EMC caused me to lose my home and made my credit score drop ,  when I first received my loan for my home, the payment was under $500 a month , the last payment I made was $719 a month.  I called EMC and told them that the payment was to high and they did not try to work anything out, EMC then foreclosed on the house and started sending me bills and letters. The Federal Trade Commission filled a law suite for unfair loan and collection practices.  EMC lost.  I have received 3 payments so far totaling less than $1600 but I still lost my house. I lost my house April 2006 they sold the house in 2007 to someone else, I found out today that EMC moved my foreclosure date to Dec 2009 .  How can they do this? EMC is very underhanded and has hurt many people. Something needs to be done!   Stop this Now.   I am now seeking legal help at this point.  Please do not have anything to do with this company,  It will end up badly for you.  I feel that EMC is one of the big reason that the housing industry is in the shape it is in now.  Sense  I had dealings with EMC I can not get a home loan. They have hurt me badly.

Before you speak to a lawyer make sure you have something you can take to him.  Like a Certified Forensic Mortgage Audit with which the results can create the complaint for him.  Then 90% of his work is done and you don't have to worry about him over charging you.  Endlessfrauddetection.com can provide just that.  The have a complete audit of the paper work done since it is a crime scene, CSI style.  If you have been removed from your house your damages could end up being treble damages. 

The best way to seek your remedy is with an audit.  An audit will stop any foreclosure proceeding. Now that you also have won a lawsuit that adds weight to your situation.  he audit will be state  and local municipality specific.  Once that is done a RESPA letter asking for more information will be created or a Letter to rescind.  The letter to rescind will return all monies paid in and start over.  Then you add the cost of violations and other legal/audit fees to the amount paid back to the home owner and see if they are greater than the cost of the home.  If so, they owe the home owner, if not you renegotiate the difference at a really low rate, say 1%, because by now they know you know how to catch their fraud and they will make sure the paper work is done right this time.

The litigation support paper work will provide him with all he needs to adjudicate your case. These audits are created by lawyer for lawyers and the judge will appreciate such a thorough job as will the lawyer.  You can have him work by the hour or on contingency which ever way you can work it out since nearly all the work is complete.  That paper work will include all the case law and laws violated.
