I was injured on the job. Back in 2001 the (miserable) state of texas sent me to this fool.

His report is full of lies.. even the dates of my surgeries he can't get right..

After seeing him and getting OTHER doctors to show he was wrong, that worked. But now, the insurance company wants and is forcing me to go back to him so they can listen to his lies (which he has been proven wrong) and take me off of my workers comp SIBS.

Last year this man alone made 906,000 paid to him by the insurance company (public record) and the yr. prior, 968,000.

So, you can see he is in the control of the insurance company and will try to take all legitimate workers off of their deserving income.. just to make himself look better and to pad his wallet.

Texas workers comp people, beware and try to get another doctor.. better yet, file here it DOES WORK.

I do remember studying that in Paralegal school and in the Criminal Justice programs. For that info, thanks, however, you are right but it doesn't matter any longer as I won all my cases with the workers comp commission, and the mere fact that Foox dropped the suit is fine. I just told his attorney that I would be happy to make a public apology to local churches, radio stations, news media of which several were interested in the story and local papers. So, he dropped the suit.

I did not have to go back to him to be examined. His prior reports were clearly overturned by a wonderful Dr. Green that the commission mandidated I go see. Dr. Green required a functional capacity exam which also clearly showed my injuries and capabilities. All of which were just the opposite of Foox's report. So, I fought the system, and I won. I don't have to mess with the workers comp commission any longer. I received all the 20 qtrs of SIBS that I was entitled to... that of which Dr. Foox was trying to discredit me, and it didn't work.

To the person who wanted a second opinion.
I had to go to different benefit review conferences, of which I won. The commission given this stuff with Foox selected another designated doctor for me to go to. His name was Green. He truly did a wonderful job. His opinion clearly stated I was unable to return to work, of which the functional capacity exam showed, and I won all of the entire 20 quarters of my SIBS.

I am now off of the purvue of the workers comp commission and never have to deal with them again, thank goodness.

However, in your case, you can file for a hearing or get your primary doctor to dispute foox's findings.. this may help.

Hope it works and I would also suggest you get an attorney, I did.

By the way, Foox did drop the suit.

Your Constitutional right to free speech applies only to the government....

So if you are an employee of a government agency and you do not violate a law such as not disclosing classified information, then your free speech rights to criticise the government agency are protected. But you have no free speech rights when private citizens and private employers are involved because these entities do not have governmental powers. The reference to free speech in the Constitution states that "The GOVERNMENT shall not..."

Wether your "Dr. G. Peter Foox MD" could be successful in his lawsuit, I do not know, but having "deep pockets" relative to the pockets of your advesary is a major asset in court cases. And if someone is making more than $900K per year and your income is far more modest, let's say $40K per year, then avoiding a lawsuit is wise on your part. Sometimes when people do win a civil lawsuit they really loose... they achieve a Pyrrhic victory, if you will.

Had identicle situation with Foox happen to me!

Hi Pat, I had the identicle situation happen to me regarding Foox in Tyler, Texas. Seeing him for an on the job injury, he tried to release me to full time status when I clearly could not do my regular job duties. He tried to have me sign a waver stating that I was o.k and I had no injury, releasing him from liability in the claim. I declined to sign and went to my ATT. I was wondering if you could help me which doctor you visited to get the second opinion? I need help with finding a doc that will give the injury a fresh and honest look, thanks, Ziggy

Did retraction get him to drop the lawsuit?

Pat, did Dr. Foox insist that you print a retraction in order to drop the lawsuit? If he did, I can understand why you did it. If not, I'm a little confused because you seemed very adamant. I'm interested because I'm from East Texas and I still have family there.

I would like to retract the statements that I have made with regard to Dr. Foox:

1.The fact that I called him a fool. (this was done in anger)

2.Overpaid and bought by insurance companies.(I did not mean to direct this statement specifically to Dr. Foox. It is my belief that doctors in general get paid large sums of money for the short period of time that they spend with patients.

I also believe that insurance companies are more inclined to choose a doctor that will submit reports favorable to the insurance company).

3.So, you can see he is in the control of the insurance company and will try to take all legitimate workers off of their deserving income just to make himself look better and to pad his wallet.(It was also wrong for me to assume that the insurance companies control him. I based my opinion on this because I believe that insurance companies choose a doctor that will be more likely to rule in their favor.

The public record of his prior two years of income from Workers Comp, found at the Workers Comp web site leads me to believe that they have been pleased with his reports due to the amount of money that he has been paid by them. It was wrong for me to assume that he treats all his patients the same way he treated me. For this I apologize.

Foox sueing me?

Foox is now sueing me for filing a complaint of which in my opinion was justified.

Is it now safe to assume that we as patients cannot even voice our opinion any longer?

Is this not a violation of our Constitutional Rights?

Foox running scared

Today, Foox contacted the adjuster of the claimant in this case (mine) then the adjuster called my attorney and wanted to know what was going on... Of course my attorney's office didn't know..

I have also file a complaint with the State of Texas Medical Examiners, the licensing agent for Doctors in this state...

So now he is resulting to more unethical behavior, contacting my adjuster, and attorney... What else will he stoop to?
