E & H Asphalt, LLC Started work without authorization, having made sure I was not at the job site to stop the work.Tore out my RR tie bridge first, so when I came home and saw what he was doing, it would be impossible for me to get to my driveway if he stopped at that point.Big Spring Texas

Continued and expanded work after being told not to do any more. Quoted one price, then doubled and tripled it after ward, and insisted on at least half paymant. even though I kept telling him to stop as I did not have the money to pay for the work at that time. Assured me the paving would be three inches thick; it is one inch thick in most places.Threatened litigation when he thought he was only going to receive the half payment for the unauthorized job. Threatened me with the presence of sheriff's deputy on my property, but was foiled because I had called the sheriff also. Still insists that I pay for the unauthorized job, when it should come out of his employee's pay, since that man started the work, havig lied about it being authorized when it never was. 

Shortly after an overpass was built near my house, an employee of E & H Asphalt came onto my property and introduced himself as the business owner's brother-in-law. He offered to pave my driveway with materials left over from another job. I told him any such work on my property would have to wait two or theree months, probably more, and a great amount of preparation work wol have to be done first.

He kept returning, wanting to know when I wanted the work done. I told him I did not want it done right now, it would have to wait. He offered to pave another drive area to the horse corral for my friend who keeps his horses on my property. Again. I told hit we would have to wait, I would not have any money until Wednesday, and even then i wanted to wait as it would not be enough.

He came back on Wednesday morning wanting to start the job. I told him, again it would have to wait. And I told him I did not want anything done when I was not there, and that has always been my policy. Besides I wanted a written cintract stating prices and exact work to be done before any work was started.

I came home from town that afternoon to find the rail road tie bridge to my driveway torn out, my driveway doug out, and this employee digging up more ties with a skidder.

My friend was there, feeding the horses, so I started toward him to ask if he knew what was going on. Before I could get there, the skidder driver jumped foo his machine and ran to me claiming that my friend had given him the go-ahead and promised to pay for everything, leting me reimburse him. What he had told my friend was that I had told him to go ahead and start, even without my being there.

He had already scraped up too wide an ares of driveway, and I told him not to widen it, or scrape up any more, pointing to the area I wanted him to leave alone. I had to complete some computer work and could not watch him at that time. There was a loud boom and the house shook as he hit the house with the skidder.

I went outside to find he had scraped another eight feet, the exact area I had told him to leave alone. I kept telling him he needed to stop as I could not afford this. He grinned and said my friend had it covered.

After having stated a price of less than five hundred for my driveway, he pretended to measure the area and decided he wanted eleven hundred twenty-five dollars, just for the one smaller area. He told my friend he wanted nine hundred for that area, after an original quote of three hundred.

I reminded him of the firm quote he had made and also that I did not have that kind of money, that was why I always said we needed to wait before doing any work. He insisted on at least five hundred dollars, and I wrote a check, using money set aside for doctor, dentist, and orthopedic appointments.

That evening the owner had words with mu friend over the phone and threatened litigation for non payment, although payment had been made on the job that never was authorized.

Two days later, my friend called and told me the owner had called him and wanted us to meet him at my property, thqt he had called the sheriff to be there waiting for us. I thought it was the employee, who I suspected wanted to cause trouble, so I called the sheriff's office myself and requested a deputy meet me at my house.

The deputies did not do much, but wanted us to resolve the matter. I kept telling the owner that the work was never authorized, and his employee kept changing the prices. I also reminded him that I had wanted a signed , hard-copy contract before any work was to be done. He expected me to believe an invoice after the fact was as good as a contract and kept insisting I pay for it anyway.

I have since heard from many former costomers of E & H Asphalt. They all say the same thing. It is a rip-off. Don't have any thing to do with them.

I didn't want anything to do with them. They dug up my property without authorization when I was not there to prevent it.

I did, Indeed meet Tyler Chase for the first time when he and I had called to have sheriff's deputies meet us at my property. He, himself had done no work at the site. It was his "brother-in-law"/employee who had torn out my RR bridge while I was absent from the property, and continued to scrape up the driveway after being told not to do any more, and that I had told him to wait as I could not affprd to have any work done at that time. Yes, there was a young boy there. The brother-in-law/employee claimed that the boy was his son. At one time I witnessed the boy climb aboard the skidder and maneuver it from one point to another on my property while his father watched.

The material used to "pave" the drives was obviously reclaimed material. While repairing some of the damage done by the skidder, my friend was replacing a portion of the RR tie bridge with some of the salvageable ties when he found pieces of roofing shingles and even roofing nails in the paving material. I seriously doubt that that came from any quarry.

I have no doubt that E & H Asphalt has done many quality jobs for other people, but Mr. Chase's brother-in-law/employee made an enormous mistake this time. I am sure he was not authorized by the company to solicit this job. He solicited, anyway, and was told be me not to do work then, and certainly not without a hard-copy contract before any work was done. He then proceeded to destroy my railroad tie bridge while I was not there to stop him. I do not dispute that he was not authorized by Mr. Chase to do it, but, as the owner of the company and employer of the brother-in-law, Mr. Chase is responsible for his employees' actions. Instad of claimimg to have done the work himself, he should be docking that employee's pay to cover the damages done and to pay anyone else to whom money is owed for the blatent disregard that employee has shown for my instructions to refrain from beginning any kind of work on my property, for the company's policy against soliciting work, and for the safety of a young child.

  After reading Ms. Clines claim of contacting Tubbs Quarry. I personally visited with the owner Mr. Stratton. Mr. Stratton assured me that he is the only person to have access in answering customers calls, he stated that no one has contacted him and that it is against there company policy to discuss information about there clients. Furthermore Mr. Stratton did in fact produce documents for the materials purchased for Ms Clines residence. In my opinion Ms Cline continues to be caught in slanderous lies. At this current time E&H Asphalt, llc is taking full legal action against Ms. Cline for defamation and theft of services.

I am very disappointed that my company and name has to suffer slander. I am more disappointed about the fact that my son was able to work with me that day, being a no school day, and Ms. Cline would accuse me of anything illegal especially with my child present. In my opinion I don't think Ms. Cline took into account that there are pictures of my son taken with her livestock on that day, disproving her allegations of me not being there performing the work myself. This will be the first time in my companies history that we have been forced to take legal action against a client or had a client ever filed suit against us. No work was authorized to be done on my property. NO paprework was signed or even offered proir to work being done. I requested a contract be drawn up, but none was produced. The employee certainly DID repeatedly come to my house trying to drum-up work. I repeatedly told him "No, we'll have to wait". The employee also bnoasted that the ,aterials used were "leftover" from another job, NOT purchased specifically for this job, as Chase claims. Cahse threatened to have Tubbs Quarry put a lien on my property as that was where the materials were supposedly purchased. When Tubbs was reached about this, we were told that they did not do business with E & H Asphalt, and no materials had been purchased there. That, you can confirm with a call to Tubbs Quarry. I never saw Tyler Chase until AFTER my property was damaged and the employee wanted money for it.

 My name is Tyler Chase owner of E&H Asphalt, LLC. I would like to invite to anyone and everyone who reads the slanderous report against my company that if they have any questions or want to know the truth please contact me at my personal number 832 902 8435. My company was hired to perform work at a residence in Big Spring Texas that work was performed in a workmanlike manner with materials that were purchased for that job specific... the price of that job was given in writing prior to that work being performed. After completion of the work Ms. Catherine Cline, the customer and author of the slanderous report against my company, refused to pay the whole amount due with excuses that the man renting a piece of her property was to pay for half of the bill due. That man was unwilling to pay and Ms. Cline unwilling to be stuck with the bill refuse to pay the whole amount total and paid half the amount due. My company took the necessary steps to resolve this matter. An agreement was reached with Ms. Cline in the audience of Big Spring peace officers that she would pay the remaining balance in 30 days, this was terms Ms. Cline presented to our company that we accepted. A month later I was surprised to learn that she was taking us to small claims court. My name is Tyler Chase 100% owner E&H Asphalt,llc. No person employed by my company has authorization to solicit customers. I as the owner do not blameshift, if Ms. Cline or anyone have problems with the work or business conducted then I am to blame... the allegations presented by Ms. Cline are false and inaccurate. I myself performed work at her residence and at no point was I asked to stop performing the work that I was hired for nor was Ms. Cline ever solicited. My company is employed by numerous business, cities, and residences. This is the first report of this nature and false. My references include County Judge Sharpe, Gail Texas, Mayor Josh Stevens, Lamesa Texas, West Texas Crisis Center, Big Spring TX, Beau Patel owner Quality Inn Big Spring TX, Howard County Fair Association, Big Spring TX, St Anne Catholic Church, Colorado City TX, First Presbyterian Church, Snyder TX, Snyder Daily News, Snyder TX. Lamesa Municipal Golf Course, Lamesa TX, County Judge Tom James, Dallas TX. Lastly, Ms. Cline claims in her allegations that there are other people that have said that my company has ripped them off...I ask that they please come forward with their claims and to contact me. I believe that this is a false claim in itself made by Ms. Cline. I put God first in my life,family, business. It is an insult that my integrity has been dishonored by a person unwilling to pay their bills my company will be seeking legal action against the defamation of my character and companies reputation.
