I have been an employee of this company in a management position for several years and am finally fed up with all the lies and broken promises. Employees struggle to make ends meet, and fight over money they have coming to them. Customer issues don't get resolved, vendors dont get paid and the reputation of this company has alienated the market around us. Other dealers wont even deal with us! Every time I get paid my check is wrong, and I get looked down on or even punished just for trying to get what is owed me.

Every car has a $599 dealer fee that is profit off of the top, the employees see none of this! My pay plan has changed without me being told and the more money I make the more they take. Some empolyees are working 9-7 six days a week and sometimes on Sundays for a base pay of $1200 a month, far below minimum wage! They have also been known to let employees work only for their crappy free insurance plan and not pay them comission or an hourly wage! I have all this documented. [continued below]....

..... I have dealt with sexual harassment and degradation beyond belief! I am finished. I am getting ready to change jobs after the end of the year and fully plan on suing this organization for their disgusting attitude and business ethics.

I have been in the car business for ten years and know this is not how a real dealership works. I have never been fired and would not even be here if my previous dealership had not closed, so I am not some green pea who cant beat the draw, I know better. The sad part was that I gave 110% and always was a dedicated employee. I have wasted the last few years of my life working for this criminal, but no more! Contact me former cheated employees if you would like to participate in the lawsuit or if you have one in progress that I can join in on. This can't go on! He is a big corporation but we are strong in numbers, we need only stick together!

Believe it or not, the Legal System (most of it) and even the Mainstream Media are on the side of the CORRUPT Car Dealers and the Auto Manufacturers because they provide MILLIONS upon MILLIONS of dollars in advertising revenue to the Mainstream Media, and the Legal System thrives off of the money that these same Car Dealers and Auto Manufacturers pay them in order to be represented whenever they're sued.

Simply EXPOSE them all over the web. Make your own YOUTUBE videos and hold demonstrations outside of the Dealer's lots (off of their property) and hit them where it hurts- IN THEIR POCKETS!

Anyone can 'Google' this- YOUTUBE NISSAN ABC RIPOFF VAN TUYL, and watch that video as an example. And anyone can go to the TOYOTA page of this site, or the NISSAN page of this site, and see how customers are posting FRAUDULENT CONTRACTS, and even creating websites on TWITTER, correct?

Some people are even posting poems about TOYOTA'S executives all over the web, right? Anyone can 'Google' this- SLUDGE POEM, and read it. Toyota's CEO quit his position with Toyota exactly two weeks after that poem was posted about him. On 9-6-2007, Jim Press announced his resignation with Toyota. SLUDGE POEM was posted on 8-23-2007.

Don't waste your time in the courts. The Legal System in America (most of it) is CORRUPT, and on the side of the CORRUPT corporations in this CORRUPT country.

Two weeks ago, Plattner Automotive Group, which operates 11 dealerships in the State of Florida, agreed to settle a U.S. Department of Labor investigation and pay $71,129.00 in back wages to its employees. The Department of Labor determined that the company had violated provisions of the Fair Labor Standards Act (FLSA). One of the points stressed by the Department of Labor in that case was that while there is an overtime exemption for commissioned automobile salespersons, such salespersons must still be paid at least the federal minimum wage for all of the hours that they work.

Most clients believe that most commissioned employees are not entitled to overtime pay. However, that is not true. Some retail sales employees are exempt from overtime pay, but these exemptions require specific compliance with certain requirements. The classic example is the case of automobile dealerships, where sales personnel are exempt from the overtime pay requirement. Yet, this exemption is absolute. There are certain requirements that must be met. In addition, with respect to automobile salespersons, they must be paid at least the minimum wage for all hours that they work, regardless of whether or not they make a sale.

Typically, automobile salespersons are paid a set "draw" which is usually based on working forty hours per week at the minimum wage or slightly above the minimum wage. Problems arise if the salesperson either works more than forty hours per week or does not sell any automobiles. The problem is compounded if the salesperson works more than forty hours per week and does not sell any automobiles. The salesperson receives the draw, but does not receive any compensation for work performed over forty hours per week.

Another exemption for commissioned salespersons is the retail sales exemption. Typically, salespersons in a retail store are not entitled to an overtime premium. However, in order to qualify for the exemption, the following requirements must be met: (1) the employer must be a retail store, with 75% of the annual sales being retail sales; (2) the employee's regular rate of pay must exceed one and one-half times the applicable minimum wage for every hour worked; and (3) more than half of the employee's compensation must be in the form of commissions. If all of these requirements are not met, then the employer does not qualify for the retail sales exemption and an overtime premium must be paid for all hours worked over forty per week.

Have all your documentation together.  I warn you in advance, this is not a quick process.  It will take time, but the more individual complaints the D.O.L. receives, the stronger the overall case against this unscrupulous business owner.
