I am a single mom who has been out of work on medical disability since late Feb. I have made my car payments late due to waiting for disability checks. I faxed Drive all the state disability documentation and kept them apprised of payment dates and arrangements. Although late, I continued to make monthly payments. When due to go back to work in early June my position had been eliminated. I now was waiting for unemployment.

Drive sent a repo co to my home @ 5 am they banged on the windows of my 3 daughters (18, 17 and 15) bedroom windows w/police flashlights. The car was wedged in. My partner asked them to return in the afternoon (they wanted to drive over the lawn) after we could speak to Drive Financial Services. He called @ 7 CT and made the 2 payments for me making me current.

Drive had my car towed @ 6pm that evening. (We called 2 times during the day 10 am and 1pm, after that to assure all was properly taken care of) We then proceeded to undergo 2-3 hours of tortotorous phone calls from Rick and Shamika and a few other nasty horrible emotionally abusive Drive representatives that told me that the car was theirs until it ws paid in full and technically they could take it whenever they wanted to! It is now 10 am and my car is still missing. No one will help me.

I am an employee here and I am familiar with the names you posted onto your complaint. Normally Drive Financial makes the decision to repossess cars based on many factors. Unfortunately your vehicle was taken after payments were made. Here is the breakdown of this situatuion.

Once your account is out for repo you need to make a payment using certified funds ie. moneygram or western union. If your vehicle was picked up after you made payments you can speak to the redemption department to negtotiate terms to get the unit back.

We do understand how stressful the situation is but you must call in ready to talk business and negotiate a way to get your account back in good standing. The bottom line is that the account was in default and hopefully next time if you fall behind you keep in contact with your assigned account rep and set up arrangements you honestly know you can keep

You don't state how late you were.

Most creditors have a clause in their loan contracts that states something along the lines of "if you're late XX days, we may at our discretion, call the remaining balance due immediately.

You should carefully read your loan paperwork. If it states a specific time frame for the entire amount to be due, check to see if you exceeded it.

This "immediately due" clause is NORMAL and not a rip off. I've been financing my new auto/truck pruchases since 1974 and everyone one of my loans had such a clause.
