Drive Time has failed to uphold their warranty, put myself and my four children in harms way and has jeopardized my lively-hood and ability to support my children.

on Friday the 13th my transfer case caught fire.. the Drive Time representative told me to drive the car to a service center.  I did the car's transfer case was blown and according to the man who inspected the car with a diagnostic test said the car had been this way for some time.

it took them 7days,  a rebuilt transfer case with 88 thousand miles. and 20 mins for my car to leave the AAMCO Transmission shop  and catch on fire.. the car was never reparied . and my shoe melted to the gas pedal as I drove down the road.

they said they wanted my insurance company to pay for the totaling of the car. i had not had the car for 3 months . and they wont give me another one. and my insurance company says they can't help b/c the car was under warranty.. and they aren't responsible for cars under warranty. unless it was a collision.

so here i am a single mother of 4 children, and a small business owner. with 4 employees. that has to somehow find a car in 24 hours. oh yeah. they said they wouldn't cover the rental either. LMAO.

please join me in spreading the news that DRIVE TIME. is fraudulent and cares nothing for the people they say they are "helping" .on top of it all. i somehow have to find money for a retainer for an attorney to go after the money i put out for the car.. under warranty. that they fixed. that they wont replace!

If you are not leaving anything out, it sounds like you need a lawyer, and you may be able to find one who will take your case on contingency if it is really open and shut.

You didn't mention if Drive Time covered the original warranty repair or not, but it sounds like that is the case.  If so then they are actually meeting their obligation.  If not that is a totally separate issue than the car fire.

As to the fire.  Mechanical warranties cover repair to parts that break, they are not for repairing a car after an accident or fire.  So where is your insurance company in all of this?  As it sounds like they are feeding you a line.  If you have comprehensive coverage, which you should if the car is financed, the fire should be covered.  So I would contact your Insurance and tell them to point out to you exactly where in your policy does it say that they don't cover car fires.   If the fire was a result of a bad repair it is up to them to go after the repair shop.

This brings up AAMCO's responsibility.  While there may be no proof that AAMCO may have been responsible for the fire, it is very suspicious and coincidental  that something that they just rebuilt caught fire less than 20 minutes later.
