Expedia is guilty of this and claiming that you not wanting to be involved in a conversation is dishonesty (withholding information) this is not for them to decide. Lets take back some of the power. Subject: "At Will Employment" Hi, A text message can be used to fire you even if it was sent off property and outside of working hours. Without warning as long as they can assume they know what a conversation is about. We need a standard here, warnings and full review of situations before an employer can fire. A rebuttal system for human resources. That's why I created a petition to The Missouri State House, The Missouri State Senate, Governor Jay Nixon, and The United States House of Representatives, which says: "Stop employers from firing employees without warning or just cause. If there was not a text sent in the building and during work hours it cannot be held against you.

- Where did you pick up that little gem of misinformation?  Did you just make it up?  Well sorry but that doesn't make it so.

You throw around a lot of misdirection, smoke and mirrors, and unrelated "hot button" terms in order to try and make your case more convincing...but failed.

But you have also failed to answer what was said in the text that got you fired.  Yes, you "dance" around it quicker than a tap dancer on hot coals saying this is a case of you not wanting to get involved.  Well guess what...if you have text messages on your phone and sent text messages you are involved.

Before you talk about the Bill of Rights and "Freedom of Speech" perhaps you should actually read the Bill of Rights.  You will find that the Bill of Rights deals with GOVERNMENT and not private businesses or indivduals.  So yes, a company has every right to request certain things.

The fact is that you are trying to play "word games", and they have you beat at every turn.  You gambled and lost.

Expedia's handbook says that phones are not permitted on site as this is a rule how is it that Human Resources can request to see your text messages? Is there no personal and work separation?

- You are not bringing it to your workplace to use, it was requested by HR..you are NOT going to get fired for that. 

This is not dishonesty this is withholding information as my right was that I was not interested in being involved.

- Again you are involved.    In many cases not coming forward with information is the exact same thing as lying and dishonesty.  Especially when in your case you use the term "cover up" what someone else was doing.  You want an extreme example.  Okay...if you were a Teacher, Nurse, Doctor...and had information that a child you know is being abused.  If you fail to provide that information to the approprite agency YOU could not only be arrested and jailed but have your license suspended.

In the end you have failed to provide what was in the text, to Expedia and as such you have to accept the consequences of your actions.

Texting is not grounds for firing

If there was not a text sent in the building and during work hours it cannot be held against you. Also the problem with this is that there are easy ways to edit texts from one phone, you are able to delete chunks of conversation. There are applications available to text from any number you would like. 

Lastly there is that if there are not any factual proof i.e. a text history report (which has to be requested with a court order) then how do you assume without being present for the conversation that you are able to tell what is actually being discussed. I have a phone log that shows there is a break in the text messages for a 38 minute phone call. Then back to texting but not about the same thing, however, if just an outsider reading the conversation you can assume what you want.

Also that would lead me to believe that by working for a company you have essentially signed your right to privacy and freedom of speech away. 

Is Expedia allowed to veto your bill of rights and then fire you for saying things in a personal conversation and request a cell phone when that is clearly against their own rules? Where is the line drawn? Then when stating in the office very clearly without any hesitation that " I am not interested in being involved in this" tell me I have to be. Therefore after this was stated it was my right was taken away and I answered everything following with no and I don’t know. 

This is not dishonesty this is withholding information as my right was that I was not interested in being involved. This is a case of a person covering up for a higher up when there are actual past incidents to which this person was fired for the same issue. 

How often does a human resource agent ask you if you have a recording device? Then state it’s illegal to record this conversation?

Even though your report goes out of the way to not post any details.  It is fairly obvious that you were fired(or perhaps a friend of yours was fired) for a text message that either involved the company or a fellow employee.

You also somehow seem to think that this is Las Vegas, in that what happens after work..stays after work.  Where you have found out that is not true.  Again, not knowing the reason..many companies have social media policies that forbid employees from "bad mouthing" the company or any employees "on" or "off" the clock.  If you did something that is considered harrassment, such as constantly asking someone else out or threatining to beat them up. Again that is a liability and something a company is not going to risk.

Now, in further reading of your report you appear to say that the person who reported you only showed 1 part of the story and there is a whole other part that was taken out of context.  So exactly what did your text say?

Oh and as for your petition...Sorry I won't be signing it.  Well let me ammend that.  If you actually come back and post the truth as to why you were fired, not that you agree or disagree but the situation that caused them to fire you I may actually sign your petition if it was really unfair.
