Exclusive Market US Company failed to pay me for work performed as instructed. Internet
I found a work-from-home job on Indeed.com for telemarketing work at a company called Exclusive Market U.S., a company that telemarkets to consumers to generate leads for insurance agents. The ad included a phone number and the contact name of "Casey." I called and spoke to Casey on Thursday, March 23, 2017. He told there was no need to send a resume and that I could begin work on Monday, 3/27. He explained that telemarketers who worked for Exclusive could either be paid minimum wage ($8.00 per hour) for an 8-hour day, or be paid $4.00 per lead, which would be determined by how well the agent did after the trial period of a few days. There was a fee of $7.00 a day that would be deducted from the cash payment earned for the use of the company dialer, which agents accessed from their home computer. Additionally, there was a quota of 2 leads per hour that was required to keep the position. Casey said the work was easy and being paid by the lead would allow me to make the $500 dollars a week I was hoping for. I wanted to begin working right away and asked if I could begin Friday, 3/24, which I was allowed to do. I would begin work daily at 9a.m. and expect to work Monday through Friday until 6p.m., with the standard half hour for lunch and two breaks. I was told we would be paid on Wednesdays by electronic deposit through Paypal, Google Wallet, or Square Cash. I have yet to be paid for work done on 3/24, 3/27-3/31.
From the beginning, it seemed odd that there was no work contract for 1099 workers to sign, but the work seemed like it would be steady and the owners, Casey and Maelynn, and managers, Mary and Tim. seemed like likable, honest people who promised there was growth potential for good workers. Our contacts were made over Skype. The first day I worked a full day and made quota easily. I was told I did well.
Work went fine on Monday, 3/27. but by Tuesday, we were told the company had gotten all the leads they needed for the day by about 3pm, and this remained the case for the rest of the week. I became concerned that not only would I not ever make $500 a week, but after speaking with Maelynn, I learned that the earning potential with Exclusive was only about $300 a week, at best. It continued to remain unclear whether I would be paid by the hour or by the lead, though I was assured my work was more than satisfactory. I was told at some point by Maelynn that I had been misinformed and that we were to be paid on Fridays, rather than Wednesdays.
On Monday, April 3rd when I attempted to log into the dialer to begin work, I was unable to do so. I was told by Mary that the dialer was down and to take the day off. Tuesday, I was told by Mary I would need to speak with Casey. I called Casey and he told me the dialer had "locked me out" and they didn't know why. He assured me that everything was okay and as soon as their investigation was complete, I would be able to resume work. After this, Casey was no longer available and I began communication with Maelynn, who also assured me I would be paid. By April 14th I still hadn't been paid, but I did discover Exclusive had calculated by work to be valued at $200.00, but I have no idea who that figure was attained.
I sent invoices for the sum of $200.00 through Square Invoice, Google Wallet, and Paypal and was told by Casey that he didn't receive any of them. I requested that EM mail me a check. My last Skype communication was on April 28 when I provided Casey my mailing address and still, I have not been paid.
