As reported by others, EEOC dismissed by complaint in agreement with my employer when I submiited documentation (policies) to prove them wrong. I believe that employers, particularly mines, now realize that EEOC is either incompetent or pro-employer and so they encourage discrimination. What needs to be done is a class action lawsuit by those who have been violated. My case is a slam dunk and now I must file with a court and so I need lawyer pro-bono preferably. Please email me.

 Tim presented a good overview of the administrative process at EEOC.  However, as a 25-year employee of the agency, I am aware of a "behind the scenes" factor that was not explained.

First, the creation of the Civil Rights Act in 1964 was a fierce battle, as many lawmakers believed racial discrimination was unimportant or did not exist.  In order to secure the passing of the Act, the inclusion of sex and national origin protection was negotiated into the law.  The EEOC was created the following year.  Eventually, ADEA (age) and the ADA (disability) discrimination were also investigated by the EEOC. Despite these inclusions, many members of Congress continue to believe discrimination does not exist, is unimportant or is counter-productive to business survival.  As a result, pressures are placed on EEOC to resolve all cases quickly.  Office Directors are rewarded financially for resolving all cases quickly.  

In an effort to resolve cases quickly, office directors use many tactics.  One of the tactics is the placement of  barriers in the intake process, reasoning that if cases don't come in, there are fewer to resolve. These barriers are in the form of unanswered telephones, unreturned calls, or intake appointments scheduled weeks into the future.  There was a time when all offices allowed the public to walk in and file a complaint immediately.  If a person is lucky enough to secure an appointment, staff is encouraged to dissuade them from filing.  I will forever remember the middle-aged white male who came to the office complaining his discharge was due to his damaged nerves. The direction I received from my supervisor was to "get rid of him, as his nerves will heal".  The distraught look on the  man's face forever changed my approach.   

Office Directors reward employees who resolve cases quickly.  Dismissing cases quickly resolves the case. However, cases that have merit require time-consuming investigations, including scheduling on-site visits; tracking down, scheduling and interviewing witnesses for affidavits; or pouring through volumes of documents and writing lengthy reports.  Investigators who frequently find merit are denied promotion, placed on Performance Improvement Plans or discharged because they can't meet the production quota.

I know investigators who said they will only find merit in cases involving sexual harassment.  I know investigators who said they will only write up five (5) merit cases per year.  When asked what she would do if she had other merit cases in her caseload, she did not respond.  I know investigators who were told by the office director they could not identify every case of discrimination.  I know investigators who said they refused to write up any merit cases.  I know investigators who attempted to circumvent the merit restrictions by settling cases, just so the charging party could reap some reward, only to be told by management that this was not allowed. 

Some of the EEOC attorneys stated the agency existed only as a deterrant.  But, my experience has been the agency requires great overhaul.

I file with eeoc and the employer let go. I had work there for years; I was retaliated against every day. even after the employees wrote statements the employer scared the witness at work into not saying anything because they would be fired when I was let go I prove several count to eeoc and nothing happen because my case taker after 3 years of sitting the case on the shelf and several mistakes made abandon me even if I was one of the best workers I lost everything. Don’t go to eeoc just start your own business and treat your employees right and they will work harder.

Thank you for all of the inner workings of the EEOC. I assume you are an employee defending the EEOC. I am a consumer that has resorted to the EEOC only to have my cases dismissed as well. This is the easy way for the EEOC to handle their case loads. Yes, you get a letter after 18 months of nothing from the EEOC that you can now go and sue the employer. However, so much time has passed, finding witnesses through employee changes is nearly impossible.

Video tapes and evidence from the employer are mysteriously lost in this time frame and on top of all of that YOU now have to retain an attorney at 150.00 an hr. This just adds more insult to injury. If 70% or more cases are dismissed yearly then there are truly no consequences to the inflicting employer because most people cannot afford the attorney especially since they have been discriminated against and no longer have an income. This practice is rampant in Arizona.

I am happy you have a job, but you clearly do not see the waste that the EEOC produces. This is a spending cut that is needed to not only reduce the deficit in this country, but to shut down a bureaucracy that does not work, is always complaining that they are understaffed, under paid, over worked and cannot competently help those that truly need their help.

I am looking into filing a complaint about the EEOC but there is limited if any information on how to do that. You cannot get anyone to answer the phone, and if by miracle you do they are usually clueless and pass you on to someones voice mail that never calls back. This is just another broken system that the country should do away with since employers will always do what they want, and get away with it ,especially in a right to work state.

EEOC is corrupt.  If you research case law EEOC has several cases where the Court have found them failed and refused to investigate discrimination etc...

EEOC employees are paid very well like $55k-$65k per year and there is no excuse the can't investigate any case accurately.   They just don't want to perform their jobs and want you to play the role of the investigator.    Just think about it, their job titles are called Civil Rights Investigators NOT mediators.    I have a case with EEOC and since they were hit with a $2million dollar judgment for not performing their jobs you can tell they were told all employees who file charges will be immediately dismiss.    They told me the employer is allow to give them any evidence without being the truth.  Then when I demanded them to give me proof of their procedures showing clearly employers are allowed to do what they want within an investigation the next day they dismiss my case.  

If you represent yourself in the Courts even though you have evidence, its ashame but the Courts will ignore a Pro Se litigant and depends on what attorney you use if the Court knows the attorney is weak or not known they still will give you a hard time or dismiss your case.   I suggest that you contact your State and Federal Senators to monitor your case and even the US Attorney General, US Judicial Committee or the News media due EEOC will not take action against an employer especially a known employer.    And if they do normally 50-100 employees have came forward and filed a joint complaint.  So if your filing alone better chance your complaint with EEOC and the Courts will be dismiss altogether, even though you have evidence proving your complaint.  Its like they have to be in the mood to do their jobs.   

So overall, its best you study the laws and procedures of EEOC before you file a charge this way that investigator will know they can't just brush you off.    But the key thing is to obtain witnesses and other employees to file with you this will make a strong case.   GOOD LUCK

To Charles in Phenix City, confederate flag toting Alabama you seem to be calling the wrong person ignorant. First of all, just because a Black person fires someone white, does it really mean that the Black person has discriminated against the white person? I'm sure your only "proof" is a disgruntled white person who was fired by a Black supervisor/manager. There are probably no facts at your disposal regarding these issues you have been told about but you continue to cry reverse discrimination. I won't say that it does not happen but based on your comments and the fact that you constantly hinge your comments on Black people pushing you around or taking something away from you I believe the only issue here is race. Stop saying you are not a racist because you are. I will admit that people like you bring out an attitude of dislike for ignorant people like yourself in me but not for all white people in general. Just the ignorant ones like you who want to blame Black people for their problems. If Black people make this same argument, they have proof of racial profiling and racial discrimination of all sorts that has plagued the Black man for hundreds of years. If Black people really wanted to run this country and take control of it why can't they have that right? After all Black people built this nation to be what it is today. You really need to get a life and stop blaming the most underpriveleged people in this nation for your problems. Take some time to educate yourself about statistics such as rates of unemployment Blacks versus whites, substandard living conditions Black versus white. Maybe then you will see that studies show that Black people are still far below their white counterparts in both areas.

Its alright to stand up for your rights but have some facts to bring to the table so your comments don't seem to be so personalized (although I am sure that they are based on your continued arguments). Get on with your life by getting an education to better yourself so that you can compete with all the Blacks who are taking "your jobs". This is my last post because I am far too inteligent and you sir are beneath me in every way, shape or form so I will not even waste my time or my precious energy on you or your tirades (do you know what that means?). You could never compete against me even if you tried regardless of race or any other factors.

I watched that movie where a black principal that morgan freedom played Mr.Clark who was trying to clean up a dirty high school.  He told the black students don't blame the "WHITE MAN" that they was responsible for their own life and quit blaming everybody else. Mr.Clark was hard and rough on the black students he had to be cause they was lazy bums he had no mercy.

I wish their was more black people like Mr.Clark to tell black people its their choice how their life turned out,  & his  own black people hated him for it.  But black people today are to chicken to tell them like it is &  how Mr.Clark was rough on the black students.

Yes Charles in Phenix City you are very entertaining as Tim stated. The first thing you need to do is to stop blaming Black people for your inabilities and return to school so you can learn proper grammatical skills (you probably have no idea what I am saying). Racism against Blacks is nothing new and people like you in your little snug country towns in the south want it to remain that way but guess what Charles; today is a new day, Black people will not stand for substandard treatment and only small minded people like yourself choose to blame a population that is still well below the economic standards of their white counterparts for taking "your jobs". What do you really mean by your jobs? Do you think this is an entitlement because you are white? Blacks have just as much right as whites to assume any position that they qualify for. How many years did white people prevent Blacks from having certain jobs based on the color of their skin? Stop trying to act like reverse discrimination has helped Black people. If that were so then the Black community would not have such high rates of unemployment since employers would be hiring Blacks over whites merely because of their race. It was okay when whites did this for years and impacted the Black community but now you want to act like its wrong for someone else to do this to white people. Stop living in the past because the days of the bullfrog sitting in control on the lily patch are long gone and I will be glad when the small minded people like you are long gone too! Were it not for Black women, you would have starved because the breasts of a Black women nourished you. I am sure that a Black breast is what nourished your ancestors there in your sweet home Alabama, which allows you to live and breathe today. The world will be a much better place with people who are willing to be diverse and accepting to others who are different from them.

This information was given to my by Nancy Boyd then Deputy Director of the EEOC-NYDO and Nora Curtin Trial attorney/former regional attorney miami-EEOC. Ms. Silverman was a former staff member of the senate sub-committee that over-saw the EEOC. She currently is using her contacts to fix complaints and issues at the EEOC of Proskauer Rose law firm Washington DC. Assistant General Counsel for the EEOC James Lee is a sexual preditor who has sexually harassed many females at the EEOC over his tenure. This information was given to me by Lois Bramble legal clerk at the EEOC-NYDO. Luis Graziano Trial Attorney at EEOC-NYDO has taken money to fix decisions and conciliation at the EEOC. He's a close friend of Assistant General Counsel James Lee of EEOC-Hq's and is also on the take with Graziano. Nancy Boyd fixed decisions for Leslie Silverman at the EEOC. Nancy Boyd is also a close friend of and ex-subordenate of Enforcement Manager Electra Yourke of EEOC-NYDO who worked for Elleanor Holmes-Norton former head of EEOC and NY City Commission of human rights. Ms. Yourke is a racist bigot known by all in NYC and Washington DC. This information was given to me by Ricardo Cuevas Esq and admin judge at the EEOC-NYDO. Clyde Lo-chin Mediator EEOC-Tampa FL, received a bribe from Paul Salvator Esq for Proskauer Rose law firm representing Ralph Loren Polo and now working with former EEOC vice chair Leslie Silverman in Washington DC. Its not fair to categorically state that the EEOC favour blacks over whites when it comes to the way complaints are handled and processed.

I happen to be a victim of the EEOC poor, corrupt and calculated way of discrimination in the way they (eeoc) handled cases. I have filed three complaints that have been dismissed and in dismissing the complaints, eeoc dealt with issues that i didnt complain about. For example, I filed a complaint on sexual harassment, but eeoc dismissed my case with discrimination based on sex reasons. These are two distinct cases.

In my employment I saved American lives, innocent American lives despite the fact that I am not an American citizen but a legal resident (PR). My employers were deliberately infecting patients with super bugs such as MRSA & C.Diff etc as a way of ripping money from patients by prolonging their stay in hospital. Most of these patients where on MEDCAID or MEDICARE and my former employer was using these unsuspecting patients as cash cows to improve their corporate profits. Is this how you want your tax dollars to be used? We dont even know how many people needlessly died as a result of being
deliberately infected with these super bugs.

I spoke up against this practice and I was severely punished and discriminated against. Every single life is precious and NO ONE has the right to take it away and play God. I complained to eeoc and my employer terminated me in retaliation. I never injured any patients during the time of employment though my white co-workers did and went unpunished. As a non-American citizen I could have chosen to look away and could still have had my job today, but my job entails that I save lives, American or non American and thats what I did. The employer has also engaged in post employment retaliations and threats, giving negative reference to my prospective employers. I provided eeoc with enough and indisputable evidence, but the eeoc didnt find anything wrong with the employer.

From the dismissal letters and the notices of the right to sue that I have received, I could tell that no investigations whatsoever were done. The so called investigators just sit wait for a particular time to lapse and then dispense the dismissal letter and the notice of the right to sue.

I cant even find a lawyer to represent me in federal court. So many have expressed interest in my case but all demand retainers fees be paid up front. I cant afford the fees because I have been out of employment for two years now. I have filed Pro Se.

The EEOC is one institution that is so incompetent and extremely ineffective in fighting for the workers rights. If they are just there to issue the notices, the workers can as well just go straight to court.
What is the purpose of going to through an institution that will just add
misery to your situation? Cut it out!!

That being said, eeoc does not favour blacks over whites. I am a living example of eeoc
discrimination and I am not white.

By the way does anyone know where I can file a complaint against the eeoc? I would really appreciate that info.

The eeoc only work's for them & the pick only a few people to help & brush of all the other's, the eeoc is suppose to help all race's not just black's.

The employee's of the eeoc are only making a decent living for themselve's & not caring about us.

Why is it ok for black employer's to discriminate & for black co-worker's to harass & get white people introuble & get them fired.

Black people have been @ there job's for year's getting bounces & retiring but do white people get to do the same no!!!!!!!!!!.

I am not a racist

I am not a racist. I was reporting the injustice done buy my mother's former black employer 3 year's ago, the black employer hired to black people in my mother's place.

I made a report about this I get called a racist. The employer lied to the eeoc & the unemployment office the hearing officer twisted my mother's word's around to be in favor of the employer.

My mother did win unemployment benefit's but the employer answered there letter & the hearing officer ruled agaisnt my mother saying she had to pay back all the employment money. My mother then appealed it to hire court & for the last 4 year's she has heard nothing.

The people in the eeoc & the unemployment office are not treating people faily also the appeal's board people twist thing's around & make up thing's to rule agaisnt the employee.

I have no faith in the eeoc what so ever so these black's can discriminate keep there job's but white people can't keep there job's, my mother has talked to the black people she had worked with they had been working @ there job's over 20 year's.

They get bounces, promoted to hire position's but white people don't get to keep there job's this is discrimination. The appeal's board @ the unemployment office is not fair toward's people who have not done anything wrong to be fired so they make up thing's to rule agaisnt them.

You seem to know very well about how EEOC works. Your comments are very helpful to the readers. I want to thank you a lot.

But, you never mention anything about how EEOC decides to take the case for a law suite. What and why EEOC selects the case to pursuit the law suite? I know that EEOC is overload and short of staff to do the job. My experience with EEOC is, some officers lack of knowledge of people in different cultures. For example, they don't know how to spell race and nationality where the people are coming from. And, when EEOC files the charge, it makes the charge looks week. Do you think some of these officers really know the Title VII that they enforce? Do you think they really update and rea EEOC manuals? Do you think some of them really care about the job? Do you think some of them have any competency, integriy, honesty?

I think, that's why a lot of people have a negative impression with EEOC - incompetency.

From reading the posts, it does seem like you are too angry to read anybody's comments that may differ from your own personal opinion, so I won't be surprised if you don't read this. In your last post, you claim that black people are taking away jobs from white people. Saying this just makes you seem like you are just making this whole thing up becuase you are pissed and feel you are better qualified for whatever reason you may have. I don't know you and probably never will, so I don't know the whole story. Do some research yourself and figure out what rights you have in your state and then, and only then, will you know whether you are in the right or not. I don't know anything about the EEOC so I can't comment on how they run or what they do, that is up to you to find out what to do.

EEOC Corruption

This is a response to Tim of Valparaiso, Indiana on July 19,2007. I agree that ideally this is how the EEOC is supposed to run. But how does the EEOC react when you catch one of their employees in cahoots with your employer whom you've filed a complaint against in acts of fraud? The EEOC refused to reopen my case after a presented prima facie evidence of this fraud to them. I also was issued a right to sue letter, which I pursued in federal court. I also made a FOIA request to divulge this fraud in support of my federal case. The EEOC completely ignored the content of this request and pretended that I was only asking for my case files when I was asking for correspondences from all their offices and the defendants related to this EEOC case.

I finally was force to sue the EEOC individuals in federal court appealing for injunctive relief to get these correspondences. The federal courts also stonewalled me by literally reinventing these FOIA requests to dismiss this case. This corruption I've documented at my website and I'd be interested in what Tim or anyone else might say about it.

Charles claims that you should not listen to what I have to say and that I am, for some reason, a staunch defender of the EEOC.

Charles has it all wrong, and he has from the start. How do I know that I am right? Because I spent three years in law school with somehat of a focus on employment discrimination. I have written scholarly articles about employment discrimination cases and the procedure involved. I have been in practice for two years and have seen countless cases go through this process.

The EEOC process is what is referred to in legal circles as an "administrative remedy." It is an opportuunity to resolve a case, short of a trial, that must be taken advantage of before one can take an employment discrimination case to a federal court. There are many areas of the law in which such a paradigm exists. For example, if a prisoner wants to challenge the conditions of his confinement, he must first take advatage of the prison's internal grievance process before he can go to court. It's called "exhausting your administrative remedies."

The plain and simple truth is that the purpose of the EEOC is to weed out easy cases and to create a record of evidence to ease the burden placed on the courts. But the 7th Amendment to the U.S. Constitution guaruntees a right to trial by jury in most civil cases. So the EEOC can only decide on a case if there are no factual issues in dispute and one side or the other must win as a matter of law. This can only happen in cases where no reasonable jury could find the other way.

As you should be able to fathom, there are very few cases in which "no reasonable jury could find the other way." There are two sides to pretty much every story, and the EEOC can only render a decision if there is only one side to the story.

If you don't want to take my word for it, do some independent research. Find some reliable sources and look into the function and role of the EEOC. I know what I'm talking about, and I have a doctorate, scholarly writings, and employment experience to prove it. Charles has nothing more than his unfounded and uneducated guesses at how the system is supposed to work.

I am not a defender of the EEOC and, in my honest opinion, I think it's a waste of taxpayer dollars, precicely because very few cases are actually decided by the EEOC. But my opinion does not reflect the legal reality.

Unless and until you can show me some reliable sources that contradict ANYTHING I have said regarding the EEOC, all you have are your unfounded speculations and frustration. Show me the law that states that the EEOC is required to decide cases. Show me the statistics that show that the EEOC is discriminatory in any way. Then, and only then, can we have a real debate. At this point, however, I might as well be arguing with a bag of rocks.

He, just responded to my eeoc complaint to cause trouble only to harm me.

Tim, never tried to help me only to make my problem worse & try to ruin my

complaint anybody can say there anything, this is why I don't believe tim.

People, have lied saying who they are I don't know who tim is he is just somebody

who was sent to my eeoc complaint, to try to ruin my complaint. I, have made

my decision not to believe anything tim or who ever he is I have been lied to from

people my whole life, I do not trust anybody. I, guess people don't like it cause

I chose to speak out agaisnt the wrong doings from the eeoc I am considered a

racist cause I made a report agaisnt the eeoc & said things about racist black

people. Black, people are not going to take all the jobs from us, black people

need to quit living in the past, & quit blaming white people for there problems.

I, am not a racist I have a right to speak out just like how black people speak

out agaisnt us!. If, people don't like it that is there problem. People, can call me

Thank you, EEOC Corruption, for validating that I have presented the proper way in which the EEOC is supposed to operate. You unwittingly substantiated my numerous comments to Charles. However, unlike Charles or his mom, or whoever, you were smart enough to take advantage of your right to sue letter.

There is corruption at all levels of government, and I will check out your site to see if I have any comments on it. I can't say either way if what you say is true or not, but it is certainly plausible.

But let's get back to the point here: Charles is claiming that the EEOC discriminates against white people because, instead of rendering a decision in his mother's case, they issued the right to sue letter. That's a completely separate issue from the conflict-of-interest claim that you are alleging.

Charles, I only "attack" you (and I wouldn't even characterize it as that) because you have REPEATEDLY REFUSED to substantiate your claim. In fact, from the wording of your responses to me, it doesn't even look like you have read any of my rebuttals! You simply saw that I disagreed with you and went into animalistic defense mode, rather than taking the time to comprehend the LAW that I have CLEARLY set out for you on numerous occasions.

Bottom line, Charles, you don't know the law, I do. You present a statement alleging widespread discrimination, but you refuse to substantiate it.

I would say that you are insulting the intelligence of your fellow RoR readers, if it weren't for the fact that your ramblings are so d**n entertaining.

Much like Charles from Phenix City, this is another in a long line of "victims" of the EEOC.

The problem with these reports is that the poster's really have no idea about what the EEOC is and what it is intended to do.

And here's a good point to substantiate that charge: the EEOC does not really "dismiss" complaints. The EEOC does one of two things. The first is to decide in favor of the complaintant, in which case it can levy fines and penalties against the employer. The second is to close the file and issue the complaintant a "right to sue" letter.

The EEOC is an administrative agency. It is not a court. The purpose of the EEOC is to to "weed out" easy cases and to compile a record of evidence for cases that are too complex and must be decided by a court. Taking advantage of the EEOC complaint process is a prerequisite to filing an employment discrimination case in federal court. It is not intended to be the entirety of the process. It is merely a step in the process (in most cases).

So John, you now have your "right to sue" letter. This is your ticket to the federal courts, where your case may be decided by a jury of your peers as opposed to a body of appointed officials. The fact that the EEOC didn't decide on your case in no way means that you don't have a case. And I know it's hard to understand, but the EEOC's refusal to decide on your case does not amount to a decision, on their part, that you didn't have a case.

The only thing they decided was that your case could not be resolved in the administrative setting and must be decided in the courts. This is what the EEOC does most of the time, and it is actually what the EEOC is intended to do. And if you look at the statistics, you'll clearly see that the EEOC DOES NOT discriminate.

You can stop reading now if you like, but if you're interested in the process involved in an employment discrimination case, here it is:

1. The employee files a complaint with the EEOC and must make out a "prima facie" case of discrimination. This means that the employee must show that he/she was treated differently than other "similarly situated" employees who were of a different color/gender/religion etc. If the employee can't make out a prima facie case, the EEOC will not decide the case and will issue a right to sue letter. If the employee can make out a prima facie case, go to step 2.

2. The employer must then show a "legitimate, non-discriminatory" reason for taking the adverse action at issue. If the employer cannot do so, the EEOC will decide the case in favor of the employee. If the employer can do so, go to step 3.

3. The employee must show that the employer's proffered legitimate reason was merely a pretext for discrimination. This requires more of a "fact based" showing which, under the Constitution, allows for either side to demand a trial by jury. Thus, the EEOC may render a decision at this point, but it usually doesn't, and either side can invoke their right to a judicial trial if they don't agree with the EEOC's decision.

If the case does go to trial, the same inquiries will come into play: can the plaintiff make out a prima facie case of discrimination? If yes, the case goes on. If no, the employer wins. If the case goes on, the employer then puts forth his legitimate, non-discriminatory reason for taking the action at issue. If he can successfully do so, the case goes on. If he can't, the employee wins. If the case still proceeds, the employee must then prove that the employer's excuse is bogus. If he can do so, he wins. If he can't, he loses.

And that's employment discrimination case procedure in a nutshell.
