Elecsurf Ripoff selling defective item on line Internet

I purchases a Blackberry unit fr Elecsurf thru amazon.com, in the site, it says new then i received email that its refurbished to new . anyways, what else can I do, I wasnt too smart to find out. When I got the item, was totally defective. cannot be used. I told them maybe the battery. I gave my phone number and got no call fr them so I left a negative feedback and they started communicating with me right away asking me to remove the feedback and they will either send me a new battery(bec I told them it could be the battery) or send a return label. I didnt get either of them so I emailed them again and they told me I am responsible for returning back the item and they will only exchnage it when they got the item. But that was not what they promised. Unfortunately, i can no longer give another neg feedback after removal.
