 I was desperate for a dependable car, well I got a nice car.   Since I could only do $500 down, I got a huge interest rate.  That is my bad, I was desperate.  I know they financed GAP insurance into the loan.  Well, I got to the point that I am able to pay the car off completely...but before I will, I keep requesting to speak to someone who could help me take the GAP insurance off.  Most reps didn't know what I was talking about...then one rep told me that they don't do GAP insurance.  I asked them, so if I totaled my car and my insurance paid the blue book value, what made up the difference?  Well, they informed me that they would hold me responsible for paying the difference and they could put me in another vehicle and finance it.  I don't think so people.  I know they did this...I heard them...I've looked at all my documents, but I cannot find the fine detail of this...but I remember the account manager talking to the sales person, "did you put the GAP into the loan" and their response was "yes".  Now, this infuriates me when all the reps tell me they don't know or no we do not carry GAP on our loans.  I am going to call them again tomorrow, and I am going to ask again.  I am fed up.  I know that I have paid $6000 + in interest since I first purchased the car, now it will take over $12000 to pay if off.  If I let it repossess, my credit will suffer.  I am very frustrated and hope that someone can give me insight.  NEVER BUY FROM DRIVETIME!

Dont know what state or world you live in but not all GAP insurance is pro rated. and they tried the same thing with me . so I drove the car thru there front window sorry brakes failed. filrd against insurane. lol

When you go to the grocery store, do you ask the person at the register, "Can you tell me what I bought?"  Why then would you be asking the salesman to tell you what you bought???  Any gap insurance is an add-on.  It is a line item product which will show up as such on your contract.  Did you ever read the contract?  When you insure a car, you insure the car...ONLY!  You do not insure the loan. 

When something destructive happens to the car, the insurance company reimburses either the owner or the lienholder the value of the car one second before the destruction happens.  When you are upside down in the deal (which means you owe more than the car is worth), then it is YOU who needs to come up with the extra amount to cover the amount of the contract.  This process happens every day and is not illegal, immoral or unethical.  If you have gap insurance, then that insurance covers that extra amount.

 Okay you seem to take a huge jump and there are a lot of details missing.

You buy the car and know you are getting a huge interest rate, but that is not an issue with you.  You also believe you bought GAP insurance.  Okay..so we fast forward and you have the ability to pay off your car.   But before you do you talk about having them refund the GAP insurance.  But somehow you make the leap that if they won't refund the GAP you are going to let them Reposess the car?  These are two different things and paying off your car is not contingent of you getting a GAP refund.

First of all MOST GAP insurance is through a 3rd indepenent party, where if this is the case Drive Time couldn't refund it..even if they wanted to.   Next, if your paperwork doesn't say you bought GAP insurance, regardless of what the Salesman told you you didn't buy it.  So pay off the car and move on.

As for the GAP insurance, even if you did buy it any refund would be pro-rated.  So if your car loan was 4 years and you paid it off in 3 you would only be entitled to 1/4 of what you paid.  Also, not sure if you were thinking of having this refund amount applied to your payoff, but that is not how it works either.  The GAP refund is processed after it has been proven you paid off the car and you are issued a check after the fact.
