My name is Darryl, I am the victim of FALSE ADVERTISEMENT, DECEPTION, and MISREPRESENTATION. On April 10, 2006, I answered a newspaper advertisement for salespeople. The Don McGill Toyota advertisement offered guaranteed income; $2000 monthly base salary plus sales commissions. Later, I was informed about a $500 sales training reimbursable fee. After completing the sales training, I spoke with Mary Jarvis, Human Resource Manager and Sam Gonzalez, Sales Director; neither was acknowledge as being factual information (guaranteed income and reimbursable fee).It was explained that Don McGill has the highest turn-over of salespeople at than at other dealerships. I was told about 40 salespeople (were wrongfully terminated or) had resigned their sales position within the past 3 months; primarily because they did not receive the advertised guaranteed salary based income and the reimbursable training fee. As a result, the company had profited $20,000.00 alone in sales training fees that were not reimbursed. Additionally, the $500 training fee; which I paid was inadequate for the sales position for which I was employed because other experienced commissioned salespeople were required to assist me in closing all of my sales thus; receive half of all of my earned commission.

After receiving on of the several complaints that I had filed regarding the fraud and deception, I was terminated. On May 1, 2006, (A) I was wrongfully terminated by Don McGill Automotive Group, (B) I was the victim of a racial slur by Don McGill Automotive Group, (C) I was discriminated against by Don McGill Automotive Group, and (D) I was deceived with false advertisement by Don McGill Automotive Group. Ironically, Ferol Morris; GM and Carol Hodgman, Controller; attempted to justify my termination and the inappropriate racial slur. Beginning May 2, 2006, I made 4 requests for a copy of the complaint that I filed and the written notes. Carol Hodgman referred me to the attorney; the attorney refused to acknowledge my request. May 3, 2006, after the internal investigation, an apology was made, I was commended for my outstanding performance, and I was offered my job; without personal injury compensation for (1) the malicious insults, (2) the negligent termination, and (3) the Civil Rights Violations. Accordingly, I communicated with Ferol and Carol about my observance of the company's: (a) Unfair Employment Practices, (b) Discriminatory Policies and Practices, (c) Racism, (d) Racial Profiling Policy, and (e) Deceptive Advertising. I explained, before a sales manager make a sales/financial decision for a customer; they always (99.9% of the time) ask, "What RACE is the PERSON?" This appeared to be Don McGill's POLICY. Consequently, while terminating Sam was a noble effort to improve the working environment at Don McGill Toyota; ET was allowed to continue working for Don McGill Toyota. ET Huelett is the most racist person I have encountered since I have returned to the United States. I have actually heard him use the "N" word. The last time I heard the "N" word in this context was while I was in the military; preparing for a tour in Iraq, in January 2002. In detail, while I was qualifying a customer; the customer inquired about the interest rate. I related the customer's inquiry to the Sales Office. ET made a racist comment which appeared to be a common comment because everyone in the office only laughed (Sam, Mike, Darren, and Kirk). ET asked me, "is he one of them." I said, "who is one of them?" ET said, "a sand "N", a rag-head, you know them, not a regular person." I said, "I don't know what you are talking about." Jafari (an Indian employee) was immediately called to talk to my customer.

There are three FRAUDELENT issues which ALL of the new salespeople talked about: (1) the reimbursable $500.00 Training Fee and the guaranteed $2000.00 base salary, (2) Racial Profiling Policy and the discriminatory practices of Don McGill when qualifying an customer, and (3) the racist comments of Sam and ET. Regardless of the known confirmed facts and discoveries of the internal investigation, Don McGill Automotive Group was unwilling to changed it's policies nor accept the financial responsibility for its illegal, fraudulent, unfair, deceptive, discriminatory employment practices, and discriminatory operational policies and procedures.

As an 18+ year United States Military Officer and Gentleman; I had made a diligent effort to resolve all discrepancies and misunderstanding. Consequently, since my numerous requests were ignored and since my demands for personal injury compensation were not taken seriously; I have organized Operation: Economic Sanctions.

This weekend, I began organizing Operation: Economic Sanctions--a BOYCOTT. The demonstration will take place at both location; the Houston and Katy and it will be a continuous demonstration until all DEMANDS are satisfied. This Operation will involve local and national media coverage (newspaper, radio cable, satellite, television, and internet). The first demand is the immediate Termination or Resignation Ferol Morris and Carol Hodgman.
