In June of 2005, I filed 2 charges of Discrimination against my employer, located at the St. Anthony Hospital located in Denver Colorado. These charges were based on National Orgin and Disability. On March 22, 2006 I recieved a letter from the EEOC stating that St. Anthony Hospital the Respondent denies it discriminated against me because of my national orgin Hispanic, or my Disability Epilepsy.

The closing of this letter also stated that if I had any additional evidence and/or information that I wisded the EEOC to consider that I was to provide it in writing within seven (7)days upon receipt of this letter or by March 14, 2006. If they did not hear from me by this due date, my case would be closed! Again please note that I did not recieved this letter until March 22, 2006.

On March 22, 2006 upon receipt of this letter I called the office of the EEOC and found out some very disturbing information, (My case had been CLOSED!) It was at this time that I had spoken to Ms. Scaramella, she suggested that I submitt a Rebuttal any way and she would see what she could do.

On March 24, 2006 I sent a six page rebuttal, and pages of proff of evidence against my former employer. On April 26, 2006 I recieved a phone call from Ms. Scaramella stating that there is nothing further that she could do on my behalf and that my case would remain CLOSED!

As the Business Office Supervisor of ONE year, in the Family Medicine Residency Program, I was mentally, verbally and phyically abused and I want JUSTICE! You see in July, I was noticed for tripling our revenue and creating a billing package to educate our physicians and staff.

Then on July 14, 2004 Ms. Trotter the Centura Health Auditor approached me, she wanted me to know that she was so impressed with the creation of my billing package and the increase in revenue over the last six months that she had nominated my department for Best Practice.

This was not the only recognition that I had recieved, prior to the Best Practice I recieved several complment SHARE cards and my picture and story in the CONNECTIONS news letter of the hospital.

On August 11, 2004, early morning I began to feel that the stress levels were too high. I started having seizures, and at 1:00 pm, my staff member Mr. Rigdon rushed me to the emergency room. I called Mr. Rigdon that evening around 6:30 p.m., letting him know that I was not doing to well and that the doctor had advised me to stay home the next day.

I asked Mr. Rigdon to let Ms. Baker and the department staff know. I also told James Rigdon that I would call him and Ms. Baker in the morning. The next morning, as I was coming too, my telephone rang. It was Ms. Baker, and rather than her say Diana, How are you? or Are you ok? She hollered out at me, Diana Where are you?' and Why haven't you Called?

The next thing I knew was that on August 12, 2004 I was being written up for not communicating. I, never gave up hope, I knew that by being awarded Best Practice would be gratifying enough, that all of the pain would disappear. I was wrong!

In November, 2004, the Best Practice had been approved; I knew that something had to get better. I was then asked by the Mr. Zara CEO to come to his office to discuss the work I had done, in such a short time. I had explained to George that I was having a very hard time with Ms.Baker and he had stated at that time that there was another position that he was looking into for me.

This position was in the Finance Department, he then asked me if I could just hold on until there was a position opened, I replied with a yes. I promised Mr. Zara, CEO that I would continue to have patience of waiting for the new opening along with trying my best to completely ignore Ms. Baker.

What I did not undestand was why the administrator, Ms. Baker went out of her way to find things that she could use against me to try and get me fired. It was then that I relized that being the only Hispanic Business Office Manager in this program, Ms. Carrie Baker, who was not Hispanic did not want me to recieve the recognition of Best Practice! The recognition that I deserved!

As December passed, still nothing had opened up for me. I could not handle any more of Ms. Baker! This time Ms. Baker stated that there was a complaint against me for inappropriate behavior against another (Hispanic) employee. This time I new that someone or somebody was making this up, being a Hispanic woman, I truly believe in justice for all!

It was obvious that Ms. Baker wanted me out of my department. She began to threaten me, by taking my title. She stated that I was not in the budget! I knew that that was untrue! In 12/04, we were $27,000.00 shy of billing out $1,000,000.00 (One Million Dollars.} Another first time ever for me in the St. Anthony Family Residency Program, along with the comment from Dr. Miller, You know Diana, their going to name a building after you. I replied, That's ok Dr., they can just change the Kuhlman Building to the Madrid Building!

After having such a great year, I was a bit confused when I did not receive a company promised 3 percent raise, I only received 2 percent. This information will can be found in the Human Resources Department, which is located on the first floor of the Kuhlman Building of the hospital.

I believe that I have a solid case against Ms. Baker, clearly you can see I was not insubordinate nor did I have any reason to quite my job! I am a single parent of three children, who is attending Regis University, in the BS in Health Care Administration. I was very proud of my 25 years of experience and my education, due to the facts that upon completion of my BSHCA I will have obtained my third undergraduate degree.

I am requesting that my case be reopened, due to the facts that I have been served a GREAT INJUSTICE! Not only do I have complete documentation of this entire ordeal, I have not even begun to express my pain. You see in September of 2004, I lost my son to a life sentence, and in November of that same year, my son-in-law suffer an explosive car accident and was burned from the neck up.

I refused to give up and my job was my only strength. Ms. Baker knew every detail of my epilepsy and my family situation and I believe that she knew that the only way she could get me out of my position was by continued mental abuse! Ms. Baker knew that emotionally I would break! How could Ms. Baker be so cruel to me, after all I was a human being?

What I do know is that this woman FORCEFULLY put her hands on me as I was trying to leave my office, and security was called. I want justice served! Was it not apparent to the US EEOC that Ms. Baker had become very threatened by the success that I had obtained being in my position for such a very short time! So once again, when you ask yourself, Was the treatment by Ms. Baker, DISABILITY DISCRIMINATION?

I truly believe that once you look up the meaning of the word DISABILITY DISCRIMINATION, your answer should be YES!

Please note: I have original copies of all of our department communications and company recognitions, along with letters from my neurologist, who has recorded that my condition was work related.

Also, please note that I have a letter from my family physician, who at the time was a staff member of the St. Anthony Family Residency Program, in this letter you will see TRUTH to the unjust treatment displayed by Ms. Baker which was noticed by this member of the staff.

I have had to deal with a great amount of silent pain because of this woman and I promised myself that I would never treat another human being the way Ms. Baker had treated me!

At St. Anthony Hospital, their slogan states, Here we treat you as a PERSON FIRST! Clearly, you can see that by MENTALY and PHYSICALLY ABUSING me, Ms. Baker does NOT fall within this statement.

I hope that after reading my story and carefully taking my case apart piece by piece, you will find that JUSTICE needs to be served and the EEOC must reopen my case so that St. Anthony Hospital is justly charged.
