In May of 2008 my grandson who was attending karate classes moved with his family to the southern part of the state. I had signed him up with an 18 month contract and was told by David Hughes (Ernie Reyes' World Martial Arts in Gallatin TN) that 30 day notice was needed if unable to attend and contract would be cancelled.

In early June I contacted Educational Funding Company (EFC) and advised them of the situation. My daughter went to the school where my grandson would be attending and had the principal write a letter that my grandson would be enrolled in school there. I faxed all the information to EFC and spoke to "Vanessa" on the phone repeatedly. This was June 12th, 2008. Then the nightmare began.

Over the last 4 months I have been shuffled from "Account Executive" to "Account Executive" at EFC. I have contacted David Hughes 3 times over the last 4 months and was told to contact EFC. I contacted EFC yesterday 10/30/2008 again for about the 20th time in 4 months and was told that David Hughes has told them to not honor the cancellation and he wanted them to collect the full tuition. I then called David Hughes and was told it was EFC stating that they did not have proof of my grandson attending school 135 miles away and they wanted his school records.

I have contacted my credit card company and put it in dispute. The credit card company is refusing to pay EFC because they deemed I had fulfilled the letter of the contract. I allowed EFC to take the tuition for the months of June and July 2008. Now I have received a letter stating I needed to send them more credit card information so they can get more money. I am going to contact anyone and everyone that will listen including the Gallatin Newspaper to stop this harassment.

Please think long and hard before signing a contract with David Hughes and EFC and pray that you never need to end the contract. Be ready to pay for something you did not receive. These people are not about "developing oneself physically, mentally, spiritually with good character" as the creed states. They are about money, money, money at all cost.

Educational Funding Company complies by the letter of the Student Enrollment Agreement. There are provisions for cancellation in the enrollment agreement that can be exercised. Sir, I am not affiliated with this particular school. but I do have some usefull input for you. Mr. Hughes uses ECF to do his billing collections. When you made the agreement with the school there were very specific conditions for cancelation therin. The school typically gives you great discounts and concessions in price based on your willingness to commit to long term arrangement. This affords you cash savings and allows the school to plan and implement thier budgets in a predictable manner. As a consumers we look at a contract as great thing when it saves us money, but as on ordeal when we wish to end it. Then we get caught up in "the credit card company said this" and someone else said that. The long and the short of it is, that your agreement is binding and is with Mr Hughes.
I do run a martial arts studio on the of the side of the country, and find consumers who are willing say or do anything , no matter how fraudulent, to get out of an aggreement. So you might understand why they are asking for proof of what really is happening. I know you are not trying to commit any fraud, but I am sure that if you simply provide them with the documentation they require..... everything will quickly work to your satisfaction.
Mind you, a letter stating what is being planned is not something stating that it did actually occur.
We all try to do the right thing.
