Earnware Corporation Refusing to refund money taken for unused pre-paid minutes upon cancellation of account. , Carlsbad California

I notified the company in July of 2009 that I had decided to switch my two 800 lines to another carrier and that they would be ported shortly thereafter.  Upon notification that I would be soon porting the lines, the company charged my credit card $80 for pre-paid minutes that I would not be using.

When I canceled my account 2 weeks later, I called and asked for a refund of my unused minutes, and also asked why they took the money when they knew I was porting the numbers.  The company told me that the EULA that I signed with them (which I never did sign or see for that matter) stated that NO charges would be prorated upon cancellation of account.  They would not even prorate my monthly fee of $44.95, which I had paid only 5 days prior to cancellation.

After being a happy customer for more than 2 years, I am extremely unhappy with how the company is handling a refund of my pre-paid minutes...which are rightfully mine, and should not have been taken in the first place. 

On another note...I was told by their phone rep that I should have had one pool for both 800 lines and thus been charged only $40 instead of $80, but a mistake had been made in their system which charged me the extra amount, and which cannot be refunded.

Beware of the cancellation policies of this company!  They will take your money, and no matter how many e-mails you write to them, they will not respond!
