They are nothing but a ripoff. they have done nothing but tried to take my house for two years now and they have finally won because I have given up.they lose your payments so you have no proof that you even send them in so they say you dont make payments you have to go to court.they sent me back money telling me my loan is paid off twice once for 1,380.00.they said i had a second mortgage with them which i never had so forth and so onI have to go to court the 17 because they are trying to collect money that was paid through chapter 13 but attorneys dont want to listen or either they are in with them.anyway i almost had a breakdown because i have been going through this for two years now i gave up they can have my house if they need it that bad im tired of it i work to support my kids im not on aid i get no help from dad hope i dont get thrown out befor christmas that would be nice christmas present for kids but i have not made payment since june because they sent my payment back saying i was in default because they keep losing my payments and sending them back to me

Still not getting help . I am begining to think gov judges and more are in with them.

I am begining to think gov judges and more are in with them. Know one seems to care that these monsters are stealing our homes If we were stealing anything we would be put behind bars so we could not keep stealing I have written every one I know of They say they put my complaint on file But I still have to go to court every month so I can file more papers at the court house that you have to pay to file.

I have never seen anything like these people before.They say the ones that are not in forclosure is the ones that will get a very small part of the settlement But I havent heard anything about the ones that are still fighting for there homes or that have already lost there home I think the only way we will ever get justice is for every one of us to meet with someone at the same time If anyone knows where Tell me when and where and I will gladly be there I cant take much more this has really put a lot of stress in my life Not like theres not enough already

Still looking for attorney to take my case,Does anyone know how to find out if they are licensed in the state of Illinois I would like to find out for sure, please let ripoff report know if you are.

Bankruptcy differences, A Chapter 7 is the WORST financial route and will prevent you from getting decent mortgage rates

I want to clarify the previous posters comments in regard to Chapter 7 vs Chapter 13 bankruptcy.

Firstly, any creditor will NOT view a Chapter 7 more favorably because you have no debt left to pay! A Chapter 7 is the WORST financial route and will prevent you from getting decent mortgage rates for 2 years sometimes longer.

A Chapter 13 shows creditors that you are *trying* to do your best to repay what you can.

A LOT of your debt is forgiven in a Chapter 13 - ALL or most of your revolving (credit card) debt will be forgiven. Most Chapter 13 filers will re-affirm their homes and/or cars. All the other debts secured by TVs or whatever can be returned or offered back to the specific lender (and most won't even attempt to get the merchandise back).

Each form of bankruptcy has its place. If you are able to do so and can repay some of your debt go with a Chapter 13. If you are in too deep then research your options with a Chapter 7.

Finally, if you start with a Chapter 13, it is possible to convert to a Chapter 7 if you are still unable to pay your bills.

fairbanks is in bad shape. pam just go on and do the best you can until you get some money from them thiefs

pam read your report on what you are going through and no one should be going through this,
night mare with fairbanks ,i,m also a victum and had to go bankrupt because of them had no choice

but i went chapter7 and oue nothing not even the house.i just gave it back i oued to much, the house was apprised at 79,000 and oued 73,000 and the lawyer said to just give it back.i would not give them no more money i already gave them 7,000

in sep.of 2002 and that was from my husband 401k
and in dec. of that same yr.they wanted more money like 2000.00 for some escrow that was,nt included in the 7000.oo so i told my lawyer about it and he called there lawyer and there lawyer wanted to get me for another 6000.00 with another reinstatment and i said no i well not give them no more money.but i see that you went chapter 13
that makes you still liable to this 13 chapter and still oue ,you promised to pay but they well get you anyhow just like all the others fairbanks
broke there agreement on that forbearance to lots
of other people so really your right back from the start and what there doing is that there milking you for more money and there is no end to it,but again cause you went chp.13 you might beable to get in the class action because they cheated and stole from you and that looks good on your side, the ftc well see this.

fairbanks is in bad shape. pam just go on and do the best you can until you get some money from them thiefs i well incourge you .i well give you this no. to call so you can get in to the class action lawsuit it,s1-877-862-0886 get your no. loan ready when you call cause they are going to need it and just sit back and wait for the letter to come to you and fill it out and send it back to the federal trade commition.

and i meant to say the reason your having trouble with faifbanks is because you went chp.13 and they can still come back to you for unpaid payments we didn,t want to go that way because if my husband missed one payment on his truck the bank can come back to him and sue him for none payment and lose his truck and still pay
what he oued thats the reafermation agreement.

pam, if this is you again you well get a settlement if you went bankrupt because they made you go to this ordeal and pressed it they forced
you to go bankrupt,but if this is the right pam i,m writing to that went chapter 13 this chapter13
is different this means that you agreed to make payments wish is a promisesory agreement on your mortgage to pay all payments on time and if you fail you well lose anyhow.

you should of gone chapter 7 this means that all bills are in the bankrupt and you oue nothing you are debt free and throw your house in all so and they can,t come back to you because of it, but it,s to late you went chapter 13 and because of it they fairbanks can sue you cause you did not keep your side of the bargain this is called refermation agreement meaning that you still oue and you are still in debt

i,m surprised that your attorney did not tell you the difference. it was hard for me at first because i had to make up my mined wish way i was going,was i going 13 or 7 but i read about it under bankruptcy in the net what is the difference between the both.

and the good thing about it is that loan servicers well look at, is that you are debt free under chapter7 but still oueing on chapter13 and still in debt because you promised to pay.

but maybe you can talk to your attorney about this to see if you can still get any money back on the class law suit even if you went chapter 13 because this is really sticky, but don,t be descourged cause you still went bankrupt to try and safe your home and maybe the ftc well look at this the ferderal trade commition cause we all went bankrupt cause of fairbanks.

if this is you pam from ill. the same pam that wrote in 1-18 2004 and then in 1-26-2004 call fct settlement hot line at 1-877-862-0886 but find out first from your attorney if you can still file a class action lawsuit this is one on him to answer and if he says yes go for it good luck.

THEY ARE STILL AT IT

These people just wont give up and there is nothing being done to help us . I have been in court 12 times in 2003 and cant even show my evidence to a judge. The settlement is not going to help the ones that are in forclosure .We just have to let them do whatever they want
