HAVE YOU FALLEN PREY TO MORTGAGE FRAUD?

LOOKOUT FOR THE SEVEN SIGNS:

1. Illegally recording timely payments as late, thereby imposing injurious late fees.

2. Improperly refusing to accept monthly mortgage payments, resulting in
default and adverse credit reporting.

3. Paying property taxes late, and then charging the late fees to the
borrower.

4. Charging force-placed insurance when the homeowner already has coverage.

5. Disregarding qualified written requests under RESPA and related homeowner
complaints.

6. Abusive treatment by customer service representatives and collection
attorneys.

7. Forcibly entering borrowers' homes to winterize or place foreclosure
signs on the premises.


While testimonies of the above are readily found on this site, I shall add my own personal list of offenses endured. Here is the sequence in chronological order:

1.This loan was originally closed with another mortgage company (call it XYZ) and sold shortly thereafter to EMC. Even with the flood and hazard amounts fully paid in full for the year, they attempted to (illegally) collect additional escrow.

2.I called customer service at XYZ, who completely disregarded my complaint. I then sent a Qualified Written Request to XYZ via signature-confirmed USPS priority mail

3.XYZ disregarded this request and has never replied to it.

4.I received a letter of transfer to EMC.

5.I wrote a letter to EMC and requested that they correct the excess and redundant escrow.. Also, the flood insurance I paid at closing was NOT sent to the insurer, even 2 months after closing. This demonstrated another breach of good faith.

6. EMC disregarded this letter; I subsequently sent them a Qualified Written Request.

7.A notice of receipt by EMC of the Qualified Written Request was sent to me; however they made it clear they were attempting to collect a debt!

8.EMC continued to completely disregard my communications and treat me like someone who welshed on a bet! After sustaining repeated harrassing and unwarranted collection calls, I sent a Cease and Desist Order. They disregarded this notice and continued to call and harrass anyway!

9. They completely disregarded my Qualified Written Request, continued to impose late charges, attempted to illegally collect escrow, and continued to illegally malign my credit report, all throughout each of my communications.

10. To date, 4 months later, they continue to
a. Disregard my written complaints
b. Malign my credit report
c. Illegally charge me late fees and penalties
d. Falsely claim my payments are being late, even though I have proof from my bank of the AUTOMATED ONLINE payment and clearing of these checks.
e. Harass me with collection-style tactics language and inflated invoices.

WE ASK THAT YOU JOIN US IN ABOLISHING THIS TYRANNICAL OPPRESSION AND ABUSE OF DECENT AMERICAN CITIZENS. THIS IS AMERICA. THESE OFFENSES EAT AT THE VERY ROOT OF OUR AMERICAN VALUES, VALUES WHICH OUR VERY OWN SOLDIERS ARE DYING FOR EVERY DAY.

What you can do to stop harassing calls?

I recently was switched to EMC from Wells Fargo Home Mortgage & we were also in forclosure but last minute temporarily saved my home. Until I can find other better lenders but what we do we don't even bother trying to send payments thru our bank we pay the extra money & send it Western Union.

I know it's an inconvenience but in the long run it's less headache. Plus I can not stress this. If you agree with them on something get it in writing plus keep several copies & always keep your receipts & for the person who has been paying these jokers on time & they still give you a bad credit rating keep all copies. Send every copy to the credit bureau & then on Annual Credit Report where you can get a free yearly credit report click on dispute have them mail the form or you can download the application on the internet. Then you mail the form back with the proof of payments & they will take it off the credit report.

I know they should be closed down as well as Wells Fargo Home Mortgage but a class action suit is great but all in reality is useless. My best suggestion is write your state Representative & Senator & show them proof you have how these bad Mortgage companies are frauding the voters of the state.

Here is something it's election yr & they tend to listen to you on election yr. Hope these suggestions help & don't worry if an employee from EMC is on here it's not gonna matter hill to beans. What they say because we all have freedom of speech.

Dom - T.John's, New Foundland- Canada seems like you work for EMC or at the very least are clearly defending them. You had said you don't have a mortgage with them and a friend of yours does. If that is true, then why would you be searching this web site for EMC Mortgage and why would you post at least two messages on the EMC section? I don't know anyone that searches to see if their friend's mortgage company is on here. Hmmmm, sounds like a EMC employee or friend to me. I could of course be wrong!

So, since you obliviously are here to defend EMC then can you please direct ALL of us that have continuously been ripped off by EMC to a person that will help us?

The reason EMC makes your payment show up late isn't because they don't want your money it is because they want ALL of your money. That little interest included in that one payment that they record late is nothing if they can make your mortgage look behind, make sure your credit is ruined so you can't refinance with anyone else to get away from them so that they can then foreclose on it, sell it and keep ALL the equity. See, $50,000 of equity is much better then $674 of interest, but I think you already know that.

I haven't posted my story on here yet but I will say it is VERY similar to what most of the people have posted on this web site. The good news for all of us is that I am not going to sit back any longer and put up with it.

I gave EMC ample time to make things right after I got an employee to tell me the truth and EMC still found a way to try and screw us. Instead, they attempted to take my house from me twice by creating a huge negative escrow when they bought the mortgage from another company, they tripled our mortgage payment (without explanation) thinking we would have no way to make such a high payment (opps they were wrong about that) which would then give them my house along with all of the equity I have in it, they destroyed my credit, they have charged us more money over 2 years in fake fees then I have had to pay out over the entire time we have had our mortgage and they are VERY mistaken to think they are going to get away with it.

It is time to not only get my money back and EVERYONE else's money on here back to where it rightfully belongs, but it is time to SHUT THEM DOWN and put the people that run EMC and Bear Stearns in PRISON where they belong. Oh and before I intend to make sure they are put in prison for doing this to people, I intend to make sure they are all flat broke from losing multiple lawsuits as well. Class Actions sound big and scary but if we all sue them independently they can't afford to defend them all like they could to defend one big class action. Since their goal is to take all of our money so that they can live in the biggest houses possible, I say we just let them live in the Big House- PRISON where their love can traded from person to person for a pack of cigarettes.

They may have many politicians paid off and they may even have many back door deals with the credit reporting agencies to help them. However, they don't know what it is like to have the national media breathing down their neck EVERYDAY. They haven't seen the power that Bill O'Reilly has when he puts his target on their back along with the backs of every politician and business partner that has let them slide. Those politicians will quickly be making deals to get the heat off of them and back where it belongs the people that run EMC. I guarantee that when certain politicians are being asked questions about their relationships with EMC and it's officers, or when other politicians are talking about nationally televised hearings on the subject of hard working American people losing their homes, credit, and equity to corporate thugs that are actually worse then the people that ran Enron and WorldCom into the ground things will change quickly

So, EMC since I know you pay attention to this little web site you better start to make sure you have enough ink to write and enough checks from the bank to write on and pay back what you have stolen because we are ALL coming for our money, credit and dignity. You can change office locations from Irving, TX to Lewisville, TX and you can hide behind employees giving out pretend names to customers, but you can't hide from all of us as we come together along with the NATIONAL media and investigate every single employee of your company inside and out. Oh and this time certain people in the federal government that are not getting enough money from you to go to jail for you are starting to sound more than willing to help!

Soon, I will post to ask everyone that has been screwed by EMC and their many partners to email me your contact information and your story so that we can finally put an end to these terrorists. Of course, no one will be obligated to do anything but I have had enough and I am just not able to sit on the sidelines to watch them continue to destroy the lives of so many people.

Collection Calls

Honestly, I can see how it is annoying, I know a couple of people who have mortgages with this company, And some have had a few problems with them, Payments being misapplied, Negative credit reporting due to it, Collection calls etc.. however although some corrections took longer then others it was corrected.

what I think of the first post, again this is personal opinion but here goes.

1. Illegally recording timely payments as late, thereby imposing injurious late fees.

- prove it got there on time, bank statements, receipts etc.
- Send it sooner, Not like the postal service is that reliable.

2. Improperly refusing to accept monthly mortgage payments, resulting in
default and adverse credit reporting.

- why would a company of any nature not want to take your money
- diff companies have diff policies on whats accepted and what's not, Find out what they are

3. Paying property taxes late, and then charging the late fees to the
borrower.

- Maybe it's happened to you, but when Emc paid my friends taxes late he wasn't charged anything.

4. Charging force-placed insurance when the homeowner already has coverage.

- he just sent in a copy of his dec page and it took around 2 wks or so but it was fixed

6. Abusive treatment by customer service representatives and collection
attorneys.

- don't really know what you mean by abusive

7. Forcibly entering borrowers' homes to winterize or place foreclosure
signs on the premises.

- no comment, hasn't happened to anyone I knw, But if your home is in foreclosure then they do have the right to go on the property, after all until it's paid off it's there house.

I was told that if "I would make my payment on time", they would not call me and that my loans were "delinquent". After getting the loan information from the agent, I found that these loans are still in the grace period. She wanted to know if I was going to make a payment today? I told her the payments were indeed mailed, the loans were in the still in the grace period, that they were not delinquent, thank you and hung up.. "

Although you are within your grace days, that doesn't mean you aren't delinquent, I know these calls are annoying but " grace days " are for one purpose only mainly and thats no late charges, If your mortgage is due on the first then it's due the first not 2nd or 3rd and they actually have the right to call you, although it's annoying it's fact.

I don't have a mortgage with this company so I'm only basing my opinion on friends who do, and dealing with the company for them. Other then that I don't know personally, However everyone I know who has a problem has had it fixed, although sometimes it takes longer then desired, like I say to my friends, Your not the only person with a mortgage.

EMC Mortgage - Horrible Customer Service

EMC left me three phone calls concerning one of my mortgages. Given that I have 32 mortgages with a variety of Mortgage lenders, I do not get to concerned at first.. But after the third call within two days, I thought I better call them today on 10/13/05.

Normally I find that if I approach Customer Service with a positive attitude they are very helpful. In this case after answering the same 30 questions over and over, I told them to please tell me which loan it is they were calling me about. From here it went downhill. I was told that if "I would make my payment on time", they would not call me and that my loans were "delinquent". After getting the loan information from the agent, I found that these loans are still in the grace period. She wanted to know if I was going to make a payment today? I told her the payments were indeed mailed, the loans were in the still in the grace period, that they were not delinquent, thank you and hung up..

I do have a few mortgage lenders who call me with a 'courtesy call' within the grace period. No problem.. They call me once, leave a message to bring it to my attention. great...

CLASS ACTION LAWSUIT

Please search google for James Hoyer and join their class action lawsuit. My complaint: HARASSMENT. My mortgage isn't due until the 1st of each month. According to my statement I have until the 15th of the month to pay before incurring any late fees. Well, would you beleive that EMC starts its collection callls sometimes as early as the 2nd of the month! They call 5 -6 times a day despite telling them that payment has already been sent. THIS HARRASSMENT MUST STOP!
