 Only had car 7 months and Covetter and O2 sensers failed and actually caught fire Despite having a Warranty, Averex told the repair shop they won't honor Warranty despite safety hazard and failure under warranty What legal options are there for those in this situation? I just want the repair required for the car to run and be safe Thank you

Warranty

You didn't read the warranty, did you.

 

The limited warranty is sometimes a 5 year, 50,000 mile contract for the powertrain (engine, transmission, and drive axles), with a 3 year, 36,000 mile warranty on the cooling, steering, and climate control. Or just a 3-36 limited warranty with those 6 vehicle systems, I believe it varies from state to state. Aeverex explained, and I verified this myself, that the warranty, being limited, has a specific list of parts of what they can assist with in each vehicle system.

 

If you look at the contract, which you can only get from drivetime or bridgecrest, each system has its own box, and in these boxes are all of the parts that they cover. I believe it's pretty self explanatory that after owning the vehilce for 7 months, you're now in the extended portion of the warranty that you SIGNED and AGREED to, remember that. After reviewing the warranty, neither the catalytic converter or oxygen sensors are covered components listed under the engine system. This leads me to believe that they separate the engine, sensors/electrics, and exhaust.

 

Sadly, Aeverex is a 3rd party warranty administration company, so they only handle the warranty for Drivetime. The warranty itself is a Drivetime product, not Aeverex. So because they didn't write it, they can't make any changes to it, only administer the warranty the way it's written by Drivetime. They only people who could make exceptions would be the author, Drivetime. 

 

However, because this warranty, it's coverage, and all it entails is something you SIGNED and AGREED to, they are under no obligation to cover anything that is not included in the contract, regardless of the situation. They could possibly make an exceptio, but if they do, then it would ultimately be at their discretion what they do assist you with outside of the warranty.  If you didn't read the contract when you signed, then that's unfortunately your fault. If you lost your copy, then it is your responisbility to request another for your records.
