Ecast settlement sent IRS a 1099 from 2011 that i never got a copy of. Four years later my taxes were levied for unreported income.  This company has done this to so many people from all the reports i have read.

 

I have been battling the IRS for three months to resolve this frud.  This has become the biggest mess ever.   

 

Your company has other reports on file about this ECAST settlement.   I just want my money back

 You will not get you're money back. You owed a debt you failed to pay on. You're lucky you're just paying the taxes and not the full balance owed! That money you are paying is LESS than what you should have paid to eCAST.

eCast Settlement Corporation purchases accounts from creditors (ex. BOA, CitiFinancial, etc) which are involved or will be involved in a bankruptcy. The only reason you would be receiving a 1099-C from eCAST is because your bankruptcy was Dismissed. Which, in that case, you are still personally liable for all the debt involved in your bankruptcy.

It was YOUR responsibility to have contact your creditors to settle the debts and to regularly update your information (i.e. your address).  eCast always sends a copy of the 1099-C to you. The address they send it to is the one listed on your Bankruptcy Docket. If you have moved after your bankruptcy dismissal, it is YOUR responsibilty to contact them, not eCAST's.

If your bankruptcy is dismissed, you have to pay your creditors, bottom line. If you think your debts just disappear, you're wrong. Depending on your state, the Statute of Limitations determines your time-frame in which you can resolve these debts. If you fail to address them, down to road, they will bite you in the butt in the form of a1099-C.

You made the purchases/obtained a loan. You didn't follow up when you're Bankruptcy was dismissed. You didn't advise of the address change. You're chance to address this debt was lost. You can't neglect your responsibilites. eCAST doesn't care if you don't pay them. Federal Law REQUIRES all written off balances to be reported.

You failed to do the responsible thing, and now you're paying for it. eCAST is a valid company, the IRS will never request for Proof of Validity because creditors are the ones filing it with all the necessary paperwork.
