On or about October 11 and 12, 2017 I met with a salesperson who identified himself as “Rob” at Endless Auto’s place of business on US1 in Cocoa, FL. I was inquiring about a vehicle that was advertised in the Letgo online marketplace. I was shown several vehicles, then accepted an offer to test drive the 2005 Toyota. The salesperson pointed out the car’s highlights, including the relatively low mileage of approximately 109,000 miles, as well as the fact that the roof of the convertible did not leak. It was a fairly sunny day, so I had no way to check whether that was true. On multiple occasions, I remarked about the mileage on the car, and at no time did anyone at the dealership make any statements to contradict their assertion that there were around 109,000 miles on the car.

On October 24, 2017 I was driving around town when it started raining. Within minutes, rain began pouring into the cabin of the vehicle from the roof’s edges and rear window area. I immediately contacted the dealer via the Letgo app and was told “It never leaked on me I drove it in the rain” and, once I informed them that I wanted to return the vehicle, “gonna cost money to cancel the deal and start a new one. But i will work with you,” “come in if you want.” I drove to the dealership that afternoon, showed them the water in the car, pointed out that it would have been obvious that the roof leaked because of the water marks present. First, I was accused of causing the damage to the roof. When I pointed out that the leaks were the result of wear and age and not something done in the span of 10 days, I was told that the car was sold “as-is” and they “couldn’t touch it.” When I pointed out that the “as-is” condition does not apply when a dealer makes fraudulent claims, the manager or owner (I’m not sure what he was) acted offended and refused to discuss the matter further until the following day.

That evening, I purchased a CARFAX report for the vehicle and discovered that the dealership purchased the vehicle at auction on 7th September 2017 and had the car titled on 22 September 2017, stating that the mileage was 203,623 - a difference of nearly 100,000 miles than what the car’s odometer read, and what the dealer represented to be the actual mileage. The dealer attempted to hide this information by entering “EXEMPT” in the mileage box on the sales contract. Apparently, the dealer is unaware that entering “EXEMPT” on a sales contract does not exempt him from Florida and Federal laws.

On 25th October, 2017, I delivered a statement of demands to resolve the issue. I was derided and yelled at by the "manager" and staff. They told me they would repossess the vehicle and "couldn't wait to see my face" when they did so. They also used verbal slurs and engaged in bullying. I look forward to watching them get arrested by FHP for odometer fraud, which is also a Federal crime, with each count worth up to 7 years in prison. They really don't know who they've ripped off this time, but they will.

 I am willing to help you take them to court I purchased an 08 impala paid of 90 days same as cash now they are saying I owe 15,000 for tax tag and title and finance fees and I didn’t finance the car

Odometer fraud

 Please contact me.... I bought the same car from them 2005 Toyota solara. I just ran a car fax and it said 209000 miles where my odometer reading says 110000.. were you able to get your money back?
