I was informed on Sept 18th, 2007 by a customer service representative that the payment made for July was not accepted / returned, It was supposedly returned over a month later. I made this payment on August 11th 2007 via western union speed pay as per thier website and my bank account was debited in the amount of $1,338.12 on August 14th, 2007. While speaking to this customer service rep I informed her that MY bank account did not show any returns of payment and that the payment was indeed taken from my account.

After speaking to the representative, I promptly faxed over copies of my last 2 months bank statements to EMC's research department. I even spoke with my bank prior to sending EMC my bank statements to ensure that nothing had been returned to my account in the past 2 months. I also have letters from my Bank that say no transaction to EMC had been returned only debited as of Sept 24th 2007.

When I called for an update on the status of the "research" on Sept 24th 2007, I was informed that it could take 30 days or longer for a resolution. This is unreasonable to me because now this vanishing payment is going to start affecting my credit score in a negative way. EMC HAS my money and they are treating this situation very poorly in my opinion. I have called them numerous times, sent letters, faxed, emailed EVERYTHING and now I am faced with negative credit reporting because of their pirate techniques. I doubt I will ever be able to refinance now because of this issue and that seems to be the goal they have in mind when it comes to all these dissapearing payments I keep reading about.

If this matter is not resolved within a reasonable amount of time I have the right under the fair credit laws to take appropriate legal action. I will also turn this matter over to the BBB the Texas Attorney General and any other company that will hear my story. If I do not hear anything back by October 1st 2007 I will be utilizing the resources available to me to push this further. I cannot believe that I have TONS of the proof that they need to show they got their money for the month of July and it is going to be this much of a hassle.

EMC has helped resolve the issue

It took a little while but I was contacted by an executive member this past week. I would mention her name but I dont know if I am allowed to. She has turned things around for us and has been a HUGE help. We figured out where this missing payment came from and she came up with a solution that my husband and I are both very satisfied with. She has waived all late fees and charges that were adding up since Sept. She is also willing to rework our loan for us come March of 2008 because our fixed rate is due to adjust to an ARM then. I am actually very satisifed with how this situation turned around. The executive has really turned my opinion of EMC around. I wish to apologize to the company for being so harsh in the beginning of this whole mess.

And for those that have been having problems with EMC my suggestion is to keep writing letters and be persistant. If they can find a way to fix the problem they take a little while to fix it in some cases, but it does get fixed.
Also when writing letters find a way to get to the top.

EMC/Bear Stearns did the *same* thing to me. Greg Fedler of BSC (Bear Stearns Corporation) just simply flat out lied. He told me, "As you know, your money has already been refunded." (Paraphrased) There ARE things we can do however. I'm going to specialized crime with a report on Greg Fedler and to the Texas AG re EMC & BSC. I have already contacted the US DOJ and joined a class action lawsuit. This will be a long in depth investigation but those who care about justice will be rewarded in the end. Thanks for your excellent post Legend!
