I have been fighting Fairbanks Capital for the last five years, on the same issues that were mentioned on FOX 13 tonight. My home has been forclosed on not once but twince in the last five years. I have paper work showing that they are to have correct all of the errors that were mad to my loans. All of the posting to wrong accounts, all of the lost payments they said they never received.

They are to be credit back all of the money they put into and escorw for my home owners insucrance that I pay in full every year in advance. I did get a 3rd for closer notice due to not paying my taxes in the last two years. It was very simple to understand why I am not due to spening well over $ 12,000.00 in sending double payments that still have not hit my account. Monies that I had to spend to send them copies of all of my checks for the last 5 years front and back. I did send them certified but it did not good. The 5th time I sent it they finally said they had received it.

They have promised to credit my accounts for the money I lost from work, for monies spent on sending them the same things over and over and over. For the phone bill that was well over $ 200.00 for having to call Salt Lake City UT. I finally did get a hold of a man and he emailed me tell me who I would need to speak to. From that point it then went to 10 different people who all emailed me telling me they would handle the issue and have all corrected within a week. I did receive a letter that shows that they have credited back over $ 2,580.00 in late fees as well as all the xtra fees that no one could expain as to why or what they were for.

They have corrected one of my loans on my credit report but not the other. I just spoke to them once again stating the credit report is not correct nor had I been credit back any of the money for the insurance escrow they are still billing me for. They have promised on several occasions that they would be crediting my loans for all the monies I spent on the forclosers and the paper work sent to them, along with money they mad me lose from work with the forclosers. They had been calling me at Tech Data and the calls are recorded.

They would threaten me call me names and tell me I would be homeless if I did not pay them. I am more than upset at the way I have been treated. They bought my loan from Conti Mortgage with out evern letting me know. I sent letters to the Attorney General on 11 different occasions along with or to Govenor Bush, 60 Minutes, 48 hours and so on. No one wanted to help me and till this day no one has. Though many others have called on me to help them beat Fairbanks..I still am trying to recover the money from all I spent to hold on to my home. Not to include the amount of stress and mental abusive they have put me through.

Please if in fact a case has been brought against Fairbanks, I would want to be a part of it. They have nearly destroyed my life, credit report and home. I can not even get a loan due to all the bad credit they falsely reported against me. Plese for give any spelling errors I become more and more upset each time I hear that Fairbanks has destroyed to tried to destroy some one elsed life.

Joe, I just read your story about Fairbanks, read my story dated 1/4/09 - you are not alone. You are fortunate you still have your home, Fairbanks started stealing homes right after they bought Conti mortgages - we were told Conti went bankrupt and were never notified Fairbanks assumed the mortgages. This all began sometime in 2001 - we found out 3 years later their was a class action law suit brought against them - we received less than $2000 after the FTC slapped them on their hands and allowed them to re-organize. It is sad to think they are still stealing homes and we (the victims) can't get any justice. Our prayers go out to you. Maybe someday the right politician or government official will re-open this case against Fairbanks. Good Luck and Happy New Year.

Good afternoon.

I am an exployee of Calmco/Olympus Servicing/Fairbanks from the Austin, Texas office. I worked in several departments. First, I began working in the Foreclosure (4DUE) department. The company was shrinking and people were being swithced around into different departments. By the end of my history with that company, I was moved from Foreclosure, to Pre-Foreclosure, to "2DUE" to "1DUE".

Needless to say, that company is absolutely pathetic.

The foreclosure department was incredibly ridiculous. Employees in that department would work up business plans (forebearances) to "help" borrowers get back on track. All financial information is required before such an agreement can exist, let alone be executed. Short sales, forebearances, acceptance of two mortage payments .. all of the practices in that department were mighty shaky.

Most of the time, an agent in the foreclosure department would accept two mortgage payments. This instantly tosses that loan from the "4DUE" department into the "2DUE" department. Days later, the loan is back at the "3DUE" (Pre-Foreclosure) department and back into tacking on even more "foreclosure fees." By the time some of the loans would make it out of the black hole of Fairbanks, they would owe thousands upon thousands of lawyer fees. Although, some of these borrowers were deserving of the foreclosure process, many more were being faced with unfair and unlawful charges. Some were being charged fees that had not even been assessed. Makes you wonder, eh?

Now, if you find your loan being handled by the Pre-Foreclosure / "3DUE" department, you will find yourself being harassed, threatened, and screamed at by a collector that is more than likely breaking at least 2-3 federal laws. Not only are your rights unacknowledged, they are even continuing their unreasonable calls to your employer. You're working as hard as you can, and someone calls you at work wanting you to make payments. You advise the collector that if the calls continue, you may possibly lose your job. What happens? If you're not called at your "POE" (place of employment) again that same day, you're one of the lucky ones. It is against the FDCPA to attempt contact to a borrower that is at his or her POE once it is "recorded" that it is unreasonable and definitely requested that the calls cease immediately.


The "leadership" at that company was entirely ignorant, unprofessional and promiscuous. If the collectors from that office had any knowledge of the FDCPA, they completely disregarded it.

On several occassions, collectors would violate federal law by threatening a home owner with consequences that were not lawfully possible. As a collector at that company, not only is the company as a whole liable for the collector violating the federal laws, but the collector is liable as an individual as well.

Collectors were advised by the "Leadership Team Members" to continue calling accounts, even after the cease and desist have been properly documented. Even I questioned the "order" and advised the supervisor that I would not continue calling the accounts that were under certain restrictions. I advised her that as a collector, I was liable as an individual for breaking any federal laws.

I refused to do what was asked of me. How can a company ask an employee to break federal laws? Later that week, I was written up and placed on probation for being insubordinate.

What is the bottom line? I sincerely empathize with anyone that is on the other end of "the stick" with this company. They are breaking federal laws and getting away with it.

Good Day:
Once again I find myself having to update my file because Fairbanks is still trying to STEAL my home! I have been work with Mr. Davis now for over a year and he has been wonderful. We have tried to reach the so called contacts for Fairbanks to no avail. Mr. Pay as you will note did receive my email and I have receipt showing so. However, he has never replied back to me. Now this by no means surprises me what so ever.

I want everyone to know once again last month we drove to Kentucky where there PO box is listed and dropped our payments to them. It took 16 days for those payments to post to the accounts, which allowed Fairbanks once again to charge the late fee that they make MILLIONS ON! As told above Fairbanks shows that my second loan is behind. Yet I have copies of all of my check being carbon and show that Fairbanks cashed everyone of them. On several occasions I was told that all fees on my account would be credited back and yet they did not do so nor did or have they correct by credit report.

Just yesterday I received a letter from "Select Portfolio", being Fairbanks. This letter advised me of how they had changed their name "once again". As though we were not going to stay on TOP of them. The same day I received my third statement from Fairbanks only it was "Select Portfolio". As I looked at these statements I could not believe my eyes. As I have said on several occasions, I paid $ 63,000.00 for "my" home. Fairbanks/Select Portfolio shows that I owe $ 70,000.00 on my home. I have had my home sense 1996 and have never missed a payment nor been late with one for that matter. There is an escrow account for insurance that they have been taking out for a year with out advising me. This meaning that the payments I have sent in are short each time for the first loan only, it does not show escrow for the second. I called my insurance company who told me Fairbanks/Select Portfolio has a full copy showing my insurance is valid throughout October of this year. Then they advised me that they would not be renewing my policy if I stated with Fairbanks/Select Portfolio because Fairbanks/Select Portfolio was costing them way to much money on all the time they have to spend not just on my account but on over 350 accounts in Florida. They will not be renewing any of them. This meaning I will have to find new coverage or allow the criminals to "really" start escrowing my account with coverage from them.

If that is not bad enough, today I received a default letter on my second mortgage. Now the letter states if I do not pay the $ 1,708.26. These criminals just NEVER STOP!~ As of today's date they have cost me over 54,000.00 out of pocket and I am another $ 13,000.00 in debt now to my credit union paying monthly payments. When they first foreclosed on my home that cost me right at $ 15,000.00 with all attorney fees.

Only I paid that money for them to back out the day of court, saying they in fact found their errors. A year later again I got a call From the same Attorney from Fairbanks stating that they were again going to serve me with foreclosure notice. After working with her for 8 days of phone calls personal visits and copies of my information she called me back to say "she" showed Fairbanks that once again they had mad errors.

Fairbanks/Select Portfolio has cost me LITERUALY MY LIFE! They cost me a job from the harassing calls at work, they cost me my life savings from simply and freely STEALING from me. I can not tell you the large amount I have spent for my health do to the unneeded stress from Fairbanks/Select Portfolio. It seems that our Government is yet still closing their eyes to these White Collar CRIMINALS! I received another phone call from New 10 in Saint Pete telling me they would like to come and interview me. I told them I would be more than Happy. The reporter told me he had been working with Mr. John Yanchunis of the Newcomer Firm out of Tampabay had files against them.

I told this reporter that I had been working with that firm for nearly two years and that I was advised they would be representing me on my own and not in the class action. This never happened! Every one knows that the first files was out of Miami and with all the Attorney's involved the VICTIMS will not receive anything if at all from the Class Action. As I have said in earlier reporting, I did not receive the notice to opt in or out so this leaves me going on my own against Fairbanks/Select Portfolio.

It has been said time and time again, "Thomas D. Basmajian and his crew" are ALL CRIMINALS. Stealing hundreds of millions of dollars nearly reaching a billion and yet He nor any of his CO-hearts are in prison. Why NOT!!!????? Many of use have spent our LIVES fighting these CRIMINALS. Why is it NO ONE will step up and close down Thomas D. Basmajian and his crew. They have broken EVERY Federal Law that exist and yet no one is in prison and they have not received any REAL fines for breaking the LAW.

I would like five minutes alone in a room with ALL of them, simply to tell them what they have done to my LIFE. I realize that more than not it would barley if at all effect them. However, it would give me a touch of letting go of some serious pain. I have said it several times and I will say it again! "I will not allow Thomas D. Basmajian and his crew to steal my home". I will fight them with every breath I have left. Then they will face my Family and rest assured they meaning Fairbanks/Select Portfolio have seen nothing yet!!!!

As each of you know I just posted the other day to again show that I am still trying to get Fairbanks to stop breaking the law. It is not even funny that I can not get statements on my home from Fairbanks, yet they can send me all kinds of junk mail for car insurance, health and life ect.. Today I get home an could not believe that my May payment to Fairbanks had been sent back to me. This is the 4th time they have come back and I resend then they cash them......HUMMMMMMMMMMMMMM!!!!!!!!!! I will have to go back again to Mr. Davis with the banking commition to request once again help.

Mr. Pay why are you not responding to my emails? This battle of Fairbanks and all their other companies with different names is getting really tired! When will you reply to me and fix all the errors that have and continue to happen with my loans. Notices I am nice enough to still say Fairbanks Errors. Show self respect and stand up to show you have morals.

Attention Mr. Philip Pay:

I emailed you back on May 4 and 7, 2004. This after speaking once again to Mr. Davis of the banking commission.

It is now 35 days later and I have yet to hear back from you on my concerns with Fairbanks. Nothing has changed from my initial email to you! I still do not receive my statements, I still get calls from collections, Fairbanks, still shows I am behind on one of my loans. I have been more than helpful to Fairbanks in "proving" their "errors" to them.

This endless fight with Fairbanks "trying" to STEAL MY LIFE, is not going to happen! Please Mr. Pay, take the time to respond to me via email. I Invite you to do so. The issue of Fairbanks and it"s mother companies still practicing illegal business ethics has not stopped. Please note that I again have forwarded this to Mr. Bill Davis and the banking commissions.

Please take look at the below and with your eyes see the illegal practices that are taking place. DO NOT CLOSES YOUR EYES OR SAY YOU DO NOT SEE IT!

Second, if you live in New Hampshire and are having problems with this company, please call the Banking Department and report them! There is potential for a class action lawsuit! Also, no matter where you live, contact the FTC, they already have complaints on file against this company. Send them your entire papertrail in dealing with Fairbanks.

Much like everyone else that has posted here, we have been having problems with Fairbanks including not getting credit for checks they cashed, force placed homeowner's insurance (which is illegal in New Hampshire), being called names, refusing to transfer us to a supervisor, being charged money with no explination of why or proof, threatened with foreclosure and MUCH MUCH more. They used to harass us starting at 8am every single morning and would hang up every single time they got our machine and would keep calling back all day long. They even had their computers harass us via telephone!

Superior Bank FSB sold and/or transferred servicing rights of our loan to Fairbanks in October of 2001. I was informed by the FDIC this morning that they shut Superior Bank down in July of 2001. When Fairbanks started their supposed foreclosure on us, the letter from the lawyer indicated that Merril Lynch Mortgage Company was the loan holder. In a letter we got from Fairbanks yesterday, it cliams that Superior Bank is the loan holder. Now we don't know where our money is going and Fairbanks has not given us credit for about $5000.00 in checks they cashed.

In the mean time, Fairbanks is playing games and stopped accepting our mortgage payments back in June of this year. I have all the returned checks and letters to prove it. Yet, every month we get a statement asking for just that month's mortgage payment and they are claiming we owe 9 months of back payments.

Fairbanks is refusing to answer our questions and keeps sending the same reports and pages from our loan over and over again. I've sent their lawyer all our cancelled checks, which by the way were not endorsed by Fairbanks, Superior or Merril Lynch! The checks are being endorsed for cashing by Bank One of Arizona.

If you are having problems, get yourself a good lawyer in addition to reporting Fairbanks! Tell your lawyer that there are people in other states having the same and/or similar problems with Fairbanks. Collect all the cancelled checks you have and see who is cashing them!

Unfortunately, this website does not give us all a way to contact each other that I can find so your best course of action is to report Fairbanks to the Banking Commission in your state, report them to the Banking Commission in their state, the FTC and get a lawyer. Show this website to your lawyer so that he/she knows there are problems with this company all over the country!

I was ripped off!



I had no clue Fairbanks had a history with ripping people off.

I called them December 20, 2003 to report that was going to send in my November 15th and December 15th payments on December 27th for the November payment and January 10th for December.

I asked the representative, if this could be arranged and she said there would be no problem.
In short, I sent 3 payments in by January 16th and all of them were rejected because I went into foreclosure on the 30th of December? My solution was to pay an extra $800 for attorney fees.

I too have been victimized by Fairbanks. You are the first report on this website who has had their loan sold from Superior Bank, FSB to Fairbanks in October 2001 too! Guess what, that is when it all started for us. We have been in foreclosure twice already, the have extorted more than $7,000 from us. Unfortunately, I cannot afford a lawyer and try to keep my house. I have two small children. I would love to join a class action lawsuit in our area. I am located about 75 miles, give or take 10 miles, from you.

I did contact Fairbanks on Tuesday, the 29th because we had sent our payment overnight with required signature on Friday, April 25, 2003 and we had proof it was signed for on Saturday but they had not posted the payment. So when I called I asked how they were applying it. I was told that their new policy was to apply any monies to PAYMENTS first instead of fees. I wonder HOW COME. Anyway, we aren't out of the woods yet. Now that they have ruined our credit, we cannot seek refinance anywhere even with this information. Good Luck to you!!!!

Way to put a complaint with the Attorney General



Fairbanks company is the worst Mortgage company in USA and there are already joint investigatons by the Federal Trade Commission and the Inspector General general of the Department of Housing and Urban Development This company should be fined and we should find a way to file several class action lawsuits.

This is my story: I cancelled a life insurance that was added to the mortgage company, so I sent my regular payment on time, minus the insurance premium as it was already cancelled.

Fairbanks added a late charge because they were claiming that they did not receive a cancellation notice directly from the insurance company even though the mortgage payment was sent and received on time.

Because I live in Florida I filled a complaint with the State Attorney's office. But because the headquarters are located in Kentucky, it was transferred to that jurisdiction and it is my understanding that Fairbanks Company has several hundreds of similar complaints against them.

Where are all the Superior Bank, FSB and Alliance Funding people gone, there is more to this than meets the eye, Litton Loan, Fairbanks, and maybe eve



I have been recently been foreclosed on by Litton Loan, the joke is that Litton Loan obtained my service contract from Superior Federal exactly at the time they were being closed by the FDIC.

Been checking the hall of records in my county and there is no indication that Litton Loan has control of the account or any filings were done by them for my home.

So if Superior Federal is out of business, who the hell is Litton paying the money to or who are they receiving their commission from. Interesting thought.

Wonder how many of us are in the same boat, waiting to be sunk.

Would be interesting if there was a combination page, for all the victims versus site by site and Servicer by Servicer.

One more piece to the Puzzel M&T Bank, NY & Fairbanks & who else



Since it has been quite some time since anyone posted to the Superior Bank & Alliance Funding site, be aware that things are being brought back out into the open air.

And the past is catching up to you.

There was a post in one of my anti-predatory groups about an old lawsuit. In this law suit summary it was noted that Fairbanks's parent company was and is Manufacturers & Traders Trust Company, to day commonly called M&T Bank, in NY.

This has not been formally confirmed (parent) but you have to wonder? Especially since M&T Bank has been given Federal & State monies for some new housing programs in the Erie County area & Buffalo NY.

Maybe someone should send a copy of that lawsuit to the County Exec & the Attorney General Eliott Spitzer, they might just find another can of worms to dig up.

Everyone every which way I and you turn they all seem to be involved with one another.

By the way the case was Schollser VS Fairbanks Capital Corp. Remember, if it isn't Fairbanks it could be Litton Loan, Ocwen, and the list goes on and on.

Update: one of our families has been able to pull a rabbit out of their hat.

They found a young and strong attorney who is challenging not only the foreclosure but all actions including harrassment and eviction of this Family the Mercers, Bob & Rae.

I have the pleasure of being asked to attend by their attorney on 3/23/04 I will be in court, and am prepared to be called as a supportive witness to the fraud and RICO violations perpetrated against ALL VICTIMS.

Start speakiing out, look for any little thing, but keep trying, God is with us and is helping.

Victim of Fairbanks Capital



I too have been victimized by fairbanks capital. From excessive late fee's (even when I was not late) to forced insurance even though I had insurance on my home. I received in the mail a short time ago a letter stating that I would receive a payment from fairbanks capital due to a settlement agreement on a class action lawsuit. Great I filled out the forms, however due to my credit being damaged I cannot refinance my home and I am stuck with this company for at least another year. Beware of this company and stay far away from them. i think they should be dismatled also and I pray everyday that my loan will be sold to another company just so I do not have to deal with them anymore.

My home was financed with manufactures trade and fairbanks took it over and now they took my home. they sold it i have a 15 year old daughter and they gave me 3 weeks to get out. i have lived here 26 years. alot of accumulation of various things!! the judge here in palm beach county did't seem to care nor did my attorney.i was behind on my payments , however they recieved a letter from my husbands attorney stating that the back payments would be caught up. my interest rate with them was 13.75 percent. i am crushed, devested and just plain hurt. don't know what to do thanx for listening. had to get it out.

I am a former superior bank customer and also alliance funding. i took out my original mortgage with superior bank. then i was sold to WMC mortgage company who in turn sold me to fairbanks in december of 2001. now they are saying i owe payments from may 2001 when they didnt even have my loan at that time. i have filed 3 chapter 13 trying to keep my house.i am not giving up my house with out a fignt. now they are charging me so many attorney fees they have charged me over 12,000 in attorney fees and other bogus fees. there attorneys in illinois are pierce and associates. how can a law firm represent a company like fairbanks or what ever they call themselvs. this is one horrible nightmare. but if any body out ther know of what we can do please let me know.

i have wrote to my state senator, hud, ftc, the senator of maryland, and anybody else that will listen. why wont somebody defend us in our trying times. there must be a law firm out there somewhere that can do a class action from all states.just imagine the people that would file. i have 5 friends who are in the same shape with fairbanks sold to the from superior bank.

Hello Everyone:

I am sorry that it has been so long sense I have updated my report. However, make no mistake about it, I have been staying on Fairbanks as I have for all these years. I have tried everthing I can think of to get Fairbanks to correct their so called "errors". As everyone knows they have not addmitted to any "wrong" doing. Yet the same things that each of us have filed complaints about are happening still today.

Please forgive me for not replying back to you much sooner. As you said in your message, I to have been to say the least so stressed out. I needed to take time away from all of it and try to get "my" life back in order. That meaning stopping these thiefs from stealing not just my home but my life. I am so sorry to hear that you have lost everything. Please know that you by far are not alone. I am still in my home but for how long no one knows. I still live day by day wondering when the foreclosuer will come again.

I have tried endlessly to work with Govenor Bushes office but as we all know, he is far to busy with his life to be bothered with ours. Those that are suppose to help us, are only helping Fairbanks and their friends to continue stealing homes and lives of hard working Americans. As stated in my report, I have tried for years to stop these crimes from continuing. I have filed reports with every legal state and city office any one could think of.

Yet, as everyone one has seen, each of them want nothing more than to pass the buc to another office who just continues the passing. Well, I have found one person who has been very helpful to me. Mr. Bill Davis the III. He is with the DOFS. He has stayed in touch with me on a daily basis, working my case with all he has.

We sent a letter that is a RESP letter to Fairbanks. It took them 60 days to respond. When they did it was par for the course, their numbers were way off and they supposivly correct "my" credit report. However, the records I recieved from Mr. Davis , show the name of the report they corrected listed to a John J. Cruz. I have no idea who that is. It is clear it is not me!

They show that I owe nearly $ 66,000.00 on my home, yet I only paid $ 63,000.00 for it. They show that they only foreclosed on my home once in the amount of their attorney fees of $ 1.900.00. However, again that is wrong. I have the foreclosuer paper work and it was over $ 3,000.00, for both of my loans. Then there are all these drive by fees for large amounts that I show from the 1 of the payoffs they sent. Mind you, I have 3 pay off amounts, each being different and each have different amounts of fees charged to them. Now, of course there is all the illegal insurance they added to my account in escorw. I could just go on and on.

After speaking to Mr. Davis on all of these issues, he said he would make a call and call me back with another contact from Fairbanks. Oh, I must not forget to tell you that my payments from December and January were "returned" to me, making me have to send them out once again. My Febuary payments have not been cashed yet, nor have they been returned. I tried calling Fairbanks and advised each rep that, I too would be recording the calls when we spoke. I recieved notice of default twice on my home again. I called and spoke to a young lady who's name I will leave out. She advised me that it was showing my 2nd loan was 2 months behind. When I advised her that the checks had been cashed and that my 1st loans was not behind...she said yes, I see your account is still in dispute. Not funny, but a week later I recieved another notice on the same issue.

I again call Fairbanks and this time spoke to a different women. She said completley the opposite of what the lady just a week earlier had said. When I advised her of what was stated a week eariler with it being recorded, she said well then you need to dispute it again. Send in all your checks and paper work to the fax number. I did just that and yes, keeping true to their par for errors they say they did not get it. Well, the copy fax I have shows they did.

Now that I am back, I am reading that people were or did receive the class action paper work to be filled out and filed. Well, not me I did not receive it and still have not. I guess that clearly leaves me out again. However if need be I will have to go after them a lone with having the class aution as the big back up witness.

All I have ever asked of Fairbanks was to stop the illegal practices they were and as of today still are practising. They should pay me back for all of the out of pocket money I had to spend for their improper and illegal foreclosures. Not leaving behind all the other things I metion in my report. I am praying that once I send the email with a copy of my report to Mr. Phillip Pay at Fairbanks; He will correct all the issues at hand and offer me some kind of compesation for the huge incovinece they have caused me and my family. In all honesty Fairbanks should give me the deed and titel to my home "free and clear" of paying them anything further.

The un do amount of stress Fairbanks has caused directly to myself and my family is not un like any other family who as well should be monataraly compensated for their losses. When I started this years ago, all I ever requested was for them to correct their errors and stop the harrasing me at work and home. It deeply sadens me to see that daily reports are still being filed against Fairbanks. There are clearly illegal practices that have and still occur today.

Attention Mr. Pay:

After many years of un due stress caused by Fairbanks, I was giving your name to contact and told that you "would" be able to help me get my accounts with Fairbanks corrected and straightened out. My hope is that this will be true! I not un like any other loan holder have been tryiing for numurous years to get Fairbanks to correct my accounts and send me out monthly statements. This is May of 2004 and I have recieved 2 statements for only one of the loans. The ones that I did recieve are for months already paid.

My accounts, both of them are current and should be do for only the month of May. I see that my checks again for the month of April still have yet to be taken from my bank account. Thus, telling me that they have not been cashed. Please, Please get Fairbanks to correct my accounsts. As well, please get them to give me back the money they owe me for all the things I have had to send to them for their erros and for the money I had to spend for the impoper forclosures they caused to my family.

Your story sounds just like my own. I had to deal with Ocwen and they finally foreclosed on my home. I hope that you can help me. I have read all of your report and I'm tring to contact some of the people that you suggested; Roger Doggett a Tezas Rural Legal Aid Attorney in thge San Antonio news paper article dated 2/7/03, James McMillan; consumer protection attorney in Corpus Christi, TX.

I have contacted HUD, AG office, FTC, etc. and no one is of any assistance. I have read the FTC's web site and they say that they are set up to protect the consumer with problems as ours, but they told me three different times that they couldn't help me.

Who did you contact and who assisted you the most? Where did you get the most leadway with. I think that you are still in your home, but even that I was wrongfully foreclosed on, you might be able to assist me because I have used 7 different attorneys, filed for bankruptcy, lost my 12 yr old business, car repossessed, suffered nevous breakdowm, other stress related illnesse, living with parents, spent $250,000.00, etc. Can you help me put Ocwen where they belong? I plan to file a law suit against them and represent myself. If you can please post your answers below so everyone can benefit.

They have cashed one of my check for $ 417.85 as of the 18th of this month..November, for October. It took Fairbanks 30 days to cash one check, just as it did last month. Now where is the 2nd ck for 162.70 that I sent with the $ 417.85? I am sure it is in their hands just sitting there. As I have said earlier in my report, Fairbanks is not suppose to be calling me. However, that has an does not stop The Loan Servicing Center from calling me 3-4 times a day. A message is left on my machine to call the Loan Servicing Center asap. Who is the Loan Servicing Center, I have no idea. I have no business with them, as I stated in several letters to Fairbanks. Yes, it is Fairbanks. However, it is not legal for them to be using a fake name. I was home yesterday when 1 of the 3 calls came in. I answered the phone, an it was a Miss. Newbarry, from the Loan Servicing Center. I advise this person I did not know of any company called the Loan Servicing Center. Miss. Newbarry said, that she was calling on behalf of Fairbanks. I said if she were then why did she say she was the Loan Servicing Center. Miss. Newbarry said that all collectors call using that name. I advised Miss. Newbarry, that it is in fact illegal for her to call an falsely give an fictitious name an then same, well it is Fairbanks. I then stated to her that if she were Fairbanks, that they were not suppose to be contacting me by phone at all. I followed with, why is it Fairbanks is still practicing their illegal practices. They have cashed one of my check for $ 417.85 as of the 18th of this month..November, for October. It took Fairbanks 30 days to cash one check, just as it did last month. Now where is the 2nd ck for 162.70 that I sent with the $ 417.85? I am sure it is in their hands just sitting there. As I have said earlier in my report, Fairbanks is not suppose to be calling me. However, that has an does not stop The Loan Servicing Center from calling me 3-4 times a day. A message is left on my machine to call the Loan Servicing Center asap. Who is the Loan Servicing Center, I have no idea. I have no business with them, as I stated in several letters to Fairbanks. Yes, it is Fairbanks. However, it is not legal for them to be using a fake name. I was home yesterday when 1 of the 3 calls came in. I answered the phone, an it was a Miss. Newbarry, from the Loan Servicing Center. I advise this person I did not know of any company called the Loan Servicing Center. Miss. Newbarry said, that she was calling on behalf of Fairbanks. I said if she were then why did she say she was the Loan Servicing Center. Miss. Newbarry said that all collectors call using that name. I advised Miss. Newbarry, that it is in fact illegal for her to call an falsely give an fictitious name an then same, well it is Fairbanks. I then stated to her that if she were Fairbanks, that they were not suppose to be contacting me by phone at all. I followed with, why is it Fairbanks is still practicing their illegal practices. Miss. Newbarry said nothing, so I did. I advise her that if she were from Fairbanks, to contact me by US Postal an send it certified like I do. I further told her that if she were Fairbanks, that she an Fairbanks were breaking the law by still calling me after I clearly stated 4 years ago for them not to call me any longer. Miss NewBarry advised me the call was being recorded an I told her that was fine, then they should clearly have heard what I stated to her. I then advised her that now over 175 times I have stated that Fairbanks IS NOT TO BE CALLING ME, an that from my machine, I too had recorded our conversation. Miss. NewBarry then hung up.

Fairbanks, Mr. Thomas D. Basmajian, Mr. Ozanne, Mr. Shuster, an Mr. Harmer, have not followed the current order against them. For that matter I do not think for a moment that they will. This Fight with Fairbanks, as well as PMI., seems to be never ending. Well, not it is time for me an all other victims to go after them an let them suffer the pain, stress an heartache that we have. I am going to be their migraine now. Let us see how they like it. Keep your head up an go after them, like they have an continue to come after you.

Nothing new here. I received back my payments again for October an of course sent them out one again. As of today they have only cashed one of my checks. I can hardly wait to see what happens with Novembers payments. I sent a request over 2 months ago to Fairbanks for the pay off on my home an asking who they are servicing my loans on behalf of. I have not heard back, so the FTC sent them a letter on my behalf over a month ago an as to date I have not heard back from FTC or Fairbanks. I have sent out over 50 request for Fairbanks to correct all of the issues on my account. On 2 occasion, I did hear back from them. However, nothing has been corrected an they are still practicing they way they were prior to the FTC an HUD intervention.

The other night I posted a rebuttal to Dee in New York, but for what ever reason I do not see that it was posted. It was in reference to the settlement. Of course I do not remember all that I said, an I did not save it, which I generally do. However, her post is from the 17th of this month, so please view it. I will post here a couple of emails that I have sent to Florida Governor Jeb Bush what a joke he is, to Senator Bill Nelson, to Lucy an Mark of FTC an HUD, an finally to Charlie Crist AG for Florida, who as of date has done nothing to show the victims in Florida that he even cares! I realize that many of us can not afford an attorney, or can find one who has the Humanity to help us. However, one of the main ways to go not just after Fairbanks, but PMI., as well is through the FDCPA. Please make sure that you read up on the Laws there an you will see that both companies broke each an every one of those laws listed.

This settlement is totally unacceptable to the tens of thousands of victims of this predatory mortgage servicing company. $40 million dollars is but a drop in the greedy bucket . How are the victims to be compensated not only for the money they lost , the homes , not just houses that were stolen, the many expenses such as lawyers and fees that were charged illegally. Now what is worse , how do they reimburse the victims for health lost . Many have had heart attacks, strokes, high blood pressure, put in to a deep depression, lost their families, an will never recover from that! We couldn't find lawyers to help us because they didn't believe they could win against this corporate greed.

I need to get out of the $ 12,000.00 I am in debt. I need to get back all the money I have spent on Dr. Bills in the last 5 1/2 years, as well as all the medicine bills I have an will for years to come. The money I paid in to their illegal practices for attorney fees, foreclosure .. illegal...all the money I spend on certifying payments to Fairbanks, which is $ 9.00 a month. What about all the money paid for late fees an forbearance I never agreed to. It is a shame that I can not even live pay check to paycheck now, because of Fairbanks an their illegal practices.

The FDCPA, states that each victim is or can be awarded up to $ 500,000.00. That still would not be enough for the HELL they have put anyone through. What about my attorney fees I paid for the illegal foreclosure. It could just go on an on. Needless to say the offer of $ 40 million is nothing more than a bad joke.

Everyone of them should be put into a HALL OF SHAME/CRIMINALS, including all of the Federal Government.

Maryland Announces Fairbanks Settlement Estimated 14,500 Homeowners To Receive Refunds

BALTIMORE -- Maryland officials announced a settlement Wednesday with the Utah-based mortgage servicing company at the center of a 10-month 11 News I-Team and government investigation.

The Maryland deal comes on the heels of last week's $40-million settlement with the Federal Trade Commission, WBAL-TV 11 News I-Team reporter Barry Simms reported.

"We are seeking to put this behind us so we can go after the next person in line," Charles Turnbaugh, the commissioner of Maryland's Division of Financial Regulation, said.

Turnbaugh signed an agreement with Fairbanks Capital Corp. over what the state determined that some of the company's practices are deceptive.

"They can't pull these fees out of thin air and impose them on customers," Turnbaugh said.

In the civil settlement, Fairbanks agreed to conduct internal reviews of all Maryland loans. The company will reimburse borrowers forced to pay questionable fees. State financial regulators said about 40 percent to 50 percent of an estimated 14,500 homeowners should get refund checks in the mail in a matter of months, Simms reported.

Fairbanks also agreed to respond to complaints within 20 business days and try to resolve complaints within 60 days. The loan servicer will also pay $90,000 as partial reimbursement for the state having to look into complaints.

And the investigation of Fairbanks for possible criminal activity will continue.

Diane Cipollone, president of Baltimore's Community Law Center, said the agreement is good for Maryland homeowners.

"The fact that Maryland is still going forward with the criminal investigation is a good sign. Maryland homeowners felt very victimized by the practices," Cipollone said.

Fairbanks customer Linda Smothers is relieved that she didn't lose her home. Fairbanks finally paid her overdue property taxes from her escrow account. She wants an explanation, an apology and something else.

"I would really like to refinance and get away from them completely," she said.

The state will oversee audits of customer accounts and refunds will be mailed automatically. Maryland's criminal investigation of Fairbanks could last another five to six months.

The company declined comment on the state settlement.

Fairbanks Capital Settles FTC and HUD Charges

Agencies Allege Fairbanks Engaged in Illegal Practices in Servicing Subprime Loans; Defendants Will Pay Over $40 Million for Consumer Refunds

The Federal Trade Commission today announced settlements with Fairbanks Capital Holding Corp., its wholly-owned subsidiary Fairbanks Capital Corp., and their founder and former CEO, Thomas D. Basmajian (collectively, Fairbanks). In separate settlements, the corporate defendants will pay $40 million in redress to consumers, and defendant Basmajian will pay $400,000 in redress. In a complaint filed in federal district court, the FTC charges Fairbanks with engaging in a variety of unfair, deceptive, and illegal practices in the servicing of subprime mortgage loans.

According to the FTC, the defendants, among other things, failed to post consumers' mortgage payments in a timely manner and charged consumers illegal late fees and other unauthorized fees. The settlements are contingent on approval by a federal district court in Massachusetts, and the settlement with the corporate defendants will be coordinated with a related settlement in a class action lawsuit. The case was jointly filed with the U. S. Department of Housing and Urban Development (HUD).

Consumers should be treated fairly and honestly in the servicing of their loans, said Timothy J. Muris, Chairman of the FTC. It is particularly important that the Commission stop unfair or deceptive practices in this industry, because consumers have no choice about who services their home loans and it can be extremely difficult for subprime borrowers to avoid an abusive servicer by refinancing or paying off their loans.

HUD Secretary Mel Martinez said, Today's settlement makes clear that HUD and FTC are serious about protecting consumers from those who would try to steal their American Dream.

The message we are sending is clear those who seek to take advantage of unsuspecting homeowners will be tracked down and held accountable.

Subprime lending refers to the extension of credit to persons who are considered to be higher risk borrowers. Fairbanks is a financial services company specializing in the servicing and resolution of subprime mortgage loans. Fairbanks does not originate loans, but collects and processes loan payments from borrowers on behalf of the owner of the mortgage notes. Headquartered in Salt Lake City, Utah, Fairbanks is one of the country's largest servicers of subprime mortgage loans. The FTC alleges that Fairbanks engaged in a myriad of unfair, deceptive, and illegal practices in collecting and processing consumers' loan payments.

ALLEGED LAW VIOLATIONS

The complaint charges Fairbanks with violating several federal laws, including the FTC Act, the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), and the Real Estate Settlement Procedures Act (RESPA) enforced by HUD.

FTC Act Violations

The FTC alleges that, in servicing loans, Fairbanks frequently:

failed to post consumers' mortgage payments in a timely and proper manner, and then charged consumers late fees or additional interest for failing to make their payments on time;

charged consumers for placing casualty insurance on their loans when insurance was already in place;

assessed and collected improper or unwarranted fees, such as late fees, delinquency fees, attorneys' fees, and other fees; and

misrepresented the amounts consumers owed.
Fair Debt Collection Practices Act

The complaint also alleges that Fairbanks violated several provisions of the FDCPA, in connection with collecting loans that were in default when Fairbanks obtained them. Specifically, the FTC alleges that the defendants falsely represented the character, amount, or legal status of consumers' debts; communicated or threatened to communicate credit information which was known or which should have been known to be false, including the failure to communicate that a debt was disputed; used false representations or deceptive means to collect or attempt to collect a debt, or to obtain information concerning a consumer; collected amounts not authorized by the agreement or permitted by law; and failed to validate debts.

Fair Credit Reporting Act

The FTC alleges that the defendants furnished information about consumers' payment status to consumer reporting agencies when they knew or consciously avoided knowing that the information was inaccurate. Also, when consumers informed the defendants that they disputed the reported information, the defendants did not report the dispute to the consumer reporting agencies.

Real Estate Settlement Procedures Act

RESPA is a federal statute that requires loan servicers to respond to borrowers' written requests about their loans and to make timely insurance and property tax payments on behalf of borrowers and otherwise properly administer their escrow accounts. In the complaint, HUD alleges that the defendants failed to timely and adequately acknowledge, investigate, and respond to borrowers' written requests for information about the servicing of their loans and escrow accounts. HUD also alleges that the defendants failed to make timely payments of escrow funds for insurance premiums and property taxes.

THE SETTLEMENTS

The settlements announced today resolve the Commission's and HUD's allegations. If approved, the settlements will require the Fairbanks corporations to pay $40 million, and Basmajian to pay $400,000, to the FTC to be used to compensate consumers who suffered harm from: (1) unauthorized late fees, (2) other fees Fairbanks imposed on consumers it deemed in default, (3) unauthorized prepayment penalties, or (4) other improper practices by Fairbanks related to consumer defaults.

The settlements also enjoin the defendants from future law violations and impose new restrictions on their business practices. The settlements:

require the defendants to accept partial payments from most consumers and to apply most consumers' mortgage payments first to interest and principal;

prohibit the defendants from force placing insurance when they know the consumer has insurance or fail to take reasonable actions to determine whether the consumer has insurance;

enjoin the defendants from charging unauthorized fees, and place limits on specific fees

require the defendants to acknowledge, investigate, and resolve consumer disputes in a timely manner;

require the defendants to provide timely billing information, including an itemization of fees charged;

prohibit the defendants from taking any action toward foreclosure unless they have reviewed the consumer's loan records to verify that the consumer failed to make three full monthly payments, confirmed that the consumer has not been the subject of any illegal practices, and investigated and resolved any consumer disputes;

prohibit the defendants from piling on late fees in certain situations;

prohibit the defendants from enforcing certain waiver provisions in forbearance agreements that consumers had to sign to prevent foreclosure; and

prohibit the defendants from violating the FDCPA, the FCRA, and the RESPA.

To provide further remedial relief to consumers harmed by its practices, Fairbanks will correct certain open accounts that may have been classified wrongly as delinquent, re-classify these accounts as current, and report to any consumer reporting agency previously provided with information about the consumer's account that the account is current and that the prior record of delinquency should be removed from the consumer's report.

Today, the Commission filed the two settlements in U.S. District Court for the District of Massachusetts in Boston for approval. The settlement with the corporate defendants will not become final until the related class action settlement is approved in final form by the Boston court. This process may take several months.

If the court approves it, affected consumers should receive a notice of the settlement in the mail that will explain how they can participate in the redress program. The Commission's toll-free consumer hotline regarding the settlement is 1-877-862-0886. Consumers who have changed their address recently may provide updated contact information by calling the hotline. Consumers also can find information about the settlement on the FTC's Web site at www.ftc.gov. At this time, it is not necessary for consumers to take any action other than watching their mail for notice of the settlement.

CONSUMER EDUCATION

Today, the Commission also has issued a consumer brochure, Mortgage Servicing: Making Sure Your Payments Count, to help consumers understand their rights. The brochure explains mortgage servicers' responsibilities, in particular under the RESPA enforced by HUD. The brochure urges consumers to keep records of their payments, insurance coverage, and other information, and explains how consumers can file disputes with their loan servicer. The brochure also includes sample letters that consumers may use when filing a dispute with their lender/servicer or with a credit bureau. I just checked my bank account again, an today Fairbanks, PMI, have cashed only one of my payments for my 2 loans for September. Nothing has or is currecntly showing change. This is clearly BIGGER than the Inron issue, Yet the Feberal Govermnet has done an show not to be doing anything to stop any of this.

Here is a thought, why is it the Federal Goverment has not SIEZED these three companies Fairbanks works under?

Why do they not due a Feberal AUTATING OF THE 3 companies who are ILLEGALY stealing homes? It would take them year to even begin to try an figure out the accounting of those three companies...so what! Then let it take years, then they will see the truth!

MY FIRST MISTAKE WAS ABOUT 2 YEARS AGO IN TRUSTING A MAN WHO SAID HE WOULD GET JUSTICE FOR ME. I NEW AFTER THAT NOT TO TRUST ANYONE. PEOPLE CALLED ME TO ASK ME FOR HELP AN I WILLING DID SO.



THEN EARLY THIS YEAR I GET A CALL FROM AN ATTORNEY WHO SAYS HE WILL LEAD ME IN THE RIGHT DIRECTION TO GET THE ISSUES RESOLVED. NOT ONLY HAS IT NOT HAPPENED, I WAS VERY MUCH BETTER OFF CONTINUING THE FIGHT ON MY OWN.



I TRUSTED PEOPLE WHO I HONESTLY BELIEVED WERE WILLING TO HELP NOT JUST ME BUT THE THOUSANDS OF OTHERS WHO HAVE BEEN DESTROYED BY FAIRBANKS AN PMI.. AGAIN, I WAS CLEARLY WRONG. Be nice, be firm and don't blow up in anger. Ask to speak to someone involved with presenting the proposed Fairbanks settlement to the commission. If they offer to have someone call you back, tell them you'll hold. If you get someone's voice mail, call back and ask to speak to a live person.



Be persistent. You want to get someone to listen to how bad this makes the FTC look in the eyes of the tens of thousands of past victims and the future victims.



Tell them Fairbanks is getting away with a tiny slap on the wrist while BILLIONS of dollars and thousands of homes have been taken from the victims of their scam. They won't believe you. Tell them that BILLIONS have been taken and put in the pockets of attorneys. If they can't figure out the math, tell them about the $1000 or more in bogus legal fees taken from tens of thousands of victims.

FYI - should have mentioned - You'll get a menu - press option 5 and listen to the nice music while you wait -and when they do come on the line, they are very pleasant, but actually their job is to take complaints not transfer your call to someone.



So complain! Tell them you're not happy with the paltry settlement in the Fairbanks Capital case!



They'll basically take your information and put in your comments in the database under Fairbanks Capital. I even complained about the FTC rolling over and playing dead on this one.



You'll get a case number. Whoooohooo! It's official!



The more complaints about the settlement, the more notes are there, the more the commissioners and investigators will realize how bad the settlement is.



According to the person I talked to, they use the database entries to measure the level of interest in any situation.



So let's start getting their attention!

Amanda - the reason they are, and will continue to be vague about the credit reporting issue is they have little or no control of what happens once it leaves their computer. It's a bit like starting a s****.> They never expect to have to run down and stop the avalanche - that's someone else's problem.



They won't say they will fix it because all they will do is make another report and watch and see the damage from up on the hill.



And if they slipped and gave you evidence that they knowingly put false data in, it could cost them $1,000.00 for each violation.



Don't count on Fairbanks to fix the credit problem; you're going to have to go after all four credit bureaus and keep on them at least once a quarter.



And if you miss one payment or they decide to delay processing a payment, the whole game begins all over again.



Until the fines for this activity become meaningful or people go to jail for it, it will just go on and on. If our legislators don't get the message in the next 12 months, that's our fault.

The only people who will see a dollar are those that have overwhelming physical proof and are willing to go through an excruciatingly detailed claim process.



You'll have to convince an "independent" overseer - probably from the FTC or HUD or perhaps an administrative law judge or a court-appointed trustee, that they did what you said they did.



Don't forget what Ozanne was quoted as having said in a conference call: "We have the regulators under control," or as another reporter quoted: "We have the regulatory arena under control." While taken out of context, the statement is one of those things that may be more revealing than anyone realized at the time. Obviously, the PR firm wasn't in control of the meeting!



Because of the tiny fine ($15M) there are obviously no criminal charges being readied, so you have to guess the regulators have been co-opted into accepting the "we just made some mistakes" spin.



The scary part of that is it means they actually trust the people at Fairbanks. They don't believe the victims. They don't believe the scam was deliberately operated. That's really bad news for anyone who has to go before one of them and argue a case against Fairbanks.



When you do win something, you'll also have to sign away your rights to future litigation. And your days of posting messages on the 'net or talking to the media or complaining to anyone will be over - at least until they do it all again.



My recommendation: Don't sign something this important without having a pit bull attorney on your side - one that knows better than to trust anyone from a company that willingly operated a scam for years.



FYI - If they are still returning your payments you are indeed headed into default.



And no matter what they tell you or anyone else tells you, your credit will never be fully "corrected." There are lots of things in credit bureau systems and other "information services" that you and I can't see or even have changed if we did see it.



Things are not "removed." Comments are placed and some things are not reported to inquirers or aren't supposed to be used in a FICO score, but they are still there. You can be assured that there will be a note about a settlement that somehow magically affects your FICO score.



What's more, the proliferation of other types of consumer and personal information databases has distributed old credit data into all kinds of places it shouldn't be, and those may never get an updated report.



Chances are, they know exactly how many cases they have to really worry about and they've put enough money in the kitty to cover them.



Everyone else they will build a smokescreen over and probably get away with it.

I, of course, have continued my research & discovered that Fairbanks wasn't licensed in FL to act as a Correspondent Mortgage Lender until July 10, 2002. Interesting that they've been servicing FL loans MUCH longer than that. Kinda looks like they shouldn't have been servicing ANY FL loans & CERTAINLY not have had the Jacksonville processing center opened prior to then. Nor should they have been able to Forecloses on any homes in Florida.

This is a reply from an Attorney I know. I sent her a letter that I sent Fairbanks an PMI., over a year ago. I explaine to her about my payments being sent back. This is what she had to say.

Well, that letter is very detailed in the questions it asks and the information it requests! RESPA does require the disclosure of information by a lender/servicer to a borrower. However, I am sure that when Fairbanks got this multi-page letter asking for all this information, they probably just ignored it and went about business as usual. In any correspondence, I always recommend trying to be a short, yet inclusive, as possible because I think that people, in general, lose interest in what they are reading after the second page. Additionally, Fairbanks obviously is engaging in questionable practices, so why would they want to respond in writing with information which might actually show these practices.

A borrower has the "right" to not be subjected to deceptive or illegal marketing tactics.



A borrower has the right to obtain credit counseling prior to closing on the loan.



A borrower has the right to have a lender consider a borrower's ability to repay the loan before such credit is extended.



A borrower should receive an "identifiable" benefit when charged a "fee" or higher interest rate to refinance a loan.



A borrower has the right to not be subjected to a "requirement" that he or she finance any portion of points or fees.



A borrower has the right to "decline" credit insurance in connection with a loan.



A borrower has the right to have favorable information reported to credit bureau on a timely basis.



These are "Your" rights. Mr. Ozanne promised he would send them out to each of us. However, holding true to the dishonesty an illegal practices Fairbanks an he have not done so.

Inept mortgage firms anger home owners

SAN ANTONIO -- For most American home owners, mailing a monthly mortgage payment is a routine experience.



But for the thousands struggling with poor service

from mortgage service companies, the experience can become horrible.



Robert Doggett, a Texas Rural Legal Aid attorney, has 12 years of experience protecting home owners from bad mortgage companies.



"The laws are not helpful or clear," so mortgagees

"push the limits -- they rob equity," Doggett said. "They're all doing these tactics, and their attitude is, 'We'll see who goes to jail.' "



When a home owner gets stuck with an inept mortgage company, the warning signs often show up early.



Billing is done through a mortgage servicer, which may be a subsidiary of the lender or a separate company contracted to manage the account.



Mortgage companies commonly take over huge portfolios involving thousands of loans from other companies. The first 60 days after a loan transfer is critical, and most home owners find this is where their problems start.



That is what Gloria Cortez, a San Antonio insurance agent, learned. Her mortgage company acquired her account in January 2002, and her first correspondence from them was a February letter notifying her that her account was in default.



Cortez knew her account was current, but she didn't know the new mortgage company already had violated federal law. The home owner's first letter from the mortgage company should be a notice of which company now holds the account. It should also say that no late fees or other penalties can be charged during the first 60 days.



A spokesman for Cortez's mortgage company claimed her account was in default from its first day. But

Cortez's previous mortgagee said it transferred the account in good standing.



The mortgage company forced Cortez into what's called a workout agreement, which meant she had to pay $230 extra each month to catch up on several alleged missing payments.



She also was forced to send extra money for an escrow account to pay her taxes. Cortez protested, submitting written proof that she had a payment plan with the county tax assessor. Her mortgage company repeatedly ignored her protests and even claimed to have paid her taxes, yet the assessor had no record of payment from the mortgage company.



When mortgage companies neglect or mishandle accounts, the home owner pays the consequences.



Some mortgage companies fail to pay property taxes. Another common abuse has to do with late- payment fees. Some companies seem to habitually assess late fees regardless of when they receive payment.



Because of that, Cortez, who was told her mortgage was in default, pays $11.95 extra to send her payments by Western Union on the due date.



Despite her promptness, Cortez repeatedly has been

charged a late fee.



James McMillen, a consumer-protection lawyer in Corpus Christi, Texas, said mortgage companies also throw irregular payments into something called a suspense account.



It starts when a home owner pays more than what is due to accelerate payoff on the principal, but does not specify how the extra money should be applied.



"They throw that into a suspense account until they can figure out what to do with it," McMillen said. "It doesn't get counted as the monthly payment, and several late charges may accumulate. Instead of applying it to principal, they apply it to the late charges or escrow."



Every month, for days at a time, Patrick Gill of San Antonio says his answering machine is filled with messages from his mortgage company, even though he pays on time. Gill and his wife have good jobs and do well enough to send their two daughters to a Roman Catholic school. But their experience as first-time home buyers has not been pleasant.



Although Gill sends his payment, which is due on the 15th, on the first of the month, he begins to get calls on the 16th, asking him why he has not paid.



"It takes them 15 days to post the payment; sometimes they don't get it at all and we have to stop payment on the check," he said.



"The last thing I'm going to do is lose my home," Gill said. "We're just praying somebody will buy (that company) out."



A buyout might solve the Gill's problems, but once a mortgage company fouls up an account, any successor company usually inherits the errors, experts say.



Still, the lousy record-keeping can help those acting on behalf of a home owner.



"I haven't lost that many houses," Doggett said. "Even after the foreclosure, I still sue."



Mortgage servicers, Doggett said, often cannot locate paperwork.



"It's hysterical to watch them try to find their own documents because they churn so many loans," he said.

Hi,

This is something sent by my "Friend" to the supposedly "TRUST WORTHY" man who started the Conti-Fairbanks site.



What a joke. & I mean your entire website.



I have been working to resolve a "missing payment" since July of 2002. I filed the proper letter of dispute of amount owed w/ Fairbanks on August 8 2003 after more than a YEAR of unreturned phone calls. They're response was to schedule a foreclosure hearing & NOT INFORM ME of the time or date of the hearing. Now, I can't get any Fairbanks employee to even acknowledge that letter. (Thank God for fax reports)



I didn't know about the hearing until 3 wks AFTER it occurred when a private investor called me after seeing the sale date on court dockets. I was VERY upset because I wanted NOTHING MORE than to get in front of the judge & get court intervention. A fact that I made VERY clear to Fairbanks employee Chris Sayer when I filed the original letter of dispute on August 8th which has now disappeared within the walls of Fairbanks. No proof, of course, but it reeks of deception & is VERY illegal to not serve someone who is being brought to face a judge.



I immediately contacted Fairbanks, filed another (longer, more detailed) RESPA letter & was assured by Greg Harmer both verbally & via email that the sale was stopped.



TELL ME WHY I WAS AT THE COURTHOUSE ON THE SCHEDULED DATE OF SALE & THE SALE WAS STILL ON THE BOOKS??



I'll tell you instead. Fairbanks representatives filed the cancellation with the WRONG JUDGE. If not for MY DILIGENCE my home would have been sold. Of course, I have no proof that this was done intentionally, but it certainly follows the pattern set by Fairbanks over a year ago.



As for the borrowerhelp.com comments about the small number of people posting on websites & making actual complaints ~ PEOPLE ARE SCARED. I have been dragged thru the mud, called horrible names & told to pay up or pack. Since posting my email addy in the yahoo group I have received emails from no less than 100 individuals who are afraid of the consequences of public posting but who are looking for guidance in handling what is for them, an embarassing situation. It took me a YEAR of TRYING before I went public. YES, I too was scared. Stirring the Fairbanks pot leads to foreclosure. Open your mouth & they will do whatever necessary to shut it up. Including selling your home out from under you. I am living proof of it.

They're response was to schedule a foreclosure hearing & NOT INFORM ME of the time or date of the hearing. Now, I can't get any Fairbanks employee to even acknowledge that letter. (Thank God for fax reports)

I was VERY upset because I wanted NOTHING MORE than to get in front of the judge & get court intervention. A fact that I made VERY clear to Fairbanks employee Chris Sayer when I filed the original letter of dispute on August 8th which has now disappeared within the walls of Fairbanks. No proof, of course, but it reeks of deception & is VERY illegal to not serve someone who is being brought to face a judge.



I immediately contacted Fairbanks, filed another (longer, more detailed) RESPA letter & was assured by Greg Harmer both verbally & via email that the sale was stopped.



TELL ME WHY I WAS AT THE COURTHOUSE ON THE SCHEDULED DATE OF SALE & THE SALE WAS STILL ON THE BOOKS??



I'll tell you instead. Fairbanks representatives filed the cancellation with the WRONG JUDGE. If not for MY DILIGENCE my home would have been sold. Of course, I have no proof that this was done intentionally, but it certainly follows the pattern set by Fairbanks over a year ago.



As for the borrowerhelp.com comments about the small number of people posting on websites & making actual complaints ~ PEOPLE ARE SCARED. I have been dragged thru the mud, called horrible names & told to pay up or pack. Since posting my email addy in the yahoo group I have received emails from no less than 100 individuals who are afraid of the consequences of public posting but who are looking for guidance in handling what is for them, an embarassing situation. It took me a YEAR of TRYING before I went public. YES, I too was scared. Stirring the Fairbanks pot leads to foreclosure. Open your mouth & they will do whatever necessary to shut it up. Including selling your home out from under you. I am living proof of it.

FAIRBANKS & PMI..THEY KNOW WE KNOW THERE CRIMINALS..

Informative response. I do find it curious as to mention of the servicing contract, ie, the original lender and their contract for servicing with Fairbanks (or any other). To me, it is immaterial what any agreement made with a servicer says, as any fees are provided for, specifically, in your mortgage contract. Neither the lender, nor Fairbanks, may alter the terms of the contract without agreement from you, and all such amendments must also conform to your particular States law.



For example, I live in the state of Wisconsin. The law provides for both judicial and non-judicial foreclosures, but my contract specifically reads that ANY foreclosure actions will be judicial......therefore, no matter what the original lender and service may "agree" to, I have the right to have my case heard before a judge.



The same contract does not allow for Property Preservation Fees. Prior to refinancing my wifes mortgage away from Fairbanks, they had tried (actually they did) to access such fees. We had to go to court, but those fees came off.



My point is that a legally binding contract has been signed. Both sides are legally bound to it. Live up to your end and make the payments and Fairbanks et al will have to live up to theirs. Most large cities have free legal clinics. Please take the time to visit them and to really understand what is in your contract.



Fairbanks was Hell and lots of trouble.....but stick with it. It's not what they say or do that is ultimately pivital, its what is in your contract. Hang in there, know your contract, and when you must, fight like the dickens!



I want to know with all the complaints against FB, what are we going to do about the way they have been able to take our property, finances, savings, etc and continuing to stay in business? Is FB Capitol going to be another Enron that has now become a faded past?



We need to stop and think about what we need to do. The judiciary system, the judges, and the firms of Fairbanks hired guns have violated our civil rights. FB Capitol could not continue to do this without the backing of unfair judges and unscrupulous lawyers that are hired by Fairbanks to illegally charge outrages, penalties, fees, insurance, attorney fees and who violates our due process of the law in the court room under the very nose of judges that are partial to their greedy industry.

Fitch Revises Rating Watch On Fairbanks' Servicer Ratings to Negative from Evolving



NEW YORK--(BUSINESS WIRE)--Oct. 8, 2003--Fitch Ratings revises the Rating Watch on Fairbanks Capital Corp's (Fairbanks) residential primary servicer ratings to Negative from Evolving for its 'RPS3-' sub prime and home equity loans,

'RPS3' servicer rating for Alt-A and its 'RSS3' special servicer rating, pending Fitch's determination of the impact of recent changes to their processes regarding the reconciliation of property values used in its net present value

(NPV) model.



These rating actions are the result of Fitch's concern over the procedural changes that Fairbanks has recently implemented in order to streamline the process regarding the reconciliation of broker price opinion (BPO) values. BPOs which fail logic test thresholds are referred to its appraisal review department

for reconciliation. The reconciled value of the properties is then used in Fairbanks' NPV model. Fairbanks' NPV model determines the best execution for loss mitigation initiatives. Fairbanks also relies upon this model to determine requirements for advancing which is based upon the evaluation of the potential

recoverability of the advances. Fitch has viewed this procedure, which relied upon reconciled values, as one of the strengths in Fairbanks loss mitigation processes.



The prior thresholds caused a significant number of BPOs to require econciliation by the appraisal review department. This area was unable to handle the volume of referrals, which in turn caused a backlog of files. Rather than addressing this problem by providing additional resources for its appraisal review department, Fairbanks chose to amend its criteria for thresholds across the

entire portfolio. Based on the criteria change, a significant number of the BPOs no longer required reconciliation.



The impact of this change immediately allowed Fairbanks to be reimbursed for a significant amount of advances that they previously made as well as potentially limiting the amount of future advances. Fitch acknowledges that the determination of non-recoverability and the reduction of future advances may very well have the result of reducing severities. However, it may also have the impact of reducing the amount of current cash flow to bondholders. Fitch concurs with the need to actively address the process which resulted in the existing backlog of reconciliations, and the associated time delays. However, Fitch is concerned about the impact this process change will have on Fairbanks'

determination of future loss mitigation efforts, which are dependent on appropriate valuations, and therefore the final net effect on the performance of deals.



Fitch will be evaluating this process change, and its impact on the Fitch rated transactions, and based on the results of its findings will make a

determination as to its impact on Fairbanks' servicer ratings. Fitch will be further evaluating the reasoning for effecting this process change, as well as the company's efforts to identify other potential problem areas, previously believed to be operating efficiently.



Fitch will also continue to monitor Fairbanks

execution within their stated plans as well as their ability to maintain adequate staffing and facilities, quality control, and performance levels.

Each of those offices did receive my information that I sent. The receipts I have show that the AG office did receive the information that I sent. The first date June 13, Agusust 20th an the 26th. The name in the area is not legiable.



I sent the coplaint for that is listed as well, as a detailed letter of what in "fact" had occured by Fairbanks and PMI.. I sent a few of the letter plus my full report that I filled on rip off report.com. That file has all info but for the letter Fairbanks and PMI., had sent to me. I did sent the letters I did received from them. I have so much information of the illegal

practices of these companies, that it would cost me a large amount to send "all" the information that I have.



The complaint I have stated is "fact" not alleged. There have been hundreds of complaints filed against these companies. AG. Crist, appeared himself on Fox responding to those complaints. I do understand that your verbage used

is for legal perpases. However, some of it would be best changed so that the consumer does not feel that they are being attached or being called

dishonest.

I CAN NOT BELIEVE AFTER FIGHTING THESE COWARDICE CRIMINALS FOR 6 YEARS, I DID NOT NOTICE THAT THEY WERE PUTTING 3/4 OF MY LOANS INTO THE INTEREST. I HAVE 2 LOANS 1 $ 417.85 AND $ 162.70 TOTAL $ 508.55. I WENT TO THE SIGHT AND WOW...ON MY FIRST LOAN THEY ONLY POST ABOUT $ 30.00 TO THE PRINCIPLE AND THE REST TO THEIR INTREST. ON THE 2ND THEY POST ABOUT $ 12.00 AND THE REST TO INTEREST. IT IS CLEAR WHY I DID NOT NOTICE. IN THE SIX YEARS THEY HAVE "RAPED" ME, I HAVE ONLY RECEIVED 14 STATEMENTS. THE LAST ONE IN FEBRUARY OF THIS YEAR. NOTHING THAT FAIRBANKS AND PMI., DUE ANY MORE SURPRISES ME. MY LOANS TOTALED $ 63,000.00 WHEN THEY TOOK THEM. GUESS WHAT I OWE AS OF TODAY! I think rumors are going to start coming out about the consent decree (read: the get out of jail free card for Basmajian, Smith, Garland, Harmer, West, etc.) with Fairbanks.



So the servicing industry is holding their breath.



Servicing company employees are being told to soft-pedal any cases that they might have some exposure on, which means they've gotten word from their insiders at Fairbanks about what would be considered grounds for real FTC penalties under the upcoming "standards." They're scared **itless that the feds will tie them to a leak, so there is going to be nothing in the news media until the people in Washington give the OK.



But for the rest of the loan victim situations it's pedal to the metal because they now know what is coming and they won't have to worry unless their facing a civil lawsuit from the victim.



Expect to see the worst of the servicers appearing to be overly nice and cooperative to avoid being looked at for "Fairbanksing a borrower." (Does that new super-nice guy at Litton seem just a bit suspicious???") They have insider contacts among the ousted Fairbanks managers that know what the FTC and HUD were digging into, so they are trying to change their spots before the feds come calling.



Can't take credit for it, but I kinda like the term "Fairbanksing!"



The really dedicated greedy will figure away around the rules as often as they can, but at least some people are going to get some temporary relief.



My moose-sense tells me we're going to hear something soon. But I'm not counting on hearing about jail sentences, so the fight is far from over.

My name is Joe and I have been fighting Fairbanks Capital and PMI. now over 5 years. I have filed all my complaints in written fashion as well as emailing the office Government that "should" be not only helping me but all "states". I am attaching my file, which you will see is very time consuming. However, it will only touch on what I have been through. I can not find and "Honest" Attorney who will take my case against these Monsters. What you will notice is there are major Law Firms...Class Action..who are willing to take the cases. This does "nothing" for the person or consumer who has been hurt. It does allow the Attorney's and Firms to take in Millions for them and not for the people who were in fact affected by the "illegal" practices of these Monsters. Please, I pray that someone will "REALLY" take notice of the stealing and thieving that Fairbanks and PMI.. are willing and openly doing for "ALL" to see very clearly. I do not understand why the people elected officials in all states are doing "Nothing" to help the people who elected them into office. The United States Of American, was founded on "FREEDOM", in it being said, it did not mean that anyone has the right to willing "Steal" from another. That is why there are laws for criminals who commit "illegal" acts. Fairbanks and PMI., should be punished just like any other criminal would be. That being said, not just monetarily but in serving "Prison" time just like I would if I were committing these crimes. My hope is that you will reach out to the other Senators in the states. Dear Joe,



It is so disheartening to read these reports over and over of the long struggles people are enduring with these mortgage-servicing companies. (Or should I say non-servicing companies?)



It strikes me as odd that companies that tout themselves as top-of-the-line, state-of-the-art, technologically advanced servicing companies are so piss-poor at the very job they claim to do best!



How is it possible for these modern up-to-date companies to lose three-fourths of any payments and paperwork addressed to them? Does not matter how you send it; fax, Western Union, US Postal Service, pony express or carrier pigeon, it evaporates the minute it gets in their office. Sometimes it resurfaces, but always after the due date. Sometimes it never shows up in Fairbanks' records, but your bank shows your check has been cashed. It's an adventure to see what will happen next!



No other industry in this country would last long claiming to be the best and performing in such an inept manner. This site alone would sink that nonsense. The FTC would be all over it for deceptive advertising. And yet deaf ears get turned to anyone ensnared in this tangled web of deception. That is very telling.



I have noticed a great decrease in the number of Fairbanks complaints on this site. I am not foolish enough to believe that anything has been or is being fixed at Fairbanks. I think everyone has been so exhausted by their struggle, as you have, that they breathed a sigh of relief when the Feds went in and have relaxed waiting to see. Relying on the Feds to take care of it.



I do not believe that the Feds are capable of regulating this beast. For one thing, they have no real legal tools YET. This industry as a whole fell through the cracks of legislation when it was formed. So, it is pretty much wide-open as evidenced in the people drawn to it in the beginning. When former criminals start and work a scam this huge for as long as it went on at Fairbanks without check, that is a danger signal. When attorneys run backward from it, that is a danger signal. When your own state AG refuses to respond to your correspondence, that it a danger signal.



There are things being done. Eyes are being opened, notice is being taken by people who can really do something. In spite of its attempts to always back a winner in the political arena, this industry is not owed favors by every politician.



Laws will have to be put in place, but there seems a resistance to that in some quarters. There are politicians still trying to pass laws that will allow these companies to put Americans into the street even faster than before! You will need to research that area on your own as to call any names is to risk attempts to turn this into a political debate. Check out your state and national elected leaders and see how they rate on this issue.



As much as I would like to tell you step-by-step how to fix this and make it all right, I cannot. You can contact Senator Barbara Mikulski (D-MD) who is very interested in this issue. You can log your complaint here (if you have not already done so):

Doing this will add your voice to those of others. Numbers count in these issues.



I can tell you that your continued struggle IS absolutely the right thing. Do not rely on a Federal fix at this time. I believe that this first attempt will result in a small band-aid pasted over a sucking chest wound; absolutely ineffective and will save no lives, but it shows a feeble attempt to help.



I think there will be a half-a$$ed consent decree issued. Then Fairbanks will swear that it will toe the line and whitewash itself to present the appearance of being fresh and new. The Feds will leave and Fairbanks will return to its business of sucking its hostages dry and leaving them homeless. I may be wrong and in this case, very much hope so. (I have learned in life to always expect the worst. I am rarely disappointed. And if it should come out better than expected, then its gravy!)



All I can do is encourage you in your fight and let you know that you are not alone in your struggle. Many people are working both quietly and publicly to try to rope this wild beast. It has been allowed to get too fat and sassy and it is now showing itself to be hard to handle and very temperamental. Too much big money is involved and that always creates problems.



I continue to pray for all victims of these scams. May you have the strength you need to continue in your endeavor.

A few months ago I filled my 3rd complaint with the Attorney General Office on the well know company Fairbanks. Each time I sent it, I sent it certified U.S. P.. I have yet to hear you say anything further on this issue of Fairbanks. There are thousands of us in Florida alone that are still having their homes stolen from by Fairbanks. We are spending money we do not have to fight this company and all of its mother companies. I have been fighting Fairbanks since 1998 and now I am "clearly" not "alone" on this issue any longer. It has become a state wide problem and yet I do not see that any of the elected officials are doing anything to help us or for that matter, to stop Fairbanks from "illegally" stealing our homes and our "hard" earned money.



Please tell me Mr. Christ, what are "You" doing to stop Mr. Ozanne, Fairbanks and their mother companies from their "illegal" practices?

Hello Everyone,

I am sad to see that on a daily basis, there are more and more files against Fairbanks & P.M.I.. If you have read my file from the start you will read that this thieving company has not and is not doing anything to stop the illegal practices that they "Willingly", committing.



Mr. Ozanne, as the New CEO of Fairbanks, has told us on more than one occasion that things at Fairbanks were changing, due to the New Management Team they have hired. What a bunch of Bull Poo! Nothing has been done to change or stop the illegal practices of Fairbanks. What Fairbanks, Mr. Ozanne and P.M.I. have done is simply replaced the previous "THIEVES" that were in the positions and making worse hired them at hirer salaries, which means that are "stealing" even more than previously.



If there were any hint of truth to the bull that came out of Mr. Ozanne mouth, we would not see "new" daily files and files that have been updated. It is clear to my from the Original report on the front page of this sight with the Big hand in the camera, that this is not the first or last time that those who started Fairbanks, did it with money that they stole from the Government and the Banks of our Great Country. Yet, not only does it tells us that something is definitely wrong, it would tell us that the people "we" put in office our criminals as well. That they are, taking pay offs or willing allowing Fairbanks as well as other Lenders, to steal our homes and money from us. No matter how we view it, it still comes out to be the same thing that we are saying. Fairbanks and the Politicians are stealing our "dreams" from us with out even giving thought to us but knowing that it will make their bank accounts allot bigger.



I have 2 loans with this company that never sent me any information telling me they bought my loans. As you have read above, everything still remains the same. Fairbanks, is still trying to steal my home and still trying to bills me for fees that they can not explain. In the 5 years that Fairbanks took my loans, I received no more that 14 states ments from them. Just about February of this year 2003, I received one statement from Fairbanks, when I have 2 loans. I have not received another one from this sense that time. I did notice 2 things when I did received the one statement. They change the format of the statement and the statements are sent out by a "bulk mailing company". This would tell us that the company is not doing there job. It is clear that Fairbanks knows we do not get our statement, yet they do nothing to the bulk mailing company, which still makes Fairbanks at FAULT! I keep getting phone calls from Fairbanks, when they know that they are NOT to be calling me at all. They have the cease and desist letter I sent, yet they willing break the law and keep calling me. Every month it takes Fairbanks, anywhere from 18-30 days to post my payments to my account, this of course allowing them to hit my accounts with late fees. They sent me another letter on the fact that they forced insurance to my accounts. Yet, I have sent dozens of information proving that I have insurance on my home. The letter stated that If I do not send the additional money to them, this will "send me into foreclosure". Well, first I have insurance and second if I did not, how do I know how much I am to send on the loans. They have not sent my anything tell the additional amounts that would need to be sent.



This clearly is a HUGE issue, that not only involves Fairbanks but it involves elected officials as well. If this is ever really Looked at, it would not only Destroy Fairbanks but put allot of Fairbanks persons and elected officials in Prison...were they should be. I am add to this some other stuff I sent but did not make it to the sight. I hope each of you will keep up the fight.

To Mr. Ozanne,

I have never heard so many lies come out of one mans voice in my 34 years of life. This by far is not a new issue for you or for Fairbanks in general. Your company has remained the same sense I was hit by there illegal and unethical practices back in 1999. At no pint have you mad any attempt to fix any of the issues that you have know about sense the beginning. Yet, I am sure that you continue to enjoy your million dollar income and the jet that takes you every where you go. G..at least I now know where the money that Fairbanks has stolen from me has gone to. I have been one of the original voices against Fairbanks and now you as well. I am one who noticed the illegal practices and theft of Fairbanks and now you from the beginning. It is now 5 years later and 3 months later and all the lies that came from your mouth have done nothing to help any of us. I will tell you what Fairbanks has done to me and what you continue to help them do. Fairbanks as well as you have caused me a level of "STRESS" that I never new existed! I have nearly gone into a complete mental and physical break down due to Fairbanks and yourself. It has cost me more money than I have mad. The doctor bills and medicine bills just keep piling up from the amount of stress that Fairbanks as well as you have caused to me. I take medicine on a daily basis to help me sleep to function and to be able to "try" to keep my mind in focus.



In the last 5 years due to the illegal harassing Fairbanks and you cost me my career, due to all the phone calls I received at work. From all the daily stress and harassment that Fairbanks and you continue to cause me, not only did I lose my career but other great potential position that I would have easily been able to succeed at. That is, had I never come in contact with Fairbanks and you. I continue to struggle everyday due to your company Fairbanks tell me over 2 years ago that they would correct "ALL" of the errors they had mad on my accounts. They stated they would stop calling me yet every day hour on hour they keep calling me adding more and more stress into my life. WHY, is it that Fairbanks as well as yourself "NOT" kept your word? O, I know the answer. It is because Fairbanks and you are "THIEVES"! Well Mr. Ozanne..Fairbanks and yourself have foreclosed on my home twice due to the errors that Fairbanks and you mad. Fairbanks and you have caused me my mental and physical being first and for most and then you both willingly continue to harass me on a daily basis and "STEAL" my money. This in fact may be the death of me but make "NO" mistake about it Mr. Ozanne..I will die fighting you and Fairbanks to save the home that I have worked so hard to buy and keep. I am very stressed out and sick everyday due to the on going stress and harassment from Fairbanks and you but I will "NOT" allow either of you to "STEAL" "MY" home from me! Mr. Ozzanne, one day we will all answer for the things we have done in your life. Mr. Ozanne, I would "NOT" want to be Fairbanks or you when that day comes. I "WILL FIGHT" You and Fairbanks till my last breath is taken. Remember you said 3 months ago you would be sending us out a bill of rights. Where is it, I have not received it as of today. Here is what you should be sending out to all of us who have already been ripped off and for those to come in the future. It was best said by some one like this.



Dear Borrower,



Fairbanks Capital Corporation, specializes in collecting loans from those who are considered to be sub prime borrowers.



Your loan is due on or before the 1st of the month. We will initiate the fast track to foreclosure process we have in place if we do not receive your payment on or before the 1st. We will start the process then even if your contract has a 14 day grace period.



We do not guarantee that your payment will be processed in a reasonable period of time.



We will assess late fee charges to your account based upon our own mistakes. You must check your account on line everyday to be sure your funds have been attributed to the category you designate or phone our office everyday to get the status of your loan if we have made a mistake.



We will put your funds in a suspense account instead of applying the funds to your mortgage balance. We will not notify you that funds have been placed in a suspense account. It will be your responsibility to find the money and what we have done with it yourself nearly every month.



You may call our customer service representatives who will agree there has been a mistake on your account but sadly they have no authority to correct our mistakes.



There will be no record of phone calls that you make. You must continue to write letters and phone our office until we correct our own mistakes or you will be considered late and a deadbeat.



We may assess your account and threaten you with forced placed insurance even though you provide proof of coverage, if we cannot find your FAX or letter in our office. We do not recognize proof of service as legitimate notice you have provided proof of coverage to us.



We will demand that you sign forbearance agreements wherein you agree to waive your rights to litigate now for past causes and in the future in case we make more mistakes in servicing your loan.



We will include fees for services performed that we do not itemize or substantiate and unless you agree to pay these charges without complaint or demand for certification that these funds were expended, we will foreclose on your home.



We will send you the forbearance agreement to sign and return within too short a period of time for you to have the opportunity to consult legal counsel to determine whether it is in your best interest to sign it.



We will sell your house at auction without notifying you.



Sadly, for you, we can do all these things because there are no regulations preventing us from doing so. We will exploit your loan to the fullest extent we can get away with and maybe a little further because we have found, you will not complain in writing, you will not write your elected officials and demand investigation and remedy for the borrower.

You promised borrowers a bill of rights over 2 months ago, where is it?



Mr. Ozanne, you promised a top-down review of all servicing processes to see where there are problems, and to fix them expeditiously.



The "top-down" review is not working, and you are very aware of where the problems are. We recommend that you rewrite your plan. Borrowers are still having their homes taken away, fraudulently. Do you not see the urgency in this matter? Your plan to change Fairbanks and it's practices are bogus.



Fairbanks Capital holds the top position in the mortgage servicing industry of aggressive collections and foreclosures. You have proven that, to all of us.

Clearly, you can be just as aggressive in your plan to correct Fairbanks ongoing illegal actions against borrowers.



Mr. Ozanne, you stated in your above letter that the percentage of loans in which there is a dispute with the borrower has declined by more then 30% over the past two months.

That statement may actually be true, borrowers are no longer calling Fairbanks Capital to dispute ongoing issues with you're abusive representatives. Borrowers are now filing lawsuits with the help of the many lawfirms across the Country that are now eager to help.



Your commitment to resolving existing issues with borrowers in a timely and equitable manner is not showing true.

Mr. Ozanne, for you see it is not just "me" any longer there are now THOUSANDS of us and we will fight Fairbanks till the end.



It is clear to me that Fairbanks and the new CEO James H. Ozanne have no intention of ever correct the errors they have mad or stopping there illegal practices. I have been seeing 2 doctors for the last 5 years do to the harassment and illegal practices of Fairbanks. It seems just when I try to get them out of my mind and try to just relax they make there presents know. On Friday 8-15-2003 I returned home from work only to receive not only 4 calls from Fairbanks but late notices for the month of July on my loans. I sent those checks to them on the 17th as I do every month. Fairbanks, did not cash one of my checks till the 7th of August 2003 and the other on August 8th of 2003. I live in Florida and send to Kentucky, how can it take 21 days to receive and cash my checks. We know the answer to that, so they can try to collect there late fees.

I can not tell you how much more stress this added to me. I was to have worked on Saturday the 16th and did not because I could not focus and just needed to try and relax. I met my friend Laura who is part of my prayer group and we spent the day together. I was feeling really good after praying and just enjoying life, which I have not done for the last 5 years due to Fairbanks. It would have been a very successful day, had I not returned home. I got home and again Fairbanks called to inform me that I was late on my loans by 2 months. This just put me right back where I was prior to starting the day. This has got to stop. I am just hanging on to my job. I am on F.M.L.A. from my doctor due to stress and fatigue. I am taking medicines to help me sleep and function on a daily basis. They are not helping me at all any longer. I am not sleeping, I can not concentrate or focus, I have no energy what so ever, which is making me gain weight and further put stress no only mentally but physically as well. Fairbanks is literally driving me insane. I only have 20 hours left on my F.M.L.A. and when that runs out what am I to do. My company will not continue to excuse my absents from work. I have missed so much in the last 5 years do to all the harassment and stress Fairbanks has and remains to put up on me. I am behind on all my bills and my car loan soon I may loose everything and then I will not be able to pay for my home. Nor, will I be able to afford to keep being treated by my doctor, for I will have not health insurance. Every day I pray that Fairbanks will just stop the harassment and the stress in my life. I even keep them in my prayers asking the Lord to touch them and make them realize the pain they are illegally causing in peoples lives. My Faint in the Lord is the only thing that keeps me going. I will tell you what I miss most in all of this, "ME". The man that used to smile everyday, the one who used to play softball 3 nights a week, the one who used to me active with the 10 children he is God Father to.

Fairbanks, has not just destroyed my life but the lives of those that Love me so much. For 5 years Fairbanks has put me on a non stop roller coaster and I have been screaming ever sense to stop and left me off. The willing continue to brutally attach me, causing me pain that I really cant even describe fully in words. I truly feel like Fairbanks has "RAPED" my soul!!! I will continue the fight with Fairbanks, and hope that they realize what they have done to me and many others. Keep up the fight even when you feel like you have lost.

Subject: FAIRBANKS CAPITAL...UNETHICAL, RIPP-OFF...COMPANY OF THIEFS...FRAUD ARTIST...GOVERMENT ALLOWS IT...



This is a statement of the Unethical and Fraudulent of Conti Mortgage and Fairbanks Capital.



In October of 1996 I bought a house and had if finance with a company called Conti Mortgage. With this company it was my understanding that we would be responsible for paying the home owners insurance and the property taxes on my own, due to they did not do any kind of escrow. I understood that at that time we would have disability insurance as well and that it was in our monthly payment. It went well for about the first 2 1/2 years with Conti but for they were not sending out the statements for us to send in and that they did not report to the credit burial. In 1999 I continued to send my payments out as I should. I continued to send my payments to Conti, until one day my phone rings and it is some male who said his name was Tom. He told me he was calling about my loans and that I was 3 months behind and if I did not make a payment with him right then they would foreclose on my home. I said to Tom that I have my bank statement showing that Conti had cashed my checks. He advised me I was no longer with Conti, I was now with Fairbanks Capital.



I advised Tom that I had no idea who Fairbanks Capital was, nor did I get any kind of notification that my loans had been sold to anyone. He continued to tell me if I did not pay them that I would be out on the street and they would take my home from me. I once again advise Tom that I had prove to show I paid my payment to Conit as the agreement that I had with them. He went on to tell me I was and idiot and allot of other things if I thought for one moment that he would not make sure my home was taken. I advise him if he called me again threatening me with my home without even knowing who he was, I would call and attorney to stop the calls. I then called Conti and they said that they were no longer in Business and sold all of there loans to many different companies and that I should get something showing that soon. I advised Kelly that I mad my payments to them and they said that I was 3 months behind. Kelly, then told me that she pulled my file they had and it showed that the payments had been forwarded to Fairbanks Capital. She told me that she would again forward the paper work to show them payments were current. Kelly, then told me that Conti had sold my loans to Fairbanks as of July, 1999.



In early August 1999 the calls started coming in on a daily basis not only at home but at my work place Tech Data.



The calls at my home would come in on a average of 10-15 times a day. It would be some one different each time they called. They would tell me that I was 3,4 and even 5 months behind on my loan. Each time someone called they would say something different then the last person who called. There would be times when they would say one of my loans is 2 months late and the other is paid for the next 3 months. I would tell them each time that they called that they had mad and error in posting my payments. They did not want to listen to that, they would say I had to prove I mad my payments or they were going to take my home and I would be out on the street. Previously, around the 2nd week of July I was getting phone calls at work. The calls would come in 3-4 times a day from some one who called himself Mr. Jones. He would curse at me call me names tell me I needed to get another job and pay what I owed. He went on to call me a loser and tell me that me and I was a stupid person if he thought I was playing around. Each time he called me at work I would advise him that the calls were being recorded and he would say I did not give you permission to record me. I would tell him that when he called me at work the voice prompt tells you that your call will be record and used in a training format. Mr. Jones continued to call me at work and the calls at home kept coming in as well.



I went to my Manager at work Patty Dixon and told her that I was getting these calls and on several occasions I would have to leave work to go to the bank to get copies of all the checks to fax to Fairbanks. I left work on 4 or 5 different occasions to go to the bank and get copies only to return to work and fax from Tech Data all the info of the check showing that I had paid my loans as required. It did not good, the calls at home kept coming in and Mr. Jones just kept on calling me at work. The last week of July Mr. Jones called me at work and I asked him to hold. I called my Manager Patty Dixon at the time and asked her to listen in on the call. She did just that and told Mr. Jones who she was and that he had better stop calling me at work and harassing me. That did not work either Mr. Jones continued to call. It was taken to the H.R. Office of Tech Data and they said they would have the calls stopped. They had 2 calls record with Mr. Jones harassing me and calling me names as well as telling me I would be out on the street. The calls then stopped at work from Mr. Jones. However, the calls at home increased. They would call me every hour on the hour and it would be a different person each time. I told each of them the same thing, that I was not behind and that not only had I faxed the paper work 4-5 times I had sent it to there dispute department certified on 7-8 different occasions. I did all I could and it did absolutely no good. Fairbanks just continued on. It got so bad that I could not sleep, eat or work. I had to take months off of work and see the Doctor who treated me for depression do to all the harassment that Fairbanks was putting me through.



I had to start taking medicine to help me relax, sleep and to be able to function so that I could try to pull myself back together and return to work. The medicine did help for a while but then the Doctor had to change and put me on other things so be able to function on a daily basis. The medicine help very little I was just at my limit trying to fight Fairbanks and prove them wrong. I had to call my parents and tell them I needed there help because I did not have the will to go on any longer. They came to me right away and I told them of what was going on. My mother sent Fairbanks all the info that they had asked for do to they continued calling me. I had to borrow $ 5,000.00 dollars from them to be able to catch up on all my other bills for the house. They stayed with me for a month and I went back to work I believe in early August of 1999. I had to advise my company that I was on medicine and that there would be times when I would have to leave do to not being able to function correctly.

I did my best to work but it was just so hard to try and work. I was so stressed out for all the harassment Fairbanks was continuing to give me that I just wanted for life to end. I started to visit with a local priest and he would counsel me on how not to give up and how the Lord would see me through it all. He was so helpful to me. He help me to realize that life was a blessing and no matter how hard it seemed I could make it through. I really thought I had till I started getting calls again August at work from Mr. Jones. He began calling me in about the 2nd week of August 1999. He would tell me I better get my stuffed packed because he was going to see that my home was taken from me. He called every day till one morning in August at 5:30 a.m., there was a knock at my door and it was the sheriffs department serving me with a foreclosure notice. This just sent me in a down word spiral to back where I could not function and became very ill.



I went back to the Doctor and it was thought that I had throat cancer. However, it was my thyroids and they were over reacting do to the amount of stress Fairbanks was putting me through. My throat became so bad I could barley swallow or breath. I had to have my friend AMY come and stay with me so that I would have someone to watch out for me. Amy, called the attorney who was listed on the foreclosure paperwork and told her of what I had been going through and how sick I had become from the stress that Fairbanks had put on me. She the attorney said she did not care the paperwork she had showed that I was in breach of my notes. She told Amy that she would be calling me with a court date soon. A day or two went by and I started to feel better with all the medicine I was taken, it began to help.



I called the attorney myself and when I did she was not available but I spoke to her assistant Shirley who I explained everything to. Shirley advise me to bring in all the paper work I had to prove that I was not at fault and that Fairbanks had mad the errors. I took them copies of all of my checks and paper work from Conti and Fairbanks. Shirley told me the attorney was not available once again but she would call me. A couple of day went by and I had not heard from them. However, I had heard from Mr. Jones who told me that I would be homeless soon and I deserved it. I sent emails to all the local news channels, to 60 minutes, to 48 hrs, to all the talk shows I could think of and no one would help me. A day later the attorney called me and said that I would not being going to court and she had the foreclosure stopped. Even after speaking to her I still continued to get the calls from Fairbanks Capital.



I sent Fairbanks Disputed Department all of the paper work on about 22 different occasions showing them they mad the error and that the attorney told me so. I included that I did not want anymore calls to come to me at work or at home. They just continued to call and I continued to send them the paper work. It just did not good. I then started getting paper work showing they were billing me for home owners insurance do to there records showing that I had none. I faxed them the prove as well as my insurance company faxing it to them on dozens of occasions. It did not stop and Fairbanks continued to call me. I still was seeing my doctor and was still taking the medicine to help me sleep, relax and function. I was so stressed out and taking so much medicine that I fell back in not wanting to live any longer.



I had done all I could and yet Fairbanks was still harassing me and putting me in financial disaster. I was borrowing money from one place to pay another because I was not receiving full pay from my job. I spent money sending all this info to Fairbanks time and time again and yet it did not good. I was about to have my power phone and other house hold things disconnected when I had to call my parents once again to borrow money to pay the bills. I had to borrow $ 3,000.00 this time to pay for my car and car insurance, power, phone, cable, food and medicine. I really thought that it was now about a year later and Fairbanks would correct all of there errors. That had not an they have never sent me any paper work to show me that they had my loans, as well as never sending me statements to send them payments.



Then I get a call from my home owners who said that they would not be renewing my insurance do to all the harassment they had received from Fairbanks. About 3 weeks later I get a letter from them telling me they were canceling do to hurricane issues. I called Kathy at the insurance and said that I did receive the paper work but it said it was because of hurricane issues. She told me they had to list that for legal reasons and could not list it was from the Fairbanks harassment. She did go on to tell me they canceled all the Fairbanks customers policies. Now I had another stressful issue to deal with. I had to go to my credit union and borrow money to pay my property taxes do to not being able to pay them from not being able to work with the stress Fairbanks was still putting on me.



I went to a company to try and re finance my home. The company was Apex and they said that they would do so and help me pay all my other loans off to get me back on track. They pulled my credit report and there was nothing showing from Fairbanks or from Conti. They sent all paper work to Fairbanks and called them to get the paper work they needed to complete the transaction. They called me to say that Fairbanks would not respond or corporate with them on this. They worked and worked it did not good. They pulled my credit report once again and it had showed that there was now a foreclosure on my credit report and that on 22 different occasions I was 30 days late on my payments.



Apex, continued to try and get the info they went as far as sending one of there investigators to the different states trying to get Fairbanks to respond. Now, three months later they say they will not be able to help me do to Fairbanks not responding and that they found out that Fairbanks was a Corrupt Company. They told me to try to find an attorney who could help me. I did, I spoke to 15-20 attorneys would said they would not touch Fairbanks. They all said the same thing but would not tell me why. Even after all I had done and sent to Fairbanks, and after speaking to "there" attorney who admitted it was "all" there error, I still was harassed by Fairbanks.

Now, I forgot to tell you about Bob. He was a very nice older gentleman who came around on behalf of Fairbanks to give you notice that your loans were behind. Bob, came to see me on 8 different occasions prior to the foreclosure. He and I talked each time that he came by on behalf of Fairbanks. He told me of horror stories that of others who too were with Fairbanks and how they stole there homes and that all of them said that Fairbanks was posting there payments incorrectly as well. After the foreclosure was stopped, Bob stopped by to see my one last time. He came by on his own to tell me how happy we was to see that I was fighting Fairbanks and not letting them "steal" my home from me. The same month which I believe was late September of 2000, I received a letter from a young lady who told me that all of my late fees had been credited back to my account as well as my credit report being corrected within the next 30 days.



I called her to say Thank You for some one finally taking notice of the errors that Fairbanks had mad. I asked her about the money that Fairbanks was escrowing for insurance and she said they would stop and credit that back as well. She told me that I would not get anymore calls at home or at work per my request. I felt a big relief when we finished the call, but it was all to soon.



As so many times prior I called Fairbanks to once again advise them that I was still not receiving my monthly statements and that they were still charging me late fees. I advise them again that they were holding my checks each month till after the 1st so that they could be me with the late fees. Each time the reps said the same thing, we mail them out we can help it if you are not getting them. I would tell them that it was nearly impossible for them to be sending them out each month and me not getting any of them. This was all in 2001 and the calls from Fairbanks again started coming after they clearly were advised in writing that they were not to be calling me. They were calling me to tell me that they had not received my payments for the loans. They then again would call and say that they showed one of my loans was paid way ahead and the other behind. Each time saying they would correct it. I advised them that I send out 2 checks with the account #s listed in the memo part so I could not understand why they continued to do what they were previously doing. They would tell me they had not such notes of ever receiving notice not to call me. I told them I had the letter and they said of course to fax it. I did just that on 10 different occasions to 10 different person who all chose not to correct the issue. Instead, they continued to call me on a daily basis not just once or twice but about every hour. I begged them to stop harassing me and causing me this heavy stress. I even told them that because of Fairbanks I was seeing a doctor and taking medicine to be able to function. The callers just laughed and told me if I was not such a loser and paid my bills on time that they would not be calling me. They did not stop they just kept calling hour after hour on a daily basis. I went out an bought an answering machine and started screening my calls just so I would not have to speak to them. It did no good, some one would call MR.,MRS.,MISS., OR Ms. and then say you need to call me back immediately and make a payment on the phone for your loans on the house or we will begin foreclosure again.



I started calling attorneys again and again they kept telling me they would not touch the Fairbanks company. I sent emails and letters once again as well in September of 2001. They all said the same thing nothing they could do to help me. I sent letters to the Banking commission, the Better Business Burl, the Governor, the Mayor, to every one I could thing of including the Attorney General and THE PRESIDENT of the United States. All of this and no one could or would help me. I became bad once again, I am 6-2 and got down to 145 pounds all from the stress that Fairbanks was putting on me. I could not sleep, eat or work. I had to take 3-4 months at a time leave from work to try and get myself together and get Fairbanks to stop harassing me.



I stopped taking the medicine and seeing the doctor because I could not afford to do so. Then suddenly after nearly 3 years of faxing and sending emails and certified letters, Fairbanks stopped calling me. I started feeling better and was able to go back to work. I had to go and get another loan to pay my property tax which I am still paying off. I then had to go get another loan from a company to get all my bills paid and I am still paying off. Things really started getting better, I had a new job and a new start.



Then the believable happened, Fairbanks started calling me again. I just could not keep going through this it was going to kill me. I had to leave my job, I became sick again, I had not medical insurance and had to go to the emergency room for care. This cause even more big bills and medicines that I could not afford. At this time my parents are paying my loans on the house and I am sicker than ever. I do not know what more I can do but to send out the paper work that I had sent what would seem like 100 times before. This must have worked because the calls just stopped once again. It is ending 2002 and all seems to be going well. Then I get a call from Fairbanks attorney and she tells me they are getting ready to foreclose once again. I send her all the paper work again plus the new copies and I do not hear anything more.



It has now been a few months with no calls and not hearing from Fairbanks.



Then at the end of 2002 I started getting calls from people who were having trouble with Fairbanks and wanted to know how I stopped them from taking my home. I advised about 25 people that they would just have to send all there paper work time and time again as well as calling them and calling Utah, the corporate office. They each said they no attorney would help them either. I told them they would just have to fight but that I could not go through it again it nearly killed me.



Then in December of 2002 I tried again to re finance my home with H&R Block. They were more than happy to help me and had helped many others with Fairbanks get away from them. This really added some good back to my life. Then the calls from Fairbanks started again. I told John from H&R Block to please hurry and get this done. He said they were not responding to him and that he was trying. Then they sent the pay off's on the loans and they had $ 5,000.00 tacked on with out and showing of why and it showed that I was paying for home owners through Fairbanks in escrow which was incorrect.



Well, I called Fairbanks to ask them what this was an they told me it was for foreclosure, attorney and collections fees, as well as for people coming to my home to make collections and check the home out. I told them they really needed to stop this harassing me. It had been 3 years and they said on 2 separate occasions that all was corrected and my loans were fine. This is during Christmas and it just really put me back in a state where my mental and physical being were very much at risk. I just said that there is no way to stop this from happening. I called Fairbanks and told them that they actually owed me money sense they got my loans from Conti. I had disability insurance with Conti and it should have rolled over with them. They told me they had not record of it and I was out of luck. Funny this company is stealing my money and then to add they steal more by saying I did not have the insurance.



Then in January of 2003 I received a letter From Fairbanks telling me that they again had received my letters and emails from Utah. The lady said that all would be corrected on my loans and that all late fees would be credited to my account. She went on to say that all fees would be credited back and my credit report would be corrected in 60 days.



This once again left me with a "false" sense of security. That false security lasted for about a week and they again called me to say that one of my loans was behind. I advised them that they were not to be calling me and that I again have a 2nd letter that I just received to say so. Now, you know what they wanted me to do. I faxed the letter to them and the calls still continued for about another week then just stopped.



Then in April and March of this year I received calls from 2 different attorney from California that said they were going to file a class actions suite against Fairbanks as well as Conti. I told them it did me no good being here and them there and they said they would stay in touch. Then in May of this year I saw a new report on Fox 13 News that Fairbanks was brought out in the open and if anyone needed more info please contact Eric Seidel at Fox. I did just that and advised him that I did the same 3 years ago but he as well as everyone else would not help me. He put me in touch with a lady from Miami Dade county. We emailed and spoke on several different occasions. She pointed me to Rip-Off Report.com. I went on a filed a complaint against Fairbanks and was astonished to see all the others that were there as well. Then the next week I got calls from several attorney's who wanted me to become part of their suite. I received calls again from California, Utah. Kentucky and Florida.



Then Eric Seidel called me and spoke to me about Fairbanks. I advised him once again that in email I had told him I had gone through this sense 1999 and he did not help me nor would anyone else. I asked him why I should think differently today. He said he was sorry about what happened prior and now Fairbanks was out in the public eye and I should go after them. He gave me his wife's and phone number and told me she was an Attorney as well, of Seedily & McGory. I called Mrs. Seidel and we spoke.



After speaking she advised me of what was currently going on and that I had every right to file against Fairbanks and they would be happy to represent me. I met with Seibel, McGory and Attorney John A. Yanchunis and spoke on what had happened to me. They told me that upon leaving the office I would not be represented by all of them. I was told that if anyone else contacted me to tell them I was represented and to call them. Just shortly a day or so after I did get more calls from other Attorneys. Then I started getting calls from Fairbanks once again about my payments being two months behind. I told them they were not to be calling me and harassing me. They just continued to call me. Then suddenly I start getting statements that were months I have already mad payments for. They show that Fairbanks is escrowing my money again with no reason. Then just recently I received and letter from Fairbanks tell me my home owners insurance had been canceled and they would be billing me for insurance to protect there interest.



I then received a letter this week telling me that I had not paid the years property tax and if I did not with in the next 30 days they would start foreclosure once again. I have not paid them but that is do to all the money I had to spend sending them the same info over and over and over. From not being able to work all the time from the stress and mental pain that they have put up on me.



I am back seeing a new doctor sense the beginning of this year for the same thing I was seeing the last doctor for...Stress, anxiety and fatigue. I am on 3 different medicines to help me relax, sleep, and function. This has caused me to miss work once again falling behind on my bills and paying out more money for the doctor and medicines. I do not know what more to do to get Fairbanks to stop trying to steal my home and stop harassing me.



I can not tell you the amount of mental and physical stress this company has put me through. Then on top of that they have just about financially destroyed me. I only hope is that I can come up with the money to pay the taxes in the next 30 days and that the attorneys will be able to help me get Fairbanks to stop trying to kill me with the stress they put on me.

I have been fighting Fairbanks for over 5 years now and it still has not stopped. I have an Attorney or Firm that is, that said they would be representing me in my own case against Fairbanks, instead of being part of a Class Action.



That was 4 months ago. I recently received a call from one of the Attorney's and she told me that the Firm they were working with had decided to just add me to the Class Action. I asked why and no real answer could be given. Needless to say, I did not trust anyone prior to speaking to them, because I had tried so hard for the last 3 years to get some one to help me and no one would. I will tell you that included all the local New Channels as well as the Big Network shows...20/20, 48 hrs, 60 minutes and 60 minutes 2. I sent letters to the Attorney General and they would not help.



After being told I was being entered as part of the Class Action against Fairbanks, this just added more stress to my life. I have lost so much as of today and it just keeps getting worse. When I did some research on Class Action Attorney's, I was very rudely awakened to what was being said about them. Just about 3 weeks ago, I sent another email to 20/20 about Fairbanks and Class Action Attorney's. They were looking for shows to cover. To my surprise, just last Friday night, 20/20 did a short coverage on Class Action Attorney's. I must tell you it was equal to dealing with Fairbanks. Rather then tell each of you what I mean, I would ask the you go to ABC.com and click on 20/20 for the recent story on Class Action Attorney's and the comments that followed from the viewers of the show. I will included my comments to the show and one from an Attorney, who said that Class Action Attorney's were nothing more that Greed Monsters. If anyone knows of an Attorney or Firm that will take my case for me and not what they can gain from it, please let me know. I am in Florida and would appreciate any help from any one who could give some.

I am an attorney who also teaches college and law school. I have been

discussing the realities of class action lawsuits with my students for

years. They are the great rip-off of the American public. If, as the

attorneys' claim, they are protecting the consumers, then perhaps they

should get reasonable attorneys' fees and costs and the remainder should go

to the public...there are certainly enough charities out there which need

funding. Bottomline: The system allows these greedy attorneys to accumulate

massive attorneys' fees under the guise of protecting the consumer. I have

received my share of "coupons" over the years and I reject the system, as

should every other thinking attorney in the United States. Shame on us.

I am truly sorry for all the financial and emotional upheaval you have been

through with Fairbanks over the last five years. However, Fairbanks will

continue in their activities until the attorney general's office finds

THIS IS THE EMAIL I SENT TO FAIRBANKS ON MORE THAN 1 OCCASIONS. THIS WAS LAST NOVEMBER.

To Whom It May Concern:



Once again I find myself having to send a letter to Fairbanks Capital for errors they have mad on my loans they purchased. Two years ago I sent copies of all of my checks that had been cashed by Fairbanks Capital and yet it did no good they foreclosed on my home. However when it came time to set a court date it did not happen.



I received a 2nd letter from the Fairbanks Capital attorney that stated that they had correct the errors that they had mad on my loans. It went on to tell that the Foreclosure had been stopped and I would not be billed for any of the process.



I then sent a letter to the Fairbanks Capital Dispute Department on 5 separate occasions, each time by certified mail. In the letter I sent Fairbanks Capital a copy of my credit report showing that Fairbanks Capital has reported against my credit that I had been late 30 days on 22 different occasions, which was incorrect! After sending the same letter 5 times I did receive back a letter that stated Fairbanks would be correcting the credit report as well as the late fees that should have never been charged. In the letter it stated that they would remove the Foreclosure from my credit report as well which, none of this has been done.



Once again I am receiving phone calls from the Fairbanks collectors stating that I am late on my loans when in 'Fact" I am not. Fairbanks Capital again has been posting my payments to one of my loans when I have 2. This is what was previously being done by Fairbanks Capital which caused the Foreclosure to start. I was then informed by 3 different collectors that I was being billed in escrow for attorney fees, as well as charges for collection attempts and inspections of my home. None of this should be occurring it is Fairbanks Capitals error in posting my payments to one of the loans instead of both. I send 2 sprat checks each with the account # located in the memo part of the check. There should be no attorney fees being billed to me do to Fairbanks Capital making the error.



As for inspections of my home no one as ever come to my home for any reason but for the Sheriffs department to serve me with an improper Foreclosure note. It has now been 32 days sense I started receiving calls from the Fairbanks Capital collectors and the last one was Thursday night from Miss Brown who was less than ethical and has no idea what it means to be professional or to have any form of Integrity. When I tried again to explain what was occurring she said it was my problem and I would have to have it corrected. She then transferred me to customer service without even advising me that she was doing so.



I have now spoke to 21 different people in 32 days with not one of them correcting the error that Fairbanks Capital has mad. I have spoke with 15 different customer service reps that have stated they have filled out the paper work for the loans to be corrected and yet as of today this has not been done. I spoke to Julian explaining to him that I should not be receiving calls from Fairbanks Capital at all. When I sent the certified letter 2 years ago it stated very clearly that they were to stop all phone calls at my home as well as my work. I know it was received do to having the proof from the certified letter that was sent.



I asked Julian why it takes 15-25 days for Fairbanks Capital to cash my checks that come from Florida and go to Kentucky, as well as to why they keep posting payments to one loan instead of both. He stated it should take to longer than 5 days but I have the records to show each month Fairbanks Capital will cash my check on the 1st or after then charging me late fees to there advantage.



I then asked him about the attorney fees that were being billed to the escrow on my account, he said he did not see that. I told him that each of the collectors had told me that they were there and my statements show that Fairbanks Capital has been escrowing money on my accounts. I then advised him of the letter I received back from Fairbanks Capital stating they would correct the improper Foreclosure on my credit report along with the late fees which, till this day still has not been done. Still till this day no one at Fairbanks Capital has been able to tell me why Fairbanks Capital continues receptively to post my payments incorrectly.



I again advised Julian that though I do not receive my statement each month I still send my payment to the same place I have sense Fairbanks Capital purchased my loans. Just today I received statements that are from October when they should be for November.



Julian assured me that the miss posting would be correct and yet I am still getting calls from Fairbanks Capital collectors on this issue. I keep explaining the same thing over and over and over and over. This tells me that no one at Fairbanks is listening!

This will make the 15th time that I am sending a letter to Fairbanks Capital about the Harassing phone calls that need to stop! In the same requesting Fairbanks Capital to correct my credit report with the Foreclosure and late fees with all 3 credit agencies. I am again asking them to stop improperly escrowing money on my account when they do not have the right to do so.



The only money that I owe Fairbanks Capital is for the 2 loans they purchased from my previous holder nothing more. Please know that at all times I have held myself with the highest of Integrity and Professionalism which, I can tell you Fairbanks Capital has not. I have calls that are recorded from when I was called at work with a man who call himself Mr. Smith calling me a loser stating I was basically a dead beat and needed to get a 2nd job to payoff my loans with Fairbanks. I have a cabinet that is filled with certified letters I have sent on all of these issues that Fairbanks has caused. I have spent thousands of dollars not to forget the stress and mental abuse I have gone through do to Fairbanks Capital. I again am asking Fairbanks Capital to correct all that I have mentioned and stop the harassing phones calls which stem from the errors that Fairbanks Capital has mad.



As of today I am holding a credit report that still shows the Foreclosure on my home as well as 30 days late which as never occurred. Please someone at Fairbanks Capital take control of the issues I have mentioned and correct the errors that have been mad by Fairbanks Capital. All I ever get from Fairbanks Capital is it is not my job or my department or you need to call customer service.



I have done all of that and it all stems from errors Fairbanks Capital has mad, yet no matter what I do I still get the same harassing and threatening call from Fairbanks Capital. I just spoke to Michele in customer service explaining again to him then asking for a customer service Manager which I help 20 minutes for and never got to. Please whom ever get this take pride in what you do show that u as a representative of Fairbanks Capital does care about the Integrity of there company. I will Thank You in advance for taking the time to read this and it hopes that you will correct the issue mentioned.



I have sent the same letter to The F.D.C.P.A. as well as the Attorney General and The Better Business Bureau.

Once again Fairbanks has been calling me none stop to tell me they have not received my loan payments for the month of May. I sent them out to them on May 20th and as they due so offten they cashed my checks on the 2nd so that they could charge me for late fees. I have sent this to everyone I can think of including the Attorney General in the state of Florida. Yet no one has ever replyed to me. I just today sent an email to another contact her in Florida in hopes that we can do something together to put a STOP to Fairbanks illegal practices. In hopes that I can recover all of not only money for the money they stoled from me..but as well for all of the time and stress they put me through.
