2 sensor I said Yes.  I asked Mark for my money back and I would let the dealer fix the car. Mark said No. I said are you going to fix the transmission in the car. Mark said, I dont think the transmission is the problem, your car has a lot of problems. I said the car was in perfect condition and the dealer said everything was perfect but the transmission.  I said are you going to drop the transmission and check it. He said, I dont think thats the problem

5/8 Had AAA tow the car to D&M transmission

5/9 9:20 am I called D&M and asked for Mark. The worker told me that Mark was test-driving a car and he would call me back. 

11 am I called Mark again. Mark said I had a bad PCM board. He said that is the computer board for the whole car.  He was getting prices.

I called Dora at the dealership and told her what Mark said. She said its impossible, it would have showed up while they had the car on the computer. Plus the check engine light would be on.

I called my friend Dean  at a  Toyota dealership  and he had me speak with the main service manager. Told him everything about the car.  He said impossible and it sounds like a bad transmission and guy doesnt want to drop the transmission again.

Called Martin at Martin Motors (Martin has always services the car). He said your board is fine that isnt the problem. He said I know the car and everything is fine on the car.

I called Dave  from Auto talk WCBM. I ran everything by him and he said the same thing its not your PCM board. He said tell the guy if he is so sure; let him pay for the computer.

5/10 8:58 am I called Mark; I told what the dealers and the other mechanics said.  I asked Mark to check the transmission and rule that out. Mark said, Its not the transmission and the other people dont know what they are talking about.  Mark said The power train is bad and it needs a new PCM board He was going to get prices.

5/10 2:30 pm Mark called and said it was going to take another 5 days to put the part on. I said if you are so sure its the PCM board you put it in on your nickel.  Mark said I so such I will agree to put it in and if doesnt work, you dont pay me.

5/15 7:46 am I called for an update. They were waiting for the part.

5/17 10:30 am I went to D&M and the car was just sitting with the dash apart.

5/17 11:35 am I called All Computers and they said they shipped the part on 5/14

5/17 3:55 pm I called D&M and asked about the part. The worker said no part

5/17 3:58 pm Called All Computers and got the tracking number 1Z72V33E0353458864. Asked All Computers if the PCM comes programmed and was told yes.

5/18 7:30 am called Mark and he said Im putting the part right away and Im 100% sure the problem will be fixed

5/18 1:30 pm I called and asked for Mark. The worker went to get Mark, but came back on the phone and said Mark told me to tell you,we are just waiting to find out how to program the computer to your alarm system I said thats funny because the unit come programmed. I asked does the car work? He said The car works fine, its running well. I said lock the key in the car and I will pick it up tomorrow. He said, You have to talk to Mark, I will have him call you.

5/18 3:30 pm I called back and asked for Mark. I said Mark is the fixed. Mark said No its not fixed I said I guess everyone was right and the computer was not the problem and you took a Lexus computer out and put in an after market product, that I didnt need. Mark said, Maybe I got a bad computer, but I know your computer was bad I yelled at him and he hung up. I called back and told him what he has done to my family having the car and making us buy new parts. Mark said Cant you borrow a car I said No one is lending me a car. Mark said the car has a major electrical problem. He goes on the tech lines and everyone on the tech lines tell him its electrical.  I asked him if he going to drop the transmission and check now. He said its not the transmission. He was going to look at it on Monday.

5/21 2:45 pm called Mark. I asked for an update. Mark said he looked at the transmission and everything looked good. 

5/22 2:05 pm called Mark and asked if the car was working. Mark said no the car was not shifting from 2nd to 3rd gear I asked if the car was drivable, as I was just going to pick it up. Mark said No the car isnt drivable my equipment is not sophisticated enough to fix the car. Im going to take it to Len Stoler Lexus tomorrow.

5/23 1:54 called Mark and asked about the car. Mark said he towed it to Len Stolers Lexus

5/24 9:50 am called Mark and said if Len Stoler is fixing the car, can I pick it up at the dealer, as Im 5 minutes from the dealer and 35 minutes from your shop. Mark said No I have the whole dash out.

5/24 2:30 pm Mark called and said the car was fixed. I asked what was wrong with the car. Mark said When he changed the spark plugs he didnt put on a grounding strap on the plugs I said Mark the transmission broke 2 times before you changed the spark plugs. Mark said, That was a diffrent problem I said thats funny the car was doing the same thing before and after.  Then Mark said, We have another problem. Did your front window go down? I said yes. Mark said It doesnt work now and dont know what happen Then Mark said Did you have a crack in your windshield I said No. Mark said there is a 4 crack and that Len Stoler causes the crack. Would you please see what you deducible is on the windshield Mark was calling Len Stoler and I called my insurance agent.. Sal said the deducible is 500 dollars, but why should your insurance pay for a cracked windshield that Mark caused. Mark called me back and said that Len Stoler said they didnt crack the windshield. I told him my deducible was 500.

 5/25 Got to D&M at 10:45 am to pick up the car.

The Windshield had 2 or 3 large cracks. One crack was in the middle of the windshield from the very bottom to almost the top of the windshield. The crack was 2 feet 8 inches long. The other crack was off the big crack to right and it was 9 inches long. I asked Mark what he was going to do about the cracks. Mark said, Len Stoler did the crack I said you had the car are you going to pay for the crack as the car is not safe to drive. Mark said,  The car is safe to drive and I couldnt pay you I have to talk to my partner. I would need to get estimates I said the car is not safe to drive I need to get it fix now.

The front drivers window is was down 3-4 inches and it rattled when you open and shut the door.  I started the car and pushed the window button and the window didnt move. I asked Mark what happen to the window. Mark said, I dont know

I took the car and went right to Safelite Auto Glass in Reisterstown. They said I need to leave the car today (Friday) and I could pick it up on Saturday. The taped up the front window so it would stay up. Another day without the car. They were going to replace the windshield and check out the front window.

I went to Len Stoler and spoke with David . David give me the ticket on my car. David said the problem was a loose ground cable on the transmission. Also a ground cable on intake plenum was off. I asked David if it was a transmission problem and he said yes. I asked if it had anything to do with putting in spark plugs and was told nothing at all. Mark said it was when in put in the spark plugs. I asked David about the crack in the windshield and he said on Len Stolers notes it states that the windshield was cracked when the car got to Len Stoler.

5/26 I picked the car up from Safelite Auto Glass. They said we had to replace the windshield. The technician said someone had opened the front door panel, as screws were not on the panel. He said that some broke the clips off the window. They had to replace the front window so it would stay up. But something was wrong with the window going up and down all the time. He thought there was a short in the motor or the switch. We dont open and close the window, just in case it wont go back up. I think Mark shorted something, since he had the whole dash off and play around with the cars electric system.

 I paid Safelite $612.20 and still need to get the window fix.I also need to replace the master window switch cost at the dealer for the part is $813.00 without labor.

In all I didn't have the car for 43 days. The problem was a loose cable in transmission. Martin said if you would have dropped the transmission you should have seen the problem. He said it's a big job to drop the transmission and most people don't want to do it a second time.

I hired a lawyer and filed a law suit against D&M. Our court date was 2/11/2013 at 1:30 PM. At 11:00 AM D&M lawyer made an offer to settle the lawsuit out of court. I turned down the offer. I wanted all my money back plus. My lawyer give them a dollar number and D&M agreed. I got all my money back for all the extra parts plus the transmission cost and extra money.

What it comes down too is the transmission was fixed by someone else (the dealer).
