We have also been a victim of the unfair dealings of Fairbanks Capital Corp. At the time this all happened we had already been making steady payments and been in our home for over 14 years.

The problems began in the summer of 2001 and the effects may never go away because there are still high charges pending on the contract and they left our credit a mess! Every time we tried to contact the company to resolve matters we got the run-around, on top of that the employees were rude and obnoxious. They tried to put our home into Foreclosure and we have all of the documents to prove it!

They have sent back checks for payments and then had the nerve to attach late fees for it! For example they sent us a letter stating "Amount necessary to reinstate as of November 30, 2001, you must pay $14,822.13." then it follows with the statement "On or before the earlier of November 30, 2001 or the date of execution of this agreement borrower shall pay $9,717.10 to lender" This is what they demanded on their forbearance agreement.

This was not something we agreed on. They also suggested we file for bankruptcy. We were sold from Citifinancial to Fairbanks and immediately the troubles began. This was and still is a very stressful time. It put a major strain on our marriage and our health and we feel we deserve compensation for this. This company should NOT get away with this.

WE have pursued this issue with the Attorney General in Philadelphia PA @ Philadelphia Regional Office 21 South 12th Street Second Floor, Philadelphia, PA 19107 phone 215-560-2414. and we were issued a file number, yet we have not pursued a class action suit and would be very interested to do so.
