Entertainment Publications, Consitta Russo Bought Tickets via ticket master and some how in the processing my credit card info was provided to Entertainment Publication Inc. where I was then subscribed to a monthy coupon program charging $9/ Month. I notice the charge made immediately and contacted Entertainment Publications where employees were extremely egocentric and at every angle reminded me that this is my fault. Ripoff Troy Michigan

Today, 6/18/05, checked the status of my debit account and notice an unauthorized charge to my account made 6/17/05. Thankfully, an 866 number was provided and I called the company to see who they were and what they were charging me for. Imediately, the lady asked me for personal info, which I would not provide until she described the company.

Basically, she then told me they charge via ticket master and that I must have signed up for their program otherwise they would not charge me. Completely outraged, I told her that was insane and I wanted this terminated and my account credited. She said she would stop the program, but she cannot provide a refund due to company policy. I told her I didn't care and wanted to speak with a supervisor. She said wait a minute I need to finish telling you about our program. After shouting at her because she proceeded to tell me about the program, she finally got a supervisor on the phone. Up front, I asked her name and the companies corporate address, in order to file an official complaint, which she wouldn't give me straight away. She was nasty and said let me walk you through how you enrolled and proceeded to inform me that I clicked on buttons online in order to enroll in their program and she had the proof in front of her and there was no way they would credit my account. I told her I didn't give a crap, I just wanted her info and the corporate office address. She kept blaming me and informing me that this was my mistake, etc. Until finally she gave me the info. I had to keep yelling at her for the contact information to get her to stop telling me this was my fault and mistake and that they had a right to charge me and would not give me money back.

After a long battle, I did a search and came across your website and hope this fuels the fire against these people. Not only have they lost business in regard to their monthly program, but I am going to spread the news that this is the same company as the Entertainment book. This company has completely unethical tactics and it makes me sick that Ticketmaster allows this to happen when ordering concert tickets.

I do not intend for this rebuttal to be long winded, however, I do feel that since no one has attempted to show the Federal Law for Electronic Signatures, this should be made known. After all, one can only claim ignorance for so long in this world. Feel free to visit http://www.law.upenn.edu/bll/ulc/fnact99/1990s/ueta99.htm to ensure that I have given you the correct information pertaining to this subject, since the few angry consumers on this website seem to think all of us are such "liars, scammers, thieves, crooks, and frauds" and especially since, "we should be shot and killed".
"Electronic signature."def.(You know, the meaning of the word?)

The idea of a signature is broad and not specifically defined. Whether any particular record is "signed" is a question of fact. Proof of that fact must be made under other applicable law. This Act simply assures that the signature may be accomplished through electronic means. No specific technology need be used in order to create a valid signature. One's voice on an answering machine may suffice if the requisite intention is present. Similarly, including one's name as part of an electronic mail communication also may suffice, as may the firm name on a facsimile. It also may be shown that the requisite intent was not present and accordingly the symbol, sound or process did not amount to a signature. One may use a digital signature with the requisite intention, or one may use the private key solely as an access device with no intention to sign, or otherwise accomplish a legally binding act. In any case the critical element is the intention to execute or adopt the sound or symbol or process for the purpose of signing the related record.
SECTION 5. USE OF ELECTRONIC RECORDS AND ELECTRONIC SIGNATURES; VARIATION BY AGREEMENT.

The Legalities:(I hope this helps you, but don't worry, I will include the quick recap in Lamen's Terms for you too)

(a) This [Act] does not require a record or signature to be created, generated, sent, communicated, received, stored, or otherwise processed or used by electronic means or in electronic form.

(b) This [Act] applies only to transactions between parties each of which has agreed to conduct transactions by electronic means. Whether the parties agree to conduct a transaction by electronic means is determined from the context and surrounding circumstances, including the parties' conduct.

(c) A party that agrees to conduct a transaction by electronic means may refuse to conduct other transactions by electronic means. The right granted by this subsection may not be waived by agreement.

(d) Except as otherwise provided in this [Act], the effect of any of its provisions may be varied by agreement. The presence in certain provisions of this [Act] of the words "unless otherwise agreed", or words of similar import, does not imply that the effect of other provisions may not be varied by agreement.

(e) Whether an electronic record or electronic signature has legal consequences is determined by this [Act] and other applicable law.

1. This section makes clear that this Act is intended to facilitate the use of electronic means, but does not require the use of electronic records and signatures. This fundamental principle is set forth in subsection (a) and elaborated by subsections (b) and (c), which require an intention to conduct transactions electronically and preserve the right of a party to refuse to use electronics in any subsequent transaction.

So, as you can now see for yourselves, if you have even chosen to continue educating yourselves, this process is legal. We have people on a daily basis placing cancellation calls to our company WITHIN the 30-day free trial. (oh, yeah, they DID recieve all three"3" emails) And I would like to advise as well, that Miss Russo is a living, breathing human being with feelings, and that by admitting that you screamed at her and were rude on top of everything else, that just goes to show how parents are raising their children in the last few generations. I know I will raise my child with more respect for human life and privace than this person has. If you would just get over the fact that you did not read what was clearly in front of your face, then you would have seen just how nice Miss Russo really is. Oh, and by the way, I also did manage to retrieve the information for Yahoo's personal security settings, which, for you who have email accounts through Yahoo, will be more than able to verify.

One more word of advise, please do not list our personal information if you have not taken the time to get to know us. We are able to file a law suit, and the information you provided to this site when registering is able to be sopeanad for a court of law. Next time, the agent may not show you the courtesy that Miss Russo did, as we know there was no courtesy involved on your part. Thank you sincerely.
